S. COLLEGE AVE. The property is zoned NC, NEIGHBORHOOD
CONSERVATION and contains approximately 0.23 acres. The request is to
rezone the property to RSF-18, RESIDENTIAL SINGLE FAMILY, 18 UNITS PER
ACRE.
RECOMMENDATION:
Staff and Planning Commission recommend approval of an ordinance to rezone property as
depicted in Exhibits 'A' and `B'.
BACKGROUND:
The subject property of approximately 0.23 acres is located south and southeast of the
intersection of South Street and College Avenue. The parcel is zoned NC, Neighborhood
Conservation, considered the original Lot 3, Block 1 of Combs Addition, and currently developed
with a single-family home. In July of 2008 the subject property, along with approximately 300
acres of the wider Walker Park Neighborhood, were rezoned in accordance with the Walker Park
Neighborhood Master Plan (WPNMP).
Request: The request is to rezone the subject property from NC to RSF-18 in order to split the
parcel and place single-family homes on each lot.
Public Comment: Staff has received public comment opposed to development other than single-
family homes.
Land Use Plan Analysis: Staff believes that the proposal is compatible with the goals in City Plan
2030, adopted land use policies, and the Walker Park Neighborhood Master Plan. This property
is intended per the Illustrative Plan to have single-family residential development. Furthermore,
RSF-18 has been adopted in similar locations around Walker Park to allow for denser single-
family development while keeping intended uses aligned with the plan.

Land Use Compatibility: The proposed zoning is compatible with the surrounding properties at
this location. RSF-18 is a higher density than surrounding properties to the east, west, and south,
but staff finds little to no compatibility issues with NC given that both districts are single-family.
Rezoning the property to RSF-18 will not have a substantial impact on traffic or substantially
increase the density or load on public services.
DISCUSSION:
On February 26, 2018, the Planning Commission forwarded the proposal to City Council with a
recommendation for approval of the applicant's request by a vote of 8-0-0. Public comment is
included with the Planning Commission report.

RECOMMENDATION:
Staff recommends forwarding RZN 18-6092 to City Council with a recommendation for approval
based upon the findings herein.
BACKGROUND:
The subject property of approximately 0.23 acres is located south and southeast of the
intersection of South Street and College Avenue. The parcel is zoned NC, Neighborhood
Conservation, considered the original Lot 3, Block 1 of Combs Addition, and currently developed
with a single-family home. In July of 2008 the subject property, along with approximately 300
acres of the wider Walker Park Neighborhood, were rezoned in accordance with the Walker Park
Neighborhood Master Plan (WPNMP). The surrounding land use and zoning is in Table 1.

INFRASTRUCTURE:
Streets: The subject parcel has access to South College Avenue. South College Avenue is
an improved two-lane asphalt street with sidewalk, curb and gutter, no storm
drains. Any street improvements required in these areas would be determined at
the time of development proposal.
Water: Public water is available to the site. There is an existing 8 -inch main along South
College Avenue.
Sewer: Sanitary Sewer is available to the site. There is an existing 8 -inch main along South
College Avenue.
Drainage: No portion of this property is identified as FEMA regulated floodplains. No part of
the parcel lies within the HHOD. There are no protected streams on this parcel.
There are no hydric soils identified on this parcel. Any additional improvements or
requirements for drainage will be determined at time of development.
Fire: The Fire Department expressed no concerns with this request.
Police: The Police Department expressed no concerns with this request.
CITY PLAN 2030 FUTURE LAND USE PLAN: City Plan 2030 Future Land Use Map designates
the properties as part of a Complete Neighborhood Plan Area associated with the Walker Park
Neighborhood Plan.
FINDINGS OF THE STAFF:
A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: Land Use Compatibility: The proposed zoning is compatible with the
surrounding properties at this location. RSF-18 is a higher density than
surrounding properties to the east, west, and south, but staff finds little to
no compatibility issues with NC given that both districts are single-family.
Land Use Plan Analysis: Staff believes that the proposal is compatible with

Finding: Staff does believe the applicant has given sufficient justification for rezoning
the property. The proposed zoning is necessary to achieve the flexibility and
variety of lot sizes and building types not afforded by the existing zoning.

A. Current Ownership information and any proposed or pending property sales.
a. Property is owned by Kris and William Meyer. There is no proposed or pending
property sales.
B. Reason (need) for requesting zoning change
a. To accommodate two nicely finished single family homes.
C. State of how the proposed rezoning will relate to surrounding properties in terms of
land use, traffic, appearance and signage.
a. The existing home which is in dilapidated condition will be removed thus
making way for two quality built and designed homes to bring value and curb
appeal to the area. Traffic should be minimally affected as they are just single
family homes with one shared driveway. Appearance will be that of matching
and surrounding homes. Design and functionality to bring positive value and
aesthetics to the area. There will be minimal signage, only during construction
and rezoning notice.
D. Availability of water and sewer (State size of lines).
a. Minimal impact again on existing infrastructure and utitilies. The water line is a
6" and Sewer is 8".
E. The degree to which the proposed zoning is consistent with land use planning
objectives, principles, and policies and with land use zoning plans.
a. In line with Fayetteville city's current zoning and need for domestic infill as the
neighboring property to the north is being more densely developed than we are
proposing. Two quality built homes on a lot that is just 5' under being able to
split (required 40') in the current zoning of "NC". The Rsf-18 has a 30' lot
frontage which would allow for a centered driveway and two homes built
within the current restrictions of Rsf-18.
F. Whether the Proposed zoning is justified and/or needed at the time of the request.
a. Justification would be domestic infill and neighboring properties that bring
value to the area, which is what they Meyers are looking to currently do.
Market trends as of late would be a motivating factor to take advantage. The
current neighbor and neighbors are creating great infill opportunities with
beautiful homes of quality and taste. The Meyers are just looking for the
opportunity to do the same.
G. Whether the proposed zoning will create or appreciably increase traffic danger and
congestion.
a. Minimal at worst. Two single family homes using the same driveway to access
rear entry parking.
H. Whether the proposed zoning will alter the population density and thereby undesirably
increase the load on public services including schools, water, and sewer facilities.
a. The Population increase would be one 3 bed single family home. As not
proposing a mass scale rental structure just another home, I do not foresee any
unnecessary stress to public schools. With the ample water line size, and sewer
Line size and once again only bringing two single family homes where one
previously existed, I believe not to be a burden on existing public services.
I. Why it would be impractical to use the land for any of the uses permitted under its
existing zoning classification.
a. The goal of this project is domestic infill to a lot that barely under its current
zoning requirements misses the aim of this project. Frontage is 75' and
requirement of NC is 40' per lot if said lot is split thus creating the dilemma in
trying to bring another home to the property. Two 32.5 lots meeting the criteria
and surpassing for frontage of RSF 18 would allow the Meyers to bring two
quality and well built single family structures to keep Fayetteville's infill and
beauty in line
