Mayor Jordan called the meeting to order. PRESENT: Council Members Sarah Marsh, Mark Kinion, Matthew Petty, Sarah Bunch, John La Tour, Kyle Smith, Mayor Lioneld Jordan, Assistant City Attorney Blake Pennington, Deputy City Clerk Lisa Branson, Staff, Press, and Audience. Resolution 175-18 as recorded in the office of the City Clerk Special Needs Assistance Program Grant Agreements: A resolution to approve the renewal of two Special Needs Assistance Program grant agreements with the U.S. Department of Housing and Urban Development in the total amount of $73,278.00 for the city to administer programs to assist homeless Fayetteville residents. Resolution 176-18 as recorded in the office of the City Clerk Bid #18-41 Steve Beam Construction, Inc.: A resolution to award Bid # 18-41 and authorize a contract with Steve Beam Construction, Inc. in the amount of $291,477.00 for construction work associated with the Meadow Street Parking Deck Improvements Project, and to approve a project contingency in the amount of $29,147.00. Resolution 177-18 as recorded in the office of the City Clerk City Parking Lot #55 Low Impact Development: A resolution to approve a cost reimbursement agreement with the University of Arkansas Cooperative Extension Service for funding in the amount of $20,000.00 for the installation of a low impact development feature in City Parking Lot #55 located at 401 West Watson Street, and to approve a budget adjustment. Resolution 178-18 as recorded in the office of the City Clerk What My Eyes Have Seen Photography: A resolution to approve Amendment No. 1 to the contract with What My Eyes Have Seen Photography for photography services to be provided through the end of 2018. Resolution 179-18 as recorded in the office of the City Clerk Food Loops, LLC Agreement: A resolution to approve an agreement with Food Loops, LLC for the hauling of compostable and recyclable material in the City of Fayetteville. Resolution 180-18 as recorded in the office of the City Clerk January Floors, Inc.: A resolution to authorize a contract with Tom January Floors, Inc. in the amount of $30,926.00 for replacement of vinyl flooring at the Walker Park Senior Activity and Wellness Center, and to approve a project contingency in the amount of $5,000.00. Resolution 182-18 as recorded in the office of the City Clerk RFP 18-05 AvFuel Corporation: A resolution to award RFP 18-05 and approve a one (1) year contract with automatic renewals for up to four additional one (1) year terms with AvFuel Corporation for the provision of aviation fuel and refueler trucks for Fayetteville Executive Airport -Drake Field. Resolution 183-18 as recorded in the office of the City Clerk Kerzen Properties, LLC: A resolution to approve a twenty (20) year ground lease agreement with Kerzen Properties, LLC for airport property located at 4240 South School Avenue for the construction of a 100' x 75' hangar, with an option to extend the ground lease for an additional five (5) year term, and with a first right of refusal to lease the property for an additional five (5) years after the hangar becomes the property of the city. Resolution 184-18 as recorded in the office of the City Clerk Taxiway B Rehab Grant Applications: A resolution to authorize applications for two Federal Aviation Administration 90/10 Grants for completion of construction phase services and project closeout associated with the Taxiway B Widening and Rehabilitation Project in the alternative amounts of $2,072,169.00 and $1,652,878.00, and to authorize Mayor Jordan to execute the grant agreement. Wade Abernathy, Building Maintenance Supervisor gave a brief description of the ordinance. Mayor Jordan: I looked at the stairs. I can assure you they need to be replaced. Don Marr, Chief of Staff spoke about doing repairs for the Town Center in stages. Council Member Marsh moved to suspend the rules and go to the second reading. Council Member La Tour seconded the motion. Upon roll call the motion passed 6-0. Council Members Bunch, La Tour, Smith, Marsh, Kinion, and Petty voting yes. Ordinance 6082 as Recorded in the office of the City Clerk Police Department Non-Motorpool Program: An ordinance to waive the requirements of formal competitive bidding and authorize the purchase of vehicles for the Police Department's Non- Motorpool Program in an amount not to exceed $30,000.00 per vehicle, and to allow the existing non-motorpool vehicles to be sold for trade-in value toward replacements. Assistant City Attorney Blake Pennington read the ordinance. Greg Tabor, Chief of Police gave a brief description of the ordinance. Harding Pl./Thompson): An ordinance to approve VAC 18-6148 for property located at 1901 South Harding Place to vacate a portion of a utility easement. Assistant City Attorney Blake Pennington read the ordinance. Garner Stoll, Development Services Director gave a brief description of the ordinance. Ordinance 6084 as Recorded in the office of the City Clerk Washington Willow Design Standards: A resolution to express the City Council's intent to create historic district design guidelines and/or create a design overlay district for the Washington - 113 West Mountain Fayetteville, AR 72701 (479) 575-8323 www fayetteville-ar gov City Council Meeting Minutes August 21, 2018 Page 6 of 7 Willow Historic District, and to approve a budget adjustment in the amount of $20,000.00 to provide funding for a project consultant. Garner Stoll, Development Services Director gave a brief description of the resolution. Council Member La Tour: If a citizen isn't satisfied with the decision of the commission that will eventually form, will there be an appeals process? Garner Stoll: Yes. It is governed by Arkansas State Law and it goes to Circuit Court. They can request changes to the guidelines. Council Member Petty: It says the Historic District Commission initiates the local ordinance. What is the City Council's role after this step? Garner Stoll: The Council would be the approval body for the district. If the Historic District Commission initiates an ordinance, it requires review by our Planning Commission. It requires notification to the property owners. It would come back to you for the creation of the district and only City Council can create the district. Assistant City Attorney Blake Pennington: The City Council would have the authority to initiate that themselves. Council Member Petty: Are the design guidelines focused on architectural and urban design factors or do they go beyond that to talk about land use more broadly? Garner Stoll: The reason we were suggesting both zoning overlay district and historic guidelines was so we could look at having them work in a complementary way. The zoning overlay district could deal with setbacks and building orientation. The historic design guidelines would look at setting up a certificate of appropriate process that would discourage demolition of historic buildings as well as approving appropriate changes to the exterior. Council Member Petty: Right now, it's possible through conditional use permits to do things like a cottage court or in some areas a duplex. Would you see any conflict with our current process for issuing conditional uses as arising out of this? Garner Stoll: I don't see a conflict. The district isn't uniformly single family. Teresa Turk, 1408 West Cleveland stated she is a member of the Historic District Commission. She spoke in favor of the resolution. Council Member Marsh moved to approve the resolution. The Wilson Park pool has extended its hours through Labor Day. We are going to have a new event at the pool on September 3, 2018 from 6:00 p.m. to 8:00 p.m. It's providing the ability to bring your pet to the pool. Information is on the city website. We have had some frustration about road and overlay projects taking place with the morning commute due to the start of school and U of A. We have tried to do a lot of public outreach to make people aware. Information is on the city website about delays due to construction projects. There's a special Parks & Recreation Advisory Board meeting on August 23, 2018 at the Walker Senior Center.
