The property is zoned RSF-8, RESIDENTIAL SINGLE FAMILY, 8 UNITS PER ACRE and contains approximately 36.62 acres. The request is to rezone the parcel to R -A, RESIDENTIAL AGRICULTURAL. RECOMMENDATION: The Planning Commission and staff recommend approval of the requested rezoning as depicted in Exhibits 'A' and 'B'. BACKGROUND: The subject property is a City owned parcel located southeast of the intersection of Persimmon and 54th Avenue, and contains approximately 36.62 undeveloped acres within the RSF-8 zoning district. The Westside Wastewater Treatment Plant is located to the south and the subject property was acquired as part of that original land transaction. The property was zoned from R -A to RSF-8 in 2007 in anticipation of a land sale to a residential developer. The rezoning was subject to a Bill of Assurance limiting the use to 143 single-family lots, in preparation for development of a subdivision. Request: The request is to rezone the subject property to R -A, Residential/Agricultural to facilitate construction of a five -megawatt solar generation facility for the Westside Wastewater Treatment Plant. Master Street Plan: The property is traversed by the conceptual improved alignment of Persimmon Street (Minor Arterial) that was anticipated at the time of residential development of this site. However, the Master Street Plan can be accommodated generally utilizing the existing Persimmon Street corridor without having to fully bisect the property or negatively impact the planned solar facility. Land Use Compatibility: The proposed zoning is generally compatible with existing land uses, particularly to the south and east, where adjacent property is undeveloped, owned by the City of Fayetteville, and preserved or developed with the Westside Wastewater Treatment Plant. To the west, smaller lots and residential uses are less compatible with some land uses available within the R -A zoning district, especially certain agricultural uses, like animal husbandry and dog boarding. As an area on the urban fringe of Fayetteville, the land uses around this parcel are mixed, displaying the older pattern of large lot agricultural use and newer suburban style sub- division developments. Land Use Plan Analysis: The proposed zoning is consistent with the Future Land Use Map (FLUM) of the City Plan 2030, which designates this area as City Civic Institutional Area. Among the uses allowed by -right under R -A, is Use Unit 3, which allows uses for public benefit, including public protection and utility facilities, which aligns the zoning, land use, and ownership. DISCUSSION: At the November 26, 2018 Planning Commission meeting the item was forwarded with a recommendation for approval by a vote of 6-0-0. One adjacent property owner to the north asked if the future solar farm would affect their property values. Planning Commission November 26, 2018 Agenda Item 10 18-6441 City Owned Property Page 1 of 13 INFRASTRUCTURE: Streets: The subject parcel has frontage access to North 54th Avenue as well as West Persimmon Street. North 54th Avenue is an unimproved collector with open ditches on either side. The City Master Street Plan classifies Persimmon Street to the east and west as a Minor Arterial, realigning southward through the property. The City's Master Street Plan indicates the intent to realign Persimmon Street, a Minor Arterial, southward through the subject property. Water: Public water is available to the site. There is an existing 8" water main along North 54th Avenue. Sewer: Sanitary Sewer is available to the site. There is an existing 10" sewer main which fronts the subject parcel at the northeast corner. Drainage: Any additional improvements or requirements for drainage will be determined at time of development. A small portion of the northeast corner of the subject parcel is located in the flood zone. Owl Creek, a protected stream runs north -south on the northeast corner on the subject parcel. No portion of this parcel lies within the Hillside -Hilltop Overlay District. A large portion of this parcel consists of hydric soils. Fire: The Fire Department did not express concerns with this request. Police: The Police Department did not comment on this request. CITY PLAN 2030 FUTURE LAND USE PLAN: City Plan 2030 Future Land Use Plan designates the majority of the property as City Civic Institutional Areas. These areas are dedicated for buildings generally operated by not-for-profit organizations dedicated to culture, government, education or transit and municipal parking. FINDINGS OF THE STAFF A determination of the degree to which the proposed zoning is consistent with land use planning objectives, principles, and policies and with land use and zoning plans. Finding: Land Use Compatibility: The proposed zoning is generally compatible with existing land uses, particularly to the south and east, where adjacent property is undeveloped, owned by the City of Fayetteville, and variously preserved or developed with the Westside Wastewater Treatment Plant. A determination of whether the proposed zoning is justified and/or needed at the time the rezoning is proposed. Finding: As noted above, the proposed zoning would align the allowable land uses with both the Fayetteville's comprehensive plan and the City's intended use of the property for preservation of a sensitive area and provision of public services. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: The proposed R -A zoning is not expected to appreciably increase potential traffic danger or congestion in the area over the current RSF-8 zoning district. In fact, rezoning the property as proposed will significantly decrease potential traffic by dramatically reducing the allowed density over the parcel. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: The proposed zoning is unlikely to result in higher density of population, and no undesirable load on public services. The Police and Fire Departments have not expressed concerns about the proposed zoning district. 5. If there are reasons why the proposed zoning should not be approved in view of considerations under b (1) through (4) above, a determination as to whether the proposed zoning is justified and/or necessitated by peculiar circumstances such as: a. It would be impractical to use the land for any of the uses permitted under its existing zoning classifications; b. There are extenuating circumstances which justify the rezoning even though there are reasons under b (1) through (4) above why the proposed zoning is not desirable. Finding: N/A RECOMMENDATION: Staff recommends forwarding RZN 18-6441 to the City Council with a recommendation of approval, based on the findings discussed throughout this report.
