A RESOLUTION TO APPROVE AMENDMENT NO. 1 TO THE CONTRACT WITH WHAT MY EYES
HAVE SEEN PHOTOGRAPHY FOR PHOTOGRAPHY SERVICES TO BE PROVIDED THROUGH THE
END OF 2018
WHEREAS, on September 3, 2013, pursuant to Resolution No. 184-13, the City entered into a contract
with What My Eyes Have Seen Photography for photography services for the City's youth sports programs;
and
WHEREAS, the contract is set to expire on September 2, 2018, and both the City and the
photographer desire to extend the contract through the end of 2018.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves the attached
Amendment No. 1 to the contract with What My Eyes Have Seen Photography for photography services to
be provided through the end of 2018, and authorizes Mayor Jordan to sign the amendment.

RECOMMENDATION:
Resolution approving Amendment #1 to the contract with What My Eyes Have Seen
Photography to extend to December 31, 2018
BACKGROUND:
City Council approved Resolution #184-13 on February 3, 2013 for a contract with What My
Eyes Have Seen Photography to take pictures of youth participating in our sport programs
through September 2, 2018.
DISCUSSION:
Parks and Recreation Staff request to extend the current contract with What My Eyes Have
Seen Photography to December 31, 2018 to cover taking team and individual pictures for this
fall youth soccer season. A new RFP will be distributed this year to request vendors to submit
photography proposals for our youth sport participants for 2019.
BUDGET/STAFF IMPACT:
The current contract requires for the Parks and Recreation Department to receive ten percent of
the gross sales from the sales of youth team pictures. Revenues depend on the number of
participants that purchase photos.

ARKANSAS Vendor: What My Eyes Have Seen Photography.
WHEREAS, on September 03, 2013, the City of Fayetteville, Arkansas ("City") and What My Eyes Have
Seen Photography ("Photographer'), pursuant to Resolution No. 184-13, entered into a contract for
photography services (the "Contract") and;
WHEREAS, the Contract is set to expire on or about September 02, 2018, and the parties desire to
extend the Contract until December 31, 2018.
NOW, THEREFORE, BE IT KNOWN TO ALL:
A. That the Contract with an effective date of September 03, 2013, is hereby extended and shall now
expire on December 31, 2018.
B. That the Payment terms set forth in Section 3 of the Contract as well as all other terms and
conditions of the Contract shall remain in effect through the extension period.
C. This amendment does not alter, amend or abridge any of the rights, obligations, or duties of the
parties not expressly addressed herein.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby awards RFP
#13-12 and authorizes a contract with What My Eyes Have Seen Photography for the provision
of Parks and Recreation Department youth soccer and softball team and individual photographs.

Financial Proposals
Proposal l: We propose to pay the City of Fayetteville 5% of our gross sales and provide each
player and their coach with a free team picture. With the economic struggles families are facing,
we began providing a free team picture to every player, regardless of their ability to order
individual pictures. This program has been well received by coaches, parents and players. Not
only does it add value to the league program as a whole, but it encourages all players to show up
for picture day. We feel it is an effective way for our company to serve the families in our
community and generate revenue for the City of Fayetteville. This proposal offers a responsible
alternative to excluding families from participating in picture day, who can not afford the service.
Proposal 2: We propose to pay the City of Fayetteville 10% of our gross sales. We will provide
two free team pictures per team for the head and assistant coaches.
Both proposals are revenue generating plans for the City of Fayetteville. Neither will require a
cost from the City of Fayetteville. We are available to shoot both fall and spring which will
provide the opportunity for increased revenue for the City of Fayetteville, without incurring cost.
As the owners of What My Eyes Have Seen Photography, Brian or Jenny Stark have full
authority to conduct all negotiations regarding the business contract details between What My
Eyes Have Seen Photography and the City of Fayetteville.
