DESIGN OVERLAY DISTRICT (PARKSDALE AND CENTER ADDITIONS):
AN ORDINANCE TO ENACT THE PARKSDALE AND CENTER ADDITION OVERLAY
DISTRICT TO PRESERVE THOSE NEIGHBORHOODS' LIVABILITY, HISTORICAL CHARACTER
AND QUALITY OF LIFE AND TO PROTECT THE HEALTH, SAFETY AND WELFARE OF THE
CITIZENS
WHEREAS, the residents of Parksdale and Center Addition neighborhoods seek the help of the City
of Fayetteville to preserve the livability, historical character and quality of life of their neighborhoods
and to protect the health, safety and welfare of the citizens by enacting the Parksdale and Center Addition
Overlay District.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas enacts § 166.27 Parksdale and
Center Addition Overlay District as follows:
"§ 166.27 Parksdale and Center Addition Overlay District
(A) Purpose. The purpose of this ordinance is to support the neighbors' desire to preserve the
livability, historical character and quality of life of their neighborhoods, to protect the
citizens' health, safety and welfare and to encourage new buildings that are compatible
with the existing development pattern of the neighborhood in scale, height and
building placement.
(B) Applicability. The Parksdale and Center Addition Overlay District applies to parcels of land
located within the boundaries of the Parksdale and Center Addition Overlay District.

(C) General Requirements.
1. The maximum height of all buildings shall not exceed their zoning district's
limitations or two (2) stories, whichever is less.
2. Within the NC and RI -12 districts, the front building line for new primary
structures and additions shall match the existing front building lines or setbacks of
the closest adjoining primary structures, or when adjoining structures have different
front building lines, shall match the average of the front building lines on the closest
adjoining structures. This baseline number may be automatically varied by 10%. For
example, a 20 -foot front building line may be varied by 2 feet in either direction
creating an 18-22 foot build to zone.

SUBJECT: PARKSDALE DESIGN OVERLAY DISTRICT (PARKSDALE AND CENTER
ADDITIONS, 600): Submitted by CITY STAFF and PLANNING COMMISSION on
behalf of NUMEROUS PROPERTY OWNERS in the PARKSDALE AND CENTER
ADDITION NEIGHBORHOOD, SOUTH OF 15TH STREET BETWEEN BROOKS
AVENUE AND DUNCAN AVENUE. The request is modify Unified Development
Code Chapter 166 to create A DESIGN OVERLAY DISTRICT for the Parksdale
Neighborhood.
RECOMMENDATION:
The Planning Commission and staff recommend approval of the requested Design Overlay
District as described in Exhibit `A'.
Background: This code change goes in tandem with the neighborhood -wide rezoning of the
Parksdale Neighborhood (RZN 18-6254). The purpose of the code changes is to create a design
overlay district for the Parksdale Neighborhood to ensure that development of new buildings are
compatible in height and building placement with the existing development pattern of the
neighborhood. The design overlay district requires the following within the portions of the
neighborhood proposed to be rezoned to NC and RI -12:
■ Limit the maximum height of buildings to two stories.
• The front building line for new primary structures and additions shall match the existing
front building lines of the closest adjoining primary structures.
• New parking areas may not be constructed in the front yard between the building and the
street.

(A) Purpose. The intent of this ordinance is to encourage new buildings that are compatible
with the existing development pattern of the neighborhood in scale, height and building
placement.
(B) Applicability. The Parksdale and Center Addition Overlay District District applies to parcels
of land located within the boundaries of the Parksdale and Center Addition Overlay District
(C) General Requirements.
1. The maximum height of all buildings shall not exceed their zoning district's

The proposed Overlay District is an excellent proposal, it was developed by the City of
Fayetteville (the City) Planning Division. This Overlay District provides the City a tool to focus
development and infill so that it meets the current housing needs of the City.
HISTORY:
Prior to this Overlay District, development and infill was approved if it was "appropriate" (as
defined in the City 2030 Plan). Appropriate for the City meant the development conformed to
existing zoning (or rezoned through conditional use or other method) and the submitted design
conformed to the building design codes accepted by the City. Appropriate did not mean it
conformed to the housing needs of the City.
However, times have changed. And after the many years of following the 2030 Plan guidance,
the City has become overbuilt in one class of housing and under built in others.
To correct this imbalance, we can no -longer accept a development just because it conforms to
building code, but we must also consider if the housing is consistent with the needs of the City.
DEMOGRAPHICS:
The following graphic presents the population demographic information from the City of
Fayetteville 2030 Plan. As with any city plan, the population demographic information is the
basis for the goals and objectives presented in the 2030 Plan and specifically for housing
objectives of the 2030 Plan.

The blue bars, in the above graphic, represent the population of Fayetteville as depicted in the
City of Fayetteville 2030 Plan.
The green bars represent the same underlying population data corrected for the error in the
presentation published in the 2030 Plan.
The yellow bars represent the same underlying population data with the population
contributions of the University of Arkansas removed.
CURRENT HOUSING CAPACITY:
Currently there is a serious over -built situation in housing for the population that is represented
by the difference between the green and yellow bars. This, very important, demographic group
is characterized as University students, single, and not expected to be long-term residents of
Fayetteville. Currently Fayetteville is over -built in housing directed at this demographic group.
Simply ask the managers of the housing directed at this population and we hear that they are
projecting 70% to 80% Occupancy at the start of the fall semester. That statistic indicates
that, for this group, there is currently housing for 1,000 more people than there are currently in
this group.
In addition, the University of Arkansas has published their projections of enrollment for the next
few years. The UoA projects they will continue to maintain their freshman enrollment at
approximately 5,000 instead of the rapid growth we saw a few years ago. We can not look to
the University to fill the existing occupancy shortfalls and their projections do not support new
development, targeting this demographic group.
Logically, building new housing for this demographic group raises the probability that there will
be some developments that do not survive, which would be very bad for the City.
THE BOTTOM LINE:
the City needs to concentrate development for the demographic represented by the
yellow bar. That would be characterized by families and long term residents.
This proposed Overlay District finally gives the City Planning Division a tool to concentrate on
development of housing for the demographic represented by the yellow bars; housing that
families would feel comfortable moving into.
