AN ORDINANCE TO APPROVE VAC 18-6097 FOR PROPERTY LOCATED WEST OF BEECHWOOD
AVENUE AND 15TH STREET TO VACATE A PORTION OF A UTILITY EASEMENT
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or
portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described utility easement is not
required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby vacates a portion of a utility
easement as described in Exhibit B attached to the Planning Department's memo.
Section 2. A copy of this Ordinance duly certified by the City Clerk along with the map attached as
Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County
Circuit Clerk.
Section 3. This vacation approval is subject to the following conditions:
1. Any relocation of or damage to existing utilities or existing facilities shall be at the
owner/developer's expense.

RECOMMENDATION:
Staff and the Planning Commission recommend approval of VAC 18-6097 with the following
condition of approval:
1. Any relocation of or damage to existing utilities or existing facilities shall be at the
owner/developer's expense.
BACKGROUND:
The subject property is west of the intersection of 15th Street and Beechwood Avenue, is zoned
RMF -24, and contains 7.08 acres. The site is currently vacant with some dedicated utility
easements.
Proposal: The applicant proposes to vacate a portion of a utility easement, as shown in the
attached Exhibits 'A' and 'B', in order to prepare the site for development.
DISCUSSION:
On February 26, 2018, the Planning Commission forwarded this item to the City Council with a
recommendation for approval with a vote of 8-0-0.

We, the undersigned, being all the owners of the real estate abutting the (easement and right-of-way)
hereinafter sought to be abandoned and vacated, lying in the a part of the NE1/4 of the SW1/4 of Section 20, T-
16 -N, R -30-W, City of Fayetteville, Arkansas, a municipal corporation, petition to vacate a(n) (alley, easement,
right-of-way) which is described as follows:

A part of the NEI/4 of the SW1/4 of Section 20, T -16-N, R -30-W of Washington County, Arkansas, and being
described as follows: Commencing at the NW Corner of said NEI/4, SWI/4, thence S87°10'48"E 671.28 feet,

That the abutting real estate affected by said abandonment of the alley are (lot, block, subdivision of each
adjoining lot to the area requested to be vacated) City of Fayetteville used by the public for a period of many
years, and that the public interest and welfare would not be adversely affected by the abandonment of the
portion of the above described (alley, easement, right-of-way).
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the above described real estate,
subject, however, to the existing utility easements and sewer easements as required, and that the above
described real estate be used for their respective benefit and purpose as now approved by law.
The petitioners further pray that the above described real estate be vested in the abutting property owners as
provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the City of Fayetteville,
Arkansas, abandon and vacate the above described real estate, subject to said utility and sewer easements, and
that title to said real estate sought to be abandoned be vested in the abutting property owners as provided by
law, and as to that particular land the owners be free from the easements of the public for the use of said alley.
