This appeal is made pursuant to Section 155.05 of the Uniform Development Code. We understand that Planning Commission has to make a lot of tough decisions and we certainly appreciate their hard work and time. However, in this instance, we feel that the applicant has presented a reasonable zoning request that is in conformity with the surrounding properties. The property is zoned R -A, RESIDENTIAL AGRICULTURAL and contains approximately 29.00 acres. The request is to rezone the properties to RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE. RECOMMENDATION: Staff and the Planning Commission recommend denial of the request to rezone as shown in Exhibits 'A' and 'B'. The applicant has appealed the Planning Commission's decision to the City Council. BACKGROUND: The subject property is an undeveloped 29 -acre parcel located east of Greens Chapel Road and north of Drewrys Bluff Road in west Fayetteville. The property is zoned R -A, Residential Agricultural. The property is bordered on the south and west by phases I and IV of the Legacy Pointe subdivision, and on the north and east by large lots in the older residential -agricultural pattern Request: The request is to rezone the property from R -A, Residential Agricultural to RSF-4, Residential Single-family/4 Units per Acre. The applicant indicates that the intent is to facilitate development of the site. Land Use Compatibility: The proposed zoning is compatible with surrounding land use patterns to the west and south, which consists of single-family neighborhoods in t RSF-4 and have street stub -outs to the subject property. The proposed zoning is somewhat incompatible with surrounding land use to the north and east which is very low density and rural residential in nature. Land Use Plan Analysis: The proposed zoning is incompatible with the Rural -Residential designation on the Future Land Use Map (FLUM) which calls for preservation of agricultural uses, and if developed, that the appropriate pattern is low density residential development on large lots, with an emphasis on conservation and agriculture that transitions well to surrounding rural areas. The property is zoned R -A, RESIDENTIAL AGRICULTURAL and contains approximately 29.00 acres. The request is to rezone the properties to RSF-4, RESIDENTIAL SINGLE FAMILY, 4 UNITS PER ACRE. RECOMMENDATION: Staff recommends denial of RZN 17-6046 based on the findings herein. BACKGROUND: The subject property is an undeveloped 29 -acre parcel located east of Greens Chapel Road and north of Drewrys Bluff Road in west Fayetteville. The property is zoned R -A, Residential Agricultural. The property is bordered on the south and west by phases I and IV of the Legacy Pointe subdivision, and on the north and east by large lots in the older residential -agricultural pattern. The surrounding land use and zoning is depicted on Table 1. Greens Chapel Road, Sabine Pass Road, and Drewrys Bluff Road are improved two lane asphalt streets with sidewalk, curb and gutter, and storm drains. Any street improvements required in these areas would be determined at the time of development proposal. Water: Public water is available to the site. There is an 8 -inch water main along the subject parcel frontage on Greens Chapel Road, Sabine Pass Road, and Drewrys Bluff Road. Sewer: Sanitary Sewer is available to the site. There is an existing 8 -inch main along the subject parcel frontage on Greens Chapel Road, Sabine Pass Road, and Drewrys Bluff Road. Drainage: A portion of this property is identified as FEMA regulated floodplains. No part of the parcel lies within the HHOD and there are a few areas on the subject parcel that have 15% slope areas identified onsite. There are no protected streams on this parcel. There are hydric soils identified on this parcel. Any additional improvements or requirements for drainage will be determined at time of development. Fire: The Fire Department has no comments regarding the rezoning request. Fire apparatus access, water supply and fire protection will be reviewed for compliance with the Arkansas Fire Prevention Code at the time of development. Police: The Police Department did not comment on this request. CITY PLAN 2030 FUTURE LAND USE PLAN: City Plan 2030 Future Land Use Map designates this property as a Rural Residential Area. These areas recognize low density, large lot residential development, but are identified to encourage the conservation and preservation of woodlands, grasslands, or agricultural lands that are sparsely settled. They may not have adequate street and water infrastructure or public services, such as police and fire, to support urban or suburban densities and development patterns, nor should these services be expanded to accommodate further growth unless they are in line with the following principles: a. Allow and encourage historical agricultural and related uses to continue and to occur as permanent land uses within planned developments. b. If developed, encourage alternative development patterns, such as conservation or cluster development types, to achieve compatibility with surrounding rural areas. c. Foster a culture that supports local food production on a variety of scales. d. Encourage, preserve and protect viable agribusinesses such as orchards, berry farms and small scale produce -yielding businesses that provide goods for the local market. FINDINGS OF THE STAFF 1. A determination of the degree to which the proposed zoning is consistent with land use planning objectives, principles, and policies and with land use and zoning plans. Finding: The proposed zone would increase potential traffic, but not necessarily the danger or congestion in the area over the current R -A zoning. The RSF-4 zoning district allows development at eight times the density of the R -A zone. Traffic congestion may become an issue at Double Springs road as properties continue to develop along this Master Street Plan designated `Minor Arterial' street. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: The proposed zoning is likely to result in a substantial increase in density over that allowed by the existing R -A zone, however no undesirable load on public services is anticipated. The Police and Fire Departments have not expressed concerns about the proposed zoning district. 5. If there are reasons why the proposed zoning should not be approved in view of considerations under b (1) through (4) above, a determination as to whether the proposed zoning is justified and/or necessitated by peculiar circumstances such as: a. It would be impractical to use the land for any of the uses permitted under its existing zoning classifications; b. There are extenuating circumstances which justify the rezoning even though there are reasons under b (1) through (4) above why the proposed zoning is not desirable. The property is located approximately 2.8 miles from the fire station with an anticipated response time of approximately 6 minutes. The Fayetteville Fire Department has a 6 -minute response time goal for all development. Since the anticipated response time is within the Fire Department's response time goal, the Fire Department does not feel this development will negatively impact response time averages for this area.
