NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines that the facts shown above establish that an exceptional situation exists in which competitive bidding is not feasible or practical and therefore waives the requirements of formal competitive bidding and approves and authorizes a contact to purchase of eighteen (18) SCAR 16 CQC rifles from TK Tactical Firearms to replace the Fayetteville Police Department Emergency Response Team's rifles in the amount of $43,403.44 plus applicable taxes. BACKGROUND: The rifles used by the Fayetteville Police Department's Emergency Response Team were purchased in September of 2010 and have had reached their safe and practical "end of life". This project is a scheduled replacement. DISCUSSION: TK Tactical Firearms is the only distributer authorized by FN America to facilitate the sale of the SCAR 16CQC to the Fayetteville Police Department. TK Tactical will also allow us to trade in our current inventory of used rifles, offsetting some of the cost.
