Mayor Jordan called the meeting to order. PRESENT: Council Members Adella Gray, Sarah Marsh, Mark Kinion, Matthew Petty, Sarah Bunch, John La Tour, Kyle Smith, Mayor Lioneld Jordan, City Attorney Kit Williams, City Clerk Sondra Smith, Staff, Press, and Audience. Absent: Council Member Justin Tennant Pledge of Allegiance Mayor's Announcements, Proclamations and Recognitions: None City Council Meeting Presentations, Reports, and Discussion Items: Nominating Committee Report and Housing Authority Board Resident Appointment - Debra Humphrey Council Member Kinion presented the Nominating Committee report and recommended the appointments as submitted. No one came forward to speak. Council Member Marsh moved to approve the Nominating Committee Report. Council Member Smith seconded the motion. Upon roll call the motion passed 7-0. Council Members Kinion, Petty, Bunch, La Tour, Smith, Gray, and Marsh voting yes. Council Member Tennant was absent. Fayetteville Mobilitv Plan - Final Report Presentation and Draft Implementation Strategy Chris Brown, City Engineer stated two years ago the City entered into a contract with Nelson\Nygaard Consulting to develop a transportation master plan. He spoke about the many community outreach workshops organized to inform the public. He stated city staff has been working on metrics the last couple of days and is looking for feedback. Jeff Tumlin, Nelson/Nygaard presented the Final Report providing a brief overview of the state of transportation and mobility in the city. He spoke about outreach efforts to the public requesting to know the publics' values, what should be invested in, and how resources could be allocated to achieve their goals. He spoke about data for travel patterns, missing links in the pedestrian network, and missing links that could unlock opportunities for children to walk to school. He spoke about roadway connections. He spoke about the city's street grid to create a more sophisticated design. He spoke about performance metrics. He spoke about gap closures for each mode of transportation. He stated they are recommending that the city start to develop a multi-year. maintenance and capital budgeting approach. Chris Brown stated the report is done and all the work is done. He stated they are not done with implementing recommendations and will work on that in the upcoming months. He stated there is still a lot of work to be done as the city looks toward a future bond issue. Council Member Petty: What do you believe is our biggest weakness as a city as we try to implement this? What would stop it from being successful, even if we agreed with every part of it? Jeff Tumlin: If the public disagreed with you, that would stop it. Potentially, the greatest weakness is the ongoing trust building and education with the public. Your implementation strategy is reflective of their values. Mayor Jordan: We want to cover all the ages in this city in the transportation plan. There are a lot of folks that can't walk the trails and would like to have access. We don't want to exclude them from this transportation plan. How high is that on the list? Jeff Tumlin spoke about the plan's equity section on low income children, access for older adults, and people with disabilities. He stated projects could be resorted. A discussion followed about the publics' involvement in providing input. 113 West Mountain Fayetteville, AR 72701 (479) 575-8323 www.fayetteville-ar.gov City Council Meeting Minutes March 20, 2018 Page 3 of 13 Don Marr, Chief of Staff spoke about the items being evenly weighted across the 21 points, but City Council could designate the items differently if they choose too. Jeff Tumlin spoke about the items based on the publics' input of priorities. Mayor Jordan: How many people participated in the input sessions? Jeff Tumlin: We had many thousands of individual comments. At each round of public comment there were between 250 to 500 people that participated. Three rounds in public, plus multiple rounds of online survey and a variety of other means. Council Member La Tour: I am concerned about personal freedom and liberty. If you had an unlimited budget here in Fayetteville, what would you do? How would you change our existing street and sidewalk grid? Jeff Tumlin: That shouldn't be up to me. Transportation investments are an investment strategy to achieve a lot of larger goals. Mobility in and of itself isn't a public good. It helps you to achieve your health and economic development goals. It's up to local values about how to prioritize those. Looking at the data, my recommendation is that there's a lot of opportunity to unlock previous investments by focusing on several small gap closures. For a couple of big projects, there's an opportunity to build upon Fayetteville's unique economic base by transforming parts of the city that are seeing declining values and aren't supporting the current economy. Council Member La Tour: I don't want to adopt a new program that would force people a square peg in a round hole. Some people might be happy to drive their car to work and I don't want them to feel guilty about that. Jeff Tumlin: Absolutely, not. It was clear in public comments that nobody wanted to force anyone out of their car. It was also clear there was an interest in more choices and safer choices for all residents. There was recognition it might be more cost effective to invest in providing opportunities for some people to walk, bike or take transit. Council Member La Tour spoke about the elderly, cost of parking, and inclusion of all citizens. Council Member Bunch stated if we could reduce traffic, the number of trips driven by 10%, it would make a huge difference, which is through multi module transportation. Approved MSI Consulting Group, LLC: A resolution to authorize the purchase of annual software maintenance from MSI Consulting Group, LLC for Virtual Justice software used by the District Court, Police Department and the City Prosecutor Division in the amount of $21,600.00 plus applicable taxes, and to approve a 5% project contingency in the event additional licenses are needed. Resolution 79-I8 as recorded in the office of the City Clerk Continuous Process Improvement Training: A resolution to authorize a contract with Northwest Arkansas Community College for a continuous process improvement training program for Development Services Department staff in an amount not to exceed $40,000.00, and to approve a budget adjustment. Resolution 80-18 as recorded in the office of the City Clerk Council Member Marsh moved to accept the Consent Agenda as read. Council Member Gray seconded the motion. Crossover Rd./Jones): An ordinance to rezone that property described in rezoning petition RZN 17-6034 for approximately 4.40 acres located at 2468 North Crossover Road from RSF-2, Residential Single Family, 2 units per acre to NS -L, Neighborhood Services - Limited. This ordinance was left on the first reading at the February 6, 2018 City Council meeting. This ordinance was left on the second reading at the February 20, 2018 City Council meeting. At the March 6, 2018 City Council meeting this ordinance was tabled to the March 20, 2018 City Council meeting. Mayor Jordan: Is there anything new to add? Garner Stoll, Development Services Director: No, Mayor. Jerry Jones, Applicant spoke about all the marketing efforts attempted to promote the sale of lots in Lynnwood Estates. He stated at the last City Council meeting his item was tabled to allow interested residential buyers to come forward and no one has come forward. He believes it shows no one wants to build a residence on Crossover Road. He stated city staff and Planning Commission agree that NS -L is a good rezone request. He believes there would be a side effect of spot zoning. He spoke against the ordinance. Ted Wade, 2863 East Township stated there is a lot of commercial property available to lease in Fayetteville. He stated adding commercial space for the sake of creating an opportunity to sell land doesn't fit with the right thing to do. He spoke about one -bedroom apartments being available for citizens. He spoke about safety and traffic flow concerns. He spoke about property value concerns and people coming down his private driveway. Mayor Jordan asked shall the ordinance pass. Ordinance 6047 as Recorded in the office of the City Clerk Amend §74.01 Application Of Regulations: An ordinance to amend §74.01 Application Of Regulations to add a definition of roadway. This ordinance was left on the first reading at the March 6, 2018 City Council meeting. Council Member Petty moved to suspend the rules and go to the second reading. Council Member Gray seconded the motion. Upon roll call the motion passed 7-0. Council Members Kinion, Petty, Bunch, La Tour, Smith, Gray, and Marsh voting yes. Council Member Tennant was absent. City Attorney Kit Williams read the ordinance. City Attorney Kit Williams: Council Member Gray requested me to provide a Section 2, which would limit the highest fine for improperly being in the roadway to $25. Mayor Jordan: This would be an amendment? City Attorney Kit Williams: Yes. Council Member La Tour: If we don't adopt the amendment, what is the fine? City Attorney Kit Williams: The potential fine, it's always not more than, and the penalty for subsections which do not have a fine already stated, would be up to $500. Council Member La Tour: If our objective is to move people away from the medians for public safety and someone is making money by being on the median, they may see the fine as a cost of doing business. Our fine has to be sufficiently large, not to damage anyone, but give everyone an incentive to stay out of harm's way. We want to protect pedestrians and citizens in moving vehicles from a traumatic experience. 113 West Mountain Fayetteville, AR 72701 (479) 575-8323 www.fayetteville-ar.gov City Council Meeting Minutes March 20, 2018 Page 6 of 13 City Attorney Kit Williams: Council Member Gray and I think a $25 fine is quite sufficient. If somebody starts getting fines and continues to stay out there, then we can address that as it occurs. If that happens, then City Council can decide if they want to change the fine. This is a safety issue. We want to protect people who are endangering themselves and others by crossing traffic and being in a median not designed for pedestrians. Police Officers are not going to impose this harshly on anyone. It always goes to the court and the court would never have imposed a $500 fine. It shows good faith on the City Councils' part to limit the fine to $25. Lorraine O'Neal, 2070 East Spinel Link stated that a $25 penalty is insufficient. She spoke about the way the public would be notified of the fee for standing in the median. Rob Qualls, 2140 Jonquil stated he represents a Civil Rights organization called, For Fayetteville. He stated he's in favor of lowering the fine, but if someone is in real need, $25 is still quite a bit. He spoke about warnings. Greg Tabor, Chief of Police: Any time a new ordinance goes into effect, we give a 30 -day grace period from the time the ordinance goes into effect. City Attorney Kit Williams: You would be giving them warnings or advice, but not actual tickets? Greg Tabor: Correct. Don Marr, Chief of Staff spoke about discretion. City Attorney Kit Williams spoke about doing warnings administratively. He stated by reducing the fine to $25 it sends out a good message that the city isn't trying to be punitive, but instead is trying to look out for the safety of all. Council Member Marsh: In the amendment language it says, shall be fined not more than $25. I believe that gives some allowance for a smaller fine or no fine as appropriate. I am comfortable with that language. We can change this ordinance in the future if the need arises. Council Member Bunch: I like the smaller fine. I wondered if the, shall be fined not more, does that include if someone gets a fine and doesn't pay it? For example, if I get a parking ticket and I don't pay it in a certain amount of time, then it goes up in price. Does it go up in price in this case? City Attorney Kit Williams: That penalty provision in parking is written into the code. If you don't pay a fine then that's another offense. It can increase if someone doesn't follow the law and refuses to pay the fine. This is not more than $25 and I thought a much lower ceiling made more sense. Council Member Gray moved to amend §74.99 Penalty of Chapter 74 by enacting a new (C), Whoever violates §74.03, §74.04 or §74.05 shall be fined not more than $25. Council Member Tennant was absent. Rob Qualls, 2140 Jonquil stated he disagrees with the solution being proposed. He spoke about signage being helpful. He is concerned about the notification process. He requested the item to be delayed allowing for the systems to be in place before the ordinance takes effect. Mayor Jordan: You want to hold this until we contact the state? Rob Qualls: Yes, sir. Mayor Jordan: I would have to go to the state and see if they would give us permission for signage. They could say, no. City Attorney Kit Williams: We didn't put an emergency clause on this. Therefore, the ordinance doesn't go into effect for 31 days after it is passed. Then you would have an additional 30 days to giving warnings and educating the public. This is a 60 -day hold built into it before any tickets are going to be written. Mayor Jordan: I'll find out something from the state in the next few days. Council Member Petty: I'm appreciative of staff and the research they've done for the suggestions that came from the community. This ordinance is about safety and not about panhandling. We are not doing anything to keep people from panhandling on the corners of intersections. This is only talking about the middle of the roadways. This will impact people who are struggling more than it will impact other people in the community. I hope the state allows us to do some of these things in the middle of the roadway, but even if they don't, I hope we will still implement programs in other places in town to help the least fortunate. I trust the city will be lenient with fines. Mayor Jordan: We can put signs up on a city street. Is that right, Kit? City Attorney Kit Williams: That is correct. Greg Tabor, Chief of Police: I want everyone to know the Fayetteville Police Department is very compassionate. It is not our goal to write tickets. I have many examples the public never hears about where an officer takes money out of their own pocket to buy food or diapers for people who are in need. If someone is standing in the median we are going to inform them of the law. If they are truly in need, we are going to do everything we can to help them. Don Marr, Chief of Staff. The staff took concern with people thinking we would target a vulnerable group. This administration has gone from zero to over $600,000 of funding for the needy. In these locations, take the panhandler away, and put a 12 -year-old child selling Girl Scout cookies there. We wouldn't want anyone doing this because of the safety concerns. We are also concerned about the mental wellbeing of the person or family who hits a pedestrian in these areas. Mayor Jordan asked shall the ordinance pass. Upon roll call the ordinance passed 7-0. City Attorney Kit Williams read the ordinance. City Attorney Kit Williams: We believe the best thing to do is to start this application with the Police Department, which is what this will do. It will require the applicant to provide what they are proposing to the state Alcoholic Beverage Commission. All the questions that they have to answer for the state we will be able to see ahead of time. It will then be presented to the City Council to decide if it is a quality application. Once passed by the City Council, then they can go to the state. Once they go to the state and get it passed, it comes back here to automatically get their city permit issued. Before this law, you didn't have to see any of these. Council Member Petty: When somebody goes through this process, would it be a resolution or an ordinance to approve their permit? City Attorney Kit Williams: Act 1112 said an ordinance, but I'll look at that again. I'm pretty sure it does require an ordinance. Council Member Petty: On the off chance it says resolution, I would like these to go on the Consent agenda. City Attorney Kit Williams: It does say Act 1112, by ordinance. Mayor Jordan: Kit, do you have an amended version? City Attorney Kit Williams: Yes. Garner Stoll and Andrew Garner pointed out that a change is probably warranted. It would be to amend that a signed Certificate of Mailing must be provided. It should not have to be provided with the actual application. It should be provided before the Planning Commission can hear any application. Garner Stoll, Development Services Director The previous ordinance was workable, but this clarifies that the first three are required before we take the application. The fourth requirement, which is a certification that the surrounding property owners have been notified is required before we can place it on the Planning Commission's agenda. Council Member Marsh moved to amend, Prior to the Planning Commission's consideration, the applicant must furnish the Planning Department a signed Certificate of Mailing to notify all adjacent property owners of the requested rezoning. They have all served for a long time. We are going to have to reappoint them quickly so they get within their terms again. Their longtime Chairman, Lamar Pettus has sold his property and can no longer serve once his replacement has been chosen. The other two members have served a long time. It's difficult sometimes to get people to serve because you must be a landowner in the district. I don't think City Council has ever interviewed them before because it's an improvement district and not a city committee. I told them I would ask if it would be possible that you would not have to interview the two that would like to serve again. There will be a third person. They will all submit a petition as required by state law. It is an appointment by the City Council. You could insist on interviewing them if you want, but it is a very small area of people who could serve. It's more difficult to get people to serve than trying to keep people away from serving. Please think about it and let me know at Agenda Session if it's satisfactory with you or not. Don Marr, Chief of Staff: Asphalt work will be causing street closures in the Downtown Square area this week. The information is on the city website. A year ago, the Council asked that we work closely with the University of Arkansas when firework notifications were going to be made. The list of dates can be viewed on the city website. On March 21, 2018 at the Town Center from 3:00 p.m. to 5:00 p.m. there will be an event called, Progress in Print. The City of Fayetteville's Community Resources Division is hosting this event as a way of highlighting the variety of programs funded by the federal CDBG program. The event is free.
