WHEREAS, on September 5, 2017, the City Council approved Resolution 184-17 authorizing a
professional engineering services agreement with Garver, LLC in the amount of $39,950.00 for the design,
bidding and construction phase services related to the Meadow Street Parking Deck Rehabilitation project;
and
WHEREAS, on August 21, 2018, the City Council approved Resolution 177-18 authorizing a contract with
Steve Beam Construction, Inc. in the amount of $291,477.00 for the construction work associated with the
project; and
WHEREAS, since construction began, unforeseen conditions have appeared which require additional
engineering services in the amount of $80,100.00 and construction work in the amount of
$230,000.00 as estimated by Garver, LLC.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves Amendment No. 1
to the professional engineering services agreement with Garver, LLC in the amount of

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section I : That the City Council of the City of Fayetteville, Arkansas hereby approves Amendment No. 1 to
the professional engineering services agreement with Garver, LLC in the amount of $80,100.00 for additional
design and construction phase services related to the Meadow Street Parking Deck Rehabilitation Project, and
further approves a project contingency in the amount of $8,010.00.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment, a
copy of which is attached to this Resolution.

SUBJECT: Approving a resolution to amend the scope of the professional engineering
services agreement with Garver Engineering, LLC, and to increase the

with the Meadow Street Parking Deck Rehabilitation project, to approve a
contingency in the amount of $8,010, and to approve a budget adjustment.
RECOMMENDATION:
Staff recommends approving a resolution to amend the scope of the professional engineering
services agreement with Garver Engineering LLC (Garver), to perform additional services
associated with the exit ramp and north stairwell of the Meadow Street Parking Deck and to
increase the amount to $80,100 and to approve a contingency in the amount of $8,010.
BACKGROUND:
On September 5, 2017, the City Council approved Resolution 184-17 authorizing a professional
services agreement with Garver in the amount of $39,950 for the design, bidding, and
construction phase services related to the Meadow Street Parking Deck Rehabilitation project.
The Meadow Street Parking Deck was constructed in the late 1970's in conjunction with the
construction of the (then) Hilton Hotel. Restoration work was performed on the deck in 2005
that included concrete repairs, shoring, latex modified concrete placement and patching, trowel
applied concrete repairs, sealants, waterproofing, expansion joints, supplemental floor drains,
painting and miscellaneous other repairs to the Meadow Street Parking Deck.
More recent observations of the parking deck identified several maintenance issues that have
developed since the deck was last repaired, leading to the original agreement with Garver. The
repair items for this project include: the replacement of metal stair treads, the demolition and
complete replacement of both stairs serving the deck, repair and patching of concrete and
stucco surfaces, crack repair, painting, installation of drains and associated PVC piping,
application of a protective membrane to the top level of the deck, removal and replacement of
concrete sidewalk, and other miscellaneous items.
On August 21, 2018, the City Council approved Resolution 177-18 to award Bid #18-41 and
authorize a contract with Steve Beam Construction, Inc. (Steve Beam Construction), in the

amount of $291,477 for construction work associated with the Meadow Street Parking Deck
Rehabilitation project.
DISCUSSION:
Since the construction phase began, some unforeseen conditions have appeared.
1. The sidewalk replacement on the northwest corner of the structure exposed the stair
tower foundation blocks without steel reinforcements. Staff requested x-ray of the
foundation and supporting side walls of the tower which revealed lack of reinforcements
in all the walls. The engineers recommend demolishing the tower and design of an open-
air, free-standing stair tower modular unit that will remain independent from the parking
deck structure. The existing stairwell has not been deemed inoperable or unsafe for use
at this juncture, but it will continue to be monitored and evaluated prior to demolition.
2. Patching of the exit ramp at the southeast corner of the deck uncovered greater
deterioration in size and depth of the concrete slab than originally quantified. Upon
further analysis Garver has determined that remedial repairs could not be done, and the
demolition and replacement of the post -tensioned exit ramp concrete slab is necessary.
The existing exit ramp has been determined to be unsafe to use in its current condition
and is inaccessible at this juncture. The entry ramp to the west has been converted to a
dual -use entry/exit ramp and safety precautions have been installed to allow for two-way
traffic to enter and exit the third level of the deck.
Staff negotiated with Garver on the fee proposal for this additional work. In good faith, Garver
reduced their original quote 20%.
This amendment only includes the additional scope and fees associated with the engineering
design work and construction administration, however Garver has provided preliminary cost
estimates for the additional construction work of approximately $230,000. Approximately
$88,000 worth of work is estimated to be removed from the original scope, resulting in an
anticipated net additional construction cost of approximately $142,000. A change order request
will be forthcoming once a lump sum figure is provided by the on-site contractor.
BUDGET/STAFF IMPACT:
A budget adjustment from the Parking Fund Reserves in the amount of $88,110 will be
necessary to fund this amendment. This amount includes a 10% contingency.

AMENDMENT TO AGREEMENT FOR PROFESSIONAL SERVICES

CONTRACT AMENDMENT NO. 1
This Contract Amendment No. 1, effective on the date last written below, shall amend the original
contract between the City of Fayetteville (Owner) and GARVER, LLC (GARVER), dated September
5, 2017 referred to in the following paragraphs as the original contract.
This Contract Amendment No.1 adds professional services for the:
Rehabilitation of the Meadow Street Parking Deck
The original contract is hereby modified as follows:
SECTION 5 — PAYMENTS TO ENGINEER
Section 5 of the original contract is hereby amended as follows.,
The maximum not -to -exceed amount as specified in Section 5.1 shall be increased $80,100 from $39,950
to $120,050.
APPENDIX A — SCOPE OF SERVICES
The following items shall be added to the Scope of Services as detailed in Appendix A of the original
contract:
2.3 Geotechnical Services
Garver will subcontract with Terracon Consultants, Inc. to provide geotechnical services associated with
the Meadow Street Parking Deck Stair Tower replacement. Services include providing one (1) bore
approximately 20 -ft in depth, laboratory testing of the soil material to evaluate pertinent physical properties
and engineering characteristics of the soils to develop foundation recommendations.
2.8 Final Design — Stair Tower
Construction plans will be prepared for the demolition and replacement of the stair tower located at the
northwest corner of the Meadow Street Parking Deck that is more particular described below:
• Design of a free-standing stair tower modular unit that is independent from the parking deck
structure that will provide access to all three levels. The stair tower will be open to the
environment with a roof structure.
• The relocation of the existing fire protection shall be designed to meet the current fire protection
codes and the limitations of the open stair tower.
• Lighting for the new stair tower shall be designed to meet current electrical and fire protection

codes. If necessary, the exterior light pole and fixture located to the west of the existing stair
tower will be designed to be removed and replaced with a fixture attached to the stair tower.
Prepare specifications for the additional improvements.
p Coordinate the proposed improvements with the existing contractor to determine costs.
2.8 Final Design — Exit Ramp
Construction plans will be prepared for the demolition and replacement of the post -tensioned exit ramp
concrete slab located at the southeast corner of the Meadow Street Parking Deck that is more particular
described below:
On-site examination of the exit ramp by a registered professional structural engineer.
Develop construction drawings for the removal and replacement of the exit ramp concrete slab
complete with a plan of the improvements and structural detailing.
Prepare specifications for the additional improvements
■ Coordinate the proposed improvements with the existing contractor to determine costs.
2.10 Construction Phase Services — Partial
During the construction phase for the additional work, Garver will provide the following additional services:
■ Provide up to 29 additional hours to evaluate and respond to construction material submittals and
shop drawings associated with the stair tower replacement, exit ramp concrete slab replacement,
and appurtenances.
■ Provide up to 11 additional hours to issue instructions to the Contractor on behalf of the City and
issue necessary clarifications regarding the construction contract documents.
• Provide up to 18 additional hours for on-site meetings to assist the City during the construction
contract performance time.
2.12 Extra Work
The following items are not included under this agreement but will be considered as extra work:
1. Preparation and coordination to obtain any City Building Permits and Planning Permits. All
Items in conjunction with City permitting will be handled by the City.
2. Design of supplemental supporting columns and foundations associated with the southeast
parking deck ramp.
3. Redesign of the stair towers and ramp for the City's convenience due to changed conditions
after previous alternate direction and/or approval including the redesign to meet budgets.
4. Hourly work in addition to the specific time limitations during the construction phase.
APPENDIX B — FEE SPREADSHEETS
The spreadsheets contained in the attached Appendix B shall be added to the fee spreadsheets contained
in Appendix B of the original agreement.
