attached to the Planning Department's Agenda Memo from NC, Neighborhood Conservation to RI -U,
Residential Intermediate, Urban.
Section 2. That the City Council of the City of Fayetteville, Arkansas hereby amends the official zoning
map of the City of Fayetteville to reflect the zoning change provided in Section 1.

The properties are zoned NO, NEIGHBORHOOD CONSERVATION and contain
approximately 0.47 acres. The request is to rezone the properties to RI -U,
RESIDENTIAL INTERMEDIATE, URBAN.
RECOMMENDATION:
Planning Commission recommend approval of an ordinance to rezone the subject property to NS-
G, Neighborhood Services -General, as shown in the attached Exhibits 'A' and 'B'.
BACKGROUND:
The subject property contains three parcel located at 203, 205, and 207 S. West Avenue and
contains approximately 0.47 acres. The property is zoned NO, Neighborhood Conservation and
contains two existing homes, constructed in 1905 and 1911. The property is located within the
Downtown Design Overlay District.
Request: The request is to rezone the property from NO, Neighborhood Conservation to RI -U,
Residential Intermediate—Urban. The applicant indicates that the intent is facilitate re-
development of the site.
Land Use Compatibility: The proposed zoning would allow single-, two-, three-, and four -family
dwellings which would be compatible with surrounding land use patterns in this area, which
consists of single-family and some small multi -family residential properties to the north, the public
library to the east, and City park to the west and south. This property is along the western edge
of the downtown square area and along a well -travelled route between Dickson Street and south
Fayetteville. The proposed zoning provides flexibility with unlimited density that is an appropriate
development pattern in this central downtown location, surrounded by the public library and
square, City park, and a wide variety of housing types and ages.
Land Use Plan Analysis: The proposed zoning is compatible with the Future Land Use Map
(FLUM) and consistent with the Downtown Master Plan, which makes a higher density of
residential development a top priority and encourages a variety of residential typologies in order
to `get more people' downtown. The proposed zoning would allow re -development of the subject

lots with options for single-family, two-family, and up to four -family units within a form -based
zoning district that encourages walkability and provides flexibility for construction of dwellings
variety of sizes and costs.
DISCUSSION:
On January 22, 2018, the Planning Commission forwarded the proposal to City Council with a
recommendation for approval RI -U, Residential Intermediate — Urban by a vote of 7-0-0.

Staff recommends forwarding RZN 18-6076 to the City Council with a recommendation of
approval, based on the findings herein.
BACKGROUND:
The subject property contains three parcel located at 203, 205, and 207 S. West Avenue and
contains approximately 0.47 acres. The property is zoned NC, Neighborhood Conservation and
contains two existing homes, constructed in 1905 and 1911. The property is located within the

Streets: The subject parcel has access to West Avenue, a partially improved, asphalt local
street. Any street improvements required in these areas would be determined at
the time of development proposal.
Water: Public water is available to the site. There is an existing 6 -inch main along the west
side of the street within the right-of-way. This line is available for service
connections
Sewer: Sanitary Sewer is available to the site. There is an 8 -inch sewer main that runs
along the center side of West Avenue. This line is available for service
connections.
Drainage: Any additional improvements or requirements for drainage will be determined at
time of development. No portion of this property is identified as FEMA regulated
floodplain. No protected streams are located onsite, nor is any of this parcel in the
HHOD. Some areas onsite are however identified as having 15% or greater slopes
and may be subject to residential grading permits if applicable.
Fire: The Fire Department did not express concerns with this request.
Police: The Police Department did not comment on this request.
CITY PLAN 2030 FUTURE LAND USE PLAN: City Plan 2030 Future Land Use Plan designates
the properties within the proposed rezone as Downtown Master Plan Area. This plan calls for
a 'superbly walkable environment and a more densely populated downtown, with a mix of income
levels in order to maintain and encourage a vibrant downtown.
FINDINGS OF THE STAFF
A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.

2. A determination of whether the proposed zoning is justified and/or needed at the time the
rezoning is proposed.
Finding: The applicant has requested the RI -U zoning district to allow for reduced lot
widths and a variety of available housing types which would allow for future
residential development.
A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: The proposed zone is not expected to appreciably increase potential traffic
danger or congestion in the area over the current NC zoning.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: The proposed zoning is likely to result in slightly higher density of
population, however no undesirable load on public services is anticipated.
The Police and Fire Departments have not expressed concerns about the
proposed zoning district.
5. If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the
proposed zoning is not desirable.
Finding: N/A
RECOMMENDATION: Staff recommends forwarding RZN 18-6076 to the City Council with a
recommendation of approval, based on the findings discussed throughout this report.

SUBJECT: RZN 18-6076: Rezone (203, 205 & 207 S. West Ave./Rouse, 523)
The Fire Department has no comments regarding the rezoning request. Fire apparatus access,
water supply and fire protection will be reviewed for compliance with the Arkansas Fire Prevention
Code at the time of development.
The site will be protected by Ladder 1, located at 303 W. Center Street. The property is located
approximately 0.2 miles from the fire station with an anticipated response time of approximately
2 minutes. The Fayetteville Fire Department has a 6 -minute response time goal for all
development. Since this site is within the Fire Department's response time goal, the Fire
Department does not feel this development will negatively impact response time averages for this
area.

Dear Planning Commission,
We are asking for a rezoning request from NC to RI -U on the following parcels: 207, 205, 203 S. West
Ave. also known as the following parcels: 765-02032-000, 765-02034-000, 765-02031-000,
Currently there is a mix of single family homes, apartments, live -work units downtown. Each of these
range in size and architectural style that gives the downtown area its eclectic synergy. It encourages
people to immerse themselves in what is the Downtown lifestyle.
The plan for this property will be Sophisticated Modern Designed Townhomes to encourage living and
working in the downtown area. These homes will include sprawling rooftop terraces with built-in green
space that
Our proposed zoning change is completely consistent with the land use planning objectives, principals,
policies, and zoning plans. Our project would bridge the gap between the current single-family housing
and the multi -family housing in the area as there are currently no medium density projects in the area.
The zoning change request is warranted at the current time because the project will not be viable
without this new zoning.
Population density would not increase drastically with proposed project. The spacious rooftop terrace
and nightlife within close proximity will encourage people to walk thus minimizing traffic and
congestion.
By requesting a medium density zoning there should no impact on city services.
Due to the current revitalization of the downtown area making single family housing cost prohibitive
due to the rise in cost per unit thus, eliminating a diverse income levels and coincidently promotes
urban sprawl.
