DUNCAN AVE./SWIFTY PROPERTIES): A RESOLUTION PURSUANT TO § 166.04(B)(2) OF THE FAYETTEVILLE UNIFIED DEVELOPMENT CODE TO APPROVE THE DEDICATION OF A REDUCED AMOUNT OF RIGHT OF WAY ALONG WEST FIFTEENTH STREET BY APPROXIMATELY 276 SQUARE FEET TO ACCOUNT FOR A PORTION OF AN EXISTING HOME AT 1436 SOUTH DUNCAN AVENUE AND TO REDUCE THE MASTER STREET PLAN RIGHT OF WAY DEDICATION FOR THIS PORTION OF WEST FIFTEENTH STREET BY 276 SQUARE FEET WHEREAS, the Planning Commission voted 9-0 to recommend to the City Council that a lesser dedication be allowed to the owner of property at 1436 South Duncan Avenue because a 276 -square foot portion of the existing home extends into the required master street plan right of way; and WHEREAS, City staff is in favor of the variance because the applicant intends to keep the 1930s - e r a house and because future improvements to West Fifteenth Street can be constructed around the existing house; and WHEREAS, the City Council has determined to accept the dedication of 276 square feet less of right of way for West Fifteenth Street and to reduce the Master Street Plan right of way dedication requirements for this section of West Fifteenth Street by 276 square feet. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby accepts the offered dedication of right of way along West Fifteenth Street, which has been reduced by 276 square feet to account for a portion of a house located at 1436 South Duncan Avenue, as shown in the Tract Split Survey attached as Exhibit A to this Resolution, and reduces the Master Street Plan dedication by 276 square feet for this section of West Fifteenth Street. The property is zoned RMF -24, RESIDENTIAL MULTI FAMILY, 24 UNITS PER ACRE and contains approximately 0.25 acres. The request is for a lesser dedication of Master Street Plan right-of-way. RECOMMENDATION: Planning Commission and staff recommend approval of a request to accept a lesser right-of-way dedication as depicted in Exhibits 'A' with the following conditions: 1. The requested lesser right-of-way dedication is limited to the area occupied by the house and within the Master Street Plan right-of-way, as denoted by the applicant in Exhibit 'A'. 2. ADM 18-6167 and LSP 18-6134 must meet all relevant and applicable development codes apart from what is requested in this variance. BACKGROUND: The subject property is located at the northeast corner of Duncan Avenue and 15th Street. The property is zoned RMF -24, Residential Multi -family, 24 Units per Acre and is developed with a single family home built in the 1930's. The applicant has submitted a lot split to create two new parcels from the subject property (LSP 18-6134). Request: The applicant has proposed to split the parcel, which requires right-of-way dedication where current right-of-way widths are insufficient to meet the Master Street Plan pursuant to UDC 166.04(B)(2)(a). The existing house on the property is within the area required to be dedicated as right-of-way with the lot split. The applicant is asking for the area occupied by the house and within the Master Street Plan Principle Arterial right-of-way to not be dedicated. Public Comment: No public comment was received for this item. Staff Findings: Due to the house existing on this property since the 1930's and the applicant's intention to keep the house, staff is in support of the request to vary right-of-way dedication. Thus, the property owner is gladly dedicating 25% of currently owned property to the City to meet said Right -of -Way future Master Street Plan. r Per the Lot Split requirements, no future drives will be allowed onto 15' street, and a single shared access entry off Duncan Avenue is a requirement, thus increasing safety. • Current Zoning of the property is RMF -24.
