OXFORD BEND WATERLINE COST SHARE:
AN ORDINANCE TO WAIVE THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING AND
APPROVE A COST SHARE AGREEMENT WITH BOB WEAVER FOR THE INSTALLATION OF
WATER MAIN ALONG A 370 FOOT PORTION OF OXFORD BEND ROAD, WITH THE ESTIMATED
AMOUNT TO BE PAID BY THE CITY OF FAYETTEVILLE NOT TO EXCEED $6,535.00, AND TO
APPROVE A PROJECT CONTINGENCY IN THE AMOUNT OF $1,307.00
WHEREAS, Bob Weaver will be building a single-family home on property located on Oxford Bend
Road and has requested that the City share in the cost of constructing an 8 -inch water main, rather than the
required 4 -inch water main, along Oxford Bend Road a distance of approximately 370 feet; and
WHEREAS, the City of Fayetteville would benefit from the cost share as it will allow the new single-
family structure to connect, will extend water service to an area that has never been served before, and will
also provide for ample future capacity for consumption and fire flow; and
WHEREAS, § 51.112 of the Fayetteville City Code provides that "the City shall pay the excess material
cost of facilities of a size that is larger than required to serve subdivisions when such excess size is
specified and required by the water and wastewater director for the general benefit of the water
system"; and
WHEREAS, waiving formal competitive bidding will save time and cost by utilizing the developer's
contractor who will be on-site installing the line for the developer's project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional
situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the
requirements of formal competitive bidding and approves a cost share agreement with Bob Weaver for the

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an exceptional
situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the
requirements of formal competitive bidding and approves a cost share agreement with Bob Weaver for the

RECOMMENDATION:
Staff recommends the approval of a cost sharing agreement with Bob Weaver in the amount of
$6,535.00 for a waterline upgrade on Oxford Bend, and approval of a contingency in the amount
of $1,307.00 for a total amount of $7,842.00.
BACKGROUND:
Mr. Weaver is requesting water service for a single-family home being constructed. Per policy,
he is responsible for installing main extension. Based on his projected usage, Mr. Weaver only
needs a 4 -inch water main.
DISCUSSION:
The City is anticipating growth in that area in the future. Therefore, the City will require Mr.
Weaver to install an 8 -inch line instead of a 4 -inch line. The City will pay the difference between
the 4 -inch and 8 -inch lines.
BUDGET/STAFF IMPACT:
Funds are available in the Water/Sewer Impact Fee Cost Sharing project.

COST SHARE OF WATER MAIN INSTALLATION COSTS

This Agreement, made and entered into on this 5th day of df� 2018, by and between
the City of Fayetteville, Arkansas ("City") and Bob Weaver, witnesseth:
WHEREAS, Bob Weaver has requested that the City share in the cost of upsizing a 4 -inch
main to an 8 -inch water main along a portion of Oxford Bend Road between West River Rock
Circle and West Wilson Lane, a distance of approximately 370 feet, so that Bob Weaver may
construct a single-family dwelling; and
WHEREAS, constructing this segment of 8 -inch water main, rather than the 4 -inch main,
will allow construction of a single-family residence, will extend water service to an area that has
never been served before, and will also provide for ample future capacity for consumption and fire
flow, which the City recognizes will be necessary for a future area that will be served by this water
main; and
WHEREAS, § 51.112 of the Fayetteville City Code provides that "the City shall pay the
excess material cost of facilities of a size larger than required to service subdivisions when such
excess size is specified and required by the water and wastewater director for the general benefit
of the water system."
NOW, THEREFORE, the City of Fayetteville, Arkansas and Bob Weaver agree as
follows;
1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse Bob Weaver for the excess cost to upsize approximately 370 linear
feet of water main from 4 -inch to 8 -inch in the area identified in Exhibit "A"
up to a maximum not -to -exceed amount of $6535.00, as was estimated by the
builder's representative and shown on Exhibit `B", attached, along with any
contingency that may be approved by the City Council.
B. Payments due to Bob Weaver shall be remitted within sixty (60) days after
receipt of valid invoices.
2. Bob Weaver agrees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary for a complete and acceptable water main installation, including
submittal of plans and specifications to the City's Engineering Department, per
their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.

SUBJECT: Approval of the Use of Contingency Funds for a Waterline Cost Share on
Oxford Bend
RECOMMENDATION:
Staff recommends the approval of the use of contingency funds in the amount of $900.00 for a
cost sharing agreement with Bob Weaver for a waterline upgrade on Oxford Bend.
BACKGROUND:
Mr. Weaver requested water service for a single-family home being constructed. Per policy, he
was responsible for installing the main extension. Based on his projected usage, Mr. Weaver
only needed a 4 -inch water main. The City is anticipating growth in that area in the future.
Therefore, the City required Mr. Weaver to install an 8 -inch line instead of a 4 -inch line. Per
Ordinance 6068, the City agreed to pay the difference between the 4 -inch and 8 -inch lines.
DISCUSSION:
Mr. Weaver has completed construction on the project and is requesting reimbursement. During
construction, it was determined that an anchor collar was needed for the waterline. The City
offered to pay half the cost of the anchor collar in the amount of $900.00. The total payment to
Bob Weaver will be $6,5350.00 plus $900.00 of the contingency for a total of $7,435.00.
BUDGETISTAFF IMPACT:
Funds are available in the Water/Sewer Impact Fee Cost Sharing project.

situation exists in which competitive bidding is deemed not feasible or practical and therefore waives the
requirements of formal competitive bidding and approves a cost share agreement with Bob Weaver for the
installation of an 8 -inch water main along a 370 foot portion of Oxford Bend Road with the estimated amount
to be paid by the City of Fayetteville not to exceed $6,535.00, and further approves a project contingency in

CONTRACTUAL AGREEMENT FOR
COST SHARE OF WATER MAIN INSTALLATION COSTS
This Agreement, made and entered into on this' 5th day of Julie
MV]f 2018, by and between
the City of Payetteville, Arkansas ("City") and Bob Weaver, witnesseth:
WHEREAS, Bob Weaver has requested that the City share in the cost ofupsizing a 4 -inch
main to an 8 -inch water main along a portion of Oxford Bend Road between West River Rock
Circle and West Wilson Lane, a distance of approximately 370 feet, so that Bob Weaver may
construct a single-family dwelling; and
WHEREAS, constructing this segment of 8 -inch water main, rather than the 4 -inch main,
will allow construction of a single-family residence, will extend water service to an area that has
never been served before, and will also provide for ample future capacity for consumption and tire
flow, which the City recognizes will be necessary for a future area that will be served by this water
main; and
WHEREAS, § 51,112 of the Payetteville City Code provides that "the City shall pay the
excess material cost of facilities of a size larger than required to service subdivisions when such
excess size is specified and required by the water and wastewater director for the general benefit
of the water system."
NOW, THEREFORE, the City of Fayetteville, Arkansas and Bob Weaver agree as
follows: ,
1. The City of Fayetteville, Arkansas agrees to, .
A. Reimburse Bob Weaver for the excess cost to upsize approximately 370 linear
feet of water main from 4 -inch to 8 -inch in the area identified in Exhibit "A"
up to a maximum not -to -exceed amount of $6535.00, as was estimated by the
builder's representative and shown on Exhibit "B", attached, along with any
contingency that may be approved by the City Council,
B. Payments due to Bob Weaver shall be remitted within sixty (60) days after
receipt of valid invoices:
2. Bob Weaver agrees to:
A. Provide the necessary and normal project maniigement, inspection, and testing
as necessary for a complete and acceptable water main installation, including
submittal of plans and specifications to the City's Engineering Department, per
their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.
