MONDAY THROUGH SATURDAY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby amends section § 111.30(D) Private Club Permit by repealing subsection (D)(3) Hours of operation and enacting a replacement subsection (D)(3) as follows: "(3) Hours of Operation. It shall be unlawful for the owner, operator, or any employee of a private club to serve or permit the consumption of any controlled beverages on the premises of said private club between the hours of 2:00 a.m. and 7:00 a.m. on any day." Section 2: That the City Council of the City of Fayetteville, Arkansas hereby amends §111.30(E) On Premises Consumption - Hotel, Motel or Restaurant Permit by repealing subsection (E)(3) Hours of operation and enacting a replacement subsection (E)(3) as follows: "(3) Hours of Operation. It shall be unlawful for any person holding an on -premises consumption hotel, motel or restaurant permit to sell, offer for sale, serve, give away, or permit consumption of any controlled beverages between the hours of 2:00 a.m. and 7:00 a.m. on Monday through Saturday, on Sunday except between the hours of 10:00 a.m. until midnight, on Christmas Day, or during any 24-hour interval designated an emergency period by the mayor, City Council, or any person acting in the Mayor's or the City Council's capacity." We ask this be allowed as we open every day for breakfast at 7AM. The majority of our customers at this time are nurses, doctors, others who work in the medical field and people who work the third shift in general. We would like to serve these third shift customers as we do all our customers and offer everything we have available as any other person throughout the day. As it may be unusual for the regular person to have a Mimosa, beer, Bloody Mary, etc. at 7AM, for these hardworking citizens of Fayetteville it is just the end of a long work day and if they would like to consume an alcoholic drink at 7AM, we would like to be able to cater to their needs.
