STARR DRIVE WATER COST SHARE:
AN ORDINANCE TO WAIVE THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING AND
APPROVE A COST SHARE AGREEMENT WITH ROBERT MARTIN, ANDREW WILLIAMS, AND
NICK BANKS FOR THE INSTALLATION OF WATER MAIN ALONG A 1,520 FOOT PORTION OF
NORTH STARR DRIVE, WITH THE ESTIMATED AMOUNT TO BE PAID BY THE CITY OF
FAYETTEVILLE NOT TO EXCEED $23,950.00, AND TO APPROVE A PROJECT CONTINGENCY IN
THE AMOUNT OF $4,790.00
WHEREAS, Robert Martin, Andrew Williams, and Nick Banks will be developing property located on
North Starr Drive and have requested that the City share in the cost of constructing an 8 -inch water
main along a portion of North Starr Drive, a distance of approximately 1,520 feet; and
WHEREAS, the City of Fayetteville would benefit from the cost share as it will allow the development
to connect, will allow for a future secondary water loop to help prevent the possibility of residents losing
water service in the event of a water leak in the area, and provide for ample future capacity which will
facilitate future development; and
WHEREAS, § 51.112 of the Fayetteville City Code provides that "the City shall pay the excess material
cost of facilities of a size that is larger than required to serve subdivisions when such excess size is
specified and required by the water and wastewater director for the general benefit of the water
system"; and
WHEREAS, waiving formal competitive bidding will save time and cost by utilizing the developer's
contractor who will be on-site installing the line for the developer's project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an
exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and approves a cost share agreement
with Robert Martin, Andrew Williams, and Nick Banks for the installation of an 8 -inch water main along a
1,520 foot portion of North Starr Drive with the estimated amount to be paid by the City of
Fayetteville not to exceed $23,950.00, and further approves a project contingency in the amount of$4,790.00.

SUBJECT: Cost Share Agreement with Robert Martin, Andrew Williams and Nick
Banks for a Water Line Upgrade on N. Starr Drive.
RECOMMENDATION:
Staff recommends approval of a cost -share agreement between the City of Fayetteville and
Robert Martin, Andrew Williams and Nick Banks., to share the costs of upgrading a waterline on
N. Drive. The estimated total cost of the project is $66,925.00. The City's portion of the cost
share in the amount of $28,740.00, which includes a 20% contingency of $4,790.00.
BACKGROUND:
Robert Martin, Andrew Williams and Nick Banks have requested that the City share in the cost
of upgrading the installation of waterline from 4 -inch to 8 -inch along a portion of N. Starr Drive,
a distance of approximately 1,520 feet, so that Robert Martin, Andrew Williams and Nick Banks
may develop their property -located at on N. Starr Drive.
DISCUSSION:
Upgrading this waterline to an 8 -inch will allow development of this property and will also
provide for a future secondary loop to help prevent the possibility of residents losing water
service in the event of a water leak in the area.
BUDGET/STAFF IMPACT:
Funds for the City portion of work are available in the Water Impact Fee Cost Sharing Project.

CONTRACTUAL AGREEMENT FOR.
COST SHARE OF WATER MAIN UPGRADE COSTS
This Agreement, made and entered into on this 3rd day of October, 2017, by and between
the City of Fayetteville, Arkansas ("City") and Robert Martin, Andrew Williams and Nick Banks
witnesseth:
WHEREAS, Robert Martin, Andrew Williams and Nick Banks (through Blew &
Associates, P.A.) received approval by the City's Engineering Department on August 25'x, 2017,
for a waterline project on Starr Drive; and
WHEREAS, increasing the size of this approximately 1,520 -foot segment from a 4 -inch
main to an 8 -inch main will allow the development to connect and also allow for a future
secondary water loop to help prevent the possibility of residents losing water service in the event
of a water leak in the area; and
WHEREAS, § 51.112 of the Fayetteville City Code provides that "the City shall pay the
excess material cost of facilities of a size that is larger than required to serve subdivisions when
such excess size is specified and required by the water and wastewater director for the general
benefit of the water system."
NOW, THEREFORE, the City of Fayetteville, Arkansas and Robert Martin, Andrew
Williams and Nick Banks agree as follows:
1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse Robert Martin, Andrew Williams and Nick Banks for the excess
cost to upgrade approximately 1,520 linear feet of 4 -inch water main in the
area identified in Exhibit "A" to 8 -inch main up to a maximum -not -to -exceed
amount of $20,475.00 as was estimated by the builder's representative and
shown on Exhibit "B", attached. Additionally, the City agrees to pay 50% of
the engineering cost of the project, which is $3,475.00. The total cost share is
$23,950.00 along with any project contingency that may be approved by the
Fayetteville City Council.
B. Payments due to Robert Martin, Andrew Williams and Nick Banks shall be
remitted within sixty (60) days after receipt of valid invoices.
2. Robert Martin, Andrew Williams and Nick Banks agree to.-
A.
o:
A. Provide the necessary and normal project management, inspection, and testing
as necessary for a complete and acceptable water main installation, including
submittal of plans and specifications to the City's Engineering Department,
per their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.
C. Pay for the water main installation (with reimbursement by the City of
Fayetteville as set forth in this Agreement).
3. It is further understood that the contract for construction of the water main upgrade is
between Robert Martin, Andrew Williams and Nick Banks and their Contractor and
that the City has no contractual obligation with either the Contractor or the Engineer.
The City's only obligation shall be to participate in this agreement with a not -to -
exceed reimbursable amount of $23,950.00 for the water main upgrade, along with
any project contingency that may be approved by the Fayetteville City Council.

Staff recommends the approval of the use of contingency funds in the amount of$4,790.00 for a

BACKGROUND:
Robert Martin, Andrew Williams and Nick Banks requested that the City share in the cost of
upgrading the installation of waterline from 4-inch to 8-inch along a portion of N. Starr Drive, a
distance of approximately 1,520 feet, so that Robert Martin, Andrew Williams and Nick Banks
may develop their property located on N. Starr Drive. Ordinance 5998, which was passed on
October 3, 2017, approved the cost share agreement with Robert Martin, Andrew Williams and
Nick Banks for the waterline upgrade on Starr Drive.
DISCUSSION:
During construction of the waterline, the contractor encountered large amounts of rock.
Removal of this rock added unexpected costs to the construction project. The entire
contingency is needed in the amount of $4,790.00 to cover the unexpected costs. The total
payment including the contingency will be $28,740.00.
BUDGET/STAFF IMPACT:
Funds are available in the Water/Sewer Impact Fee Cost Sharing project.

WHEREAS, Robert Martin, Andrew Williams, and Nick Banks will be developing property located on
North Starr Drive and have requested that the City share in the cost of constructing an 8-inch water
main along a portion of North Starr Drive, a distance of approximately 1,520 feet; and
WHEREAS, the City of Fayetteville would benefit from the cost share as it will allow the development
to connect, will allow for a future secondary water loop to help prevent the possibility of residents losing
water service in the event of a water leak in the area, and provide for ample future capacity which will
facilitate future development;and
WHEREAS, § 51.112 of the Fayetteville City Code provides that "the City shall pay the excess material
cost of facilities of a size that is larger than required to serve subdivisions when such excess size is
specified and required by the water and wastewater director for the general benefit of the water
system"; and
WHEREAS, waiving formal competitive bidding will save time and cost by utilizing the developer's
contractor who will be on-site installing the line for the developer's project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

RECOMMENDATION:
Staff recommends approval of a cost-share agreement between the City of Fayetteville and
Robert Martin, Andrew Williams and Nick Banks., to share the costs of upgrading a waterline on
N. Drive. The estimated total cost of the project is $66,925.00. The City's portion of the cost
share in the amount of$28,740.00, which includes a 20% contingency of$4,790.00.
BACKGROUND: •
Robert Martin, Andrew Williams and Nick Banks have requested that the City share in the cost
of upgrading the installation of waterline from 4-inch to 8-inch along a portion of N. Starr Drive,
a distance of approximately 1,520 feet, so that Robert Martin, Andrew Williams and Nick Banks
may develop their property located at on N. Starr Drive.

DISCUSSION:
Upgrading this waterline to an 8-inch will allow development of this property and will also
provide for a future secondary loop to help prevent the possibility of residents losing water
service in the event of a water leak in the area.
BUDGET/STAFF IMPACT:
Funds for the City portion of work are available in the Water Impact Fee Cost Sharing Project.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF WATER MAIN UPGRADE COSTS
This Agreement,made and entered into on this 3rd day of October,2017,by and between
the City of Fayetteville,Arkansas("City")and Robert Martin,Andrew Williams and Nick Banks
witnesseth:
WHEREAS, Robert Martin, Andrew Williams and Nick Banks (through Blew &
Associates,P.A.)received approval by the City's Engineering Department on August 25i6, 2017,
for a waterline project on Starr Drive;and
WHEREAS, increasing the size of this approximately 1,520-foot segment from a 4-inch
main to an 8-inch main will allow the development to connect and also .allow for a future
secondary water loop to help prevent the possibility of residents losing water service in the event
of a water leak in the area;and
WHEREAS, § 51.112 of the Fayetteville City Code provides that"the City shall pay the
excess material post of facilities of a size that is larger than required to serve subdivisions when
such excess size is specified and required by the water and wastewater director for the general
benefit of the water system."
NOW, THEREFORE, the City of Fayetteville, Arkansas and Robert Martin, Andrew
Williams and Nick Banks agree as follows:

1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse Robert Martin, Andrew Williams and Nick Banks for the excess
cost to upgrade approximately 1,520 linear feet of 4-inch water main in the
area identified in Exhibit"A" to 8-inch main up to a maximum-not-to-exceed
amount of$20,475.00 as was estimated by the builder's representative and
shown on Exhibit "B", attached. Additionally, the City agrees to pay 50% of
the engineering cost of the project, which is$3,475.00. The total cost share is
$23,950.00 along with any project contingency that may be approved by the
Fayetteville City Council.
B. Payments,due to Robert Martin, Andrew Williams and Nick Banks shall be
remitted within sixty(60)days after receipt of valid invoices.
2. Robert Martin,Andrew Williams and Nick Banks agree to:
A. Provide the necessary and normal project management,inspection, and testing
as necessary for a complete and acceptable water main installation, including
submittal of plans and specifications to the City's Engineering Department,
per their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.
C. Pay for the water main installation (with reimbursement by the City of
Fayetteville as set forth in this Agreement).
3. It is further understood that the contract for construction of the water main upgrade is
between Robert Martin, Andrew Williams and Nick Banks and their Contractor and
that the City has no contractual obligation with either the Contractor or the Engineer.
The City's only obligation shall be to participate in this agreement with a not-to-
exceed reimbursable amount of$23,950.00 for the water main upgrade, along with
any project contingency that may be approved by the Fayetteville City Council.
