A RESOLUTION TO APPROVE AMENDMENT #1 TO THE WATER MAIN INSTALLATION
COST SHARE AGREEMENT WITH GARDEN DISTRICT TOWNHOMES, LLC TO PROVIDE FOR
REIMBURSEMENT OF THE COST OF MATERIALS FOR INSTALLING TWO FIRE HYDRANTS IN
THE AMOUNT OF $5,121.60
WHEREAS, on September 25, 2017, the City Council approved a cost share agreement with Garden
District Townhomes, LLC for the construction of a water main along a portion of 9th Street between
South College Avenue and South Washington Avenue, a distance of approximately 340 feet; and
WHEREAS, due to a misunderstanding the developer installed two fire hydrants the City had agreed
to install and City staff recommend reimbursing the developer for the cost of the materials required to
install the hydrants.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves Amendment #1
to the water main installation cost share agreement with Garden District Townhomes, LLC to provide
for reimbursement of the cost of materials for installing two fire hydrants in the amount of $5,121.60.

SUBJECT: Garden District Townhomes, LLC Amendment No. 1
RECOMMENDATION:
Staff recommends approval of Amendment No. 1 to the cost share agreement with Garden
District Townhomes, LLC in the amount of $5,121.60 for reimbursement for the installation of
two fire hydrants for a waterline cost share on 91h Street.
BACKGROUND:
The City recently participated in a cost share with Garden District Townhomes for installing a
water line on 9` Street between N College and Washington. The cost share payment was
$16,327.50 plus $1,064.59 of the $1,632.75 contingency. When we were making decisions on
the scope of the project, the customer was told that the City would install a new fire hydrant at
each end of this water line, at N College and at Washington. There was some
misunderstanding, and the client installed the 2 hydrants at their expense.
DISCUSSION:
Since the original understanding was for the City to install the fire hydrants at the City's
expense, staff feels it is fair to reimburse Garden District Townhomes, LLC, for the cost of the
materials at the City's cost, which is $5,121.60. This cost is well below industry average.
BUDGET/STAFF IMPACT:
Funds for the City's portion are available in the Water Impact Fee Cost Sharing Project.

AMENDMENT #1 TO CONTRACTUAL AGREEMENT
FOR COST SHARE OF WATER MAIN INSTALLATION COSTS
BE IT KNOWN TO ALL:
That the City of Fayetteville, Arkansas (the "City") and Garden District Townhomes,
LLC on this 6" day of March, 2018, hereby agree that Contractual Agreement for Cost Share of
Water Main Installation Costs of September 5, 2017, shall be amended to include an additional
obligation by the City of Fayetteville as follows:
"The City of Fayetteville agrees to reimburse Garden District Townhomes,
LLC for the costs of installing two fire hydrants in the total amount of
$5,121.60."
The parties agree and understand that this Amendment is supplemental to their
Agreement of September 5, 2017, and that it does not alter, amend or abridge any of the rights,
obligations, or duties of the parties not expressly addressed herein.
IN WITNESS WHEREOF, the parties hereto have caused their signatures to be set by
their authorized representative effective the date set forth herein above.
