All interested persons may appear and address the City Council on Unfinished Business, New Business, and Public Hearings
at City Council meetings. If you wish to address the City Council on an agenda item, please wait for the Mayor or Chair to
request public comment then queue behind the podium. When the Mayor or Chair recognizes you, approach the podium and
give your name and address. Comments are to be addressed to the Mayor or Chair. The Mayor or Chair will direct your
comments to the appropriate elected officials, staff, or others for response. Keep your comments respectful, brief, to the
point, and relevant to the agenda item being considered. Each speaker from the public will be allowed one turn at the
microphone for discussion of an agenda item.
Agenda Additions: A new item which is requested to be added to the agenda at a City Council meeting should only be
considered if it requires immediate City Council consideration and if the normal agenda setting process is not practical. The
City Council may only place such new item on the City Council meeting's agenda by suspending the rules by two-thirds
vote. Such agenda addition shall be heard prior to the Consent Agenda.
Consent Agenda: Consent Agenda items shall be read by the Mayor and voted upon as a group without discussion by the
City Council. If an Alderman wishes to comment upon or discuss a Consent Agenda item, that item shall be removed and
considered immediately after the Consent Agenda has been voted upon.
Unfinished Business and New Business: Presentations by Staff and Applicants: Agenda items shall be
introduced by the Mayor and, if an ordinance, read by the City Attorney. City staff shall then present a report.
An agenda applicant (city contractor, rezoning or development applicant, etc.) may present its proposal only
during this presentation period, but may be recalled by a City Council member later to answer questions. City
staff, City Council members, and applicants may use electronic visual aids in the City Council meeting as part of
the presentation of the agenda item.
Public Comments: Public comment shall be allowed for all members of the audience on all items of unfinished
and new business and subjects of public hearings. A simple majority of the City Council members, present and
voting, may authorize a representative of a Fayetteville citizens' group opposing the ordinance or resolution to
present an electronic visual aid not to exceed five minutes, but no other electronic visual aid presentations will
be allowed; however, the public may submit photos, petitions, etc. to be distributed to the City Council. If a
member of the public wishes for the City Clerk to distribute materials to the City Council before its meeting,
such materials should be supplied to the City Clerk's Office no later than 9:00 A.M. on the day of the City
Council meeting. Any member of the public shall first state his or her name and address, followed by a concise
statement of the person's position on the question under discussion. Repetitive comments should be avoided; this
applies to comments made previously either to the City Council or to the Planning Commission when those
Planning Commission minutes have been provided to the Aldermen. All remarks shall be addressed to the
Mayor or the City Council as a whole and not to any particular member of the City Council. No person other
than the City Council member and the person having the floor shall be permitted to enter into any discussions
without permission of the Mayor. No questions shall be directed to an Alderman or city staff member except
through the Mayor.

Courtesy and Respect: All members of the public, all city staff and elected officials shall accord the utmost
courtesy and respect to each other at all times. All shall refrain from rude or derogatory remarks, reflections as
to integrity, abusive comments and statements about motives or personalities. Any member of the public who
violates these standards shall be ruled out of order by the Mayor, must immediately cease speaking and shall
leave the podium.
Interpreters or Telecommunications Devise for the Deaf (TDD), for hearing impaired are available for all City
Council meetings, a 72 -hour advance notice is required. For further information or to request an interpreter,
please call 479-575-8330.

RECOMMENDATION:
A resolution to award Bid 17-33 and authorize a contract with Vance Brothers, Inc. for asphalt
microsurfacing of city streets at a cost of $2.28 per square yard for projects as needed.
BACKGROUND:
The City of Fayetteville accepted bids from properly licensed firms for the application of micro -
surfacing material to 72,850 square yards of asphalted pavement surfaces for various locations.
DISCUSSION:
The Transportation Division has utilized microsurfacing for preventative asphalt maintenance
since 2012. Microsurfacing minimizes aging, reduces water infiltration, corrects raveling and
weathering, provides a skid resistance surface, and improves overall aesthetics.
BUDGET/STAFF IMPACT:
Funds for asphalt microsurfacing have been budgeted in the In -House Pavement Improvements
capital project.

Contract — Between City and Vance Brothers, Inc.
Term: Valid through 12/31/2017
This contract executed this day of J2017, between the City of Fayetteville, Arkansas (City), and Vance
Brothers, Inc. in consideration of the mutual covenants contained herein, the parties agree as follows:
Vance Brothers, Inc. at its own cost and expense shall furnish all labor, materials, supplies, machinery, equipment,
tools, supervision, bonds, insurance, tax permits, and all other accessories and services necessary to complete
items bid per Bid 17-33 as stated in Vance Brothers,_ Inc. bid proposal, and in accordance with specifications
attached hereto and made a part hereof under Bid 17-33, all included herein as if spelled out word for word.
2. The City of Fayetteville shall pay Vance Brothers, Inc. based on their bid proposal in an amount not to exceed
$156,098 for the Initial scope of work and $2.28 per square lard as needed. Payments will be made after approval
and acceptance of work and submission of invoice. Payments will be made approximately 30 days after
acceptance of invoice.
3. The Contract documents which comprise the contract between the City of Fayetteville and Vance Brothers, Inc.
consist of this Contract and the following documents attached hereto, and made a part hereof:
A. Bid form identified as Invitation to Bid 17-33 with the specifications and conditions typed thereon.
B. Vance Brothers, Inc. bid proposal.
C. The Notice to Prospective Bidders and the Bid Tabulation.
These Contract documents constitute the entire agreement between the City of Fayetteville and Vance Brothers,
Inc. and may be modified only by a duly executed written instrument signed by the City of Fayetteville and Vance
Brothers, Inc.
Vance Brothers, Inc. shall not assign its duties under the terms of this agreement.
Vance Brothers, Inc. agrees to hold the City of Fayetteville harmless and indemnify the City of Fayetteville, against
any and all claims for property damage, personal injury or death, arising from Vance Brothers, Inc. performance of
this contract. This clause shall not in any form or manner be construed to waive that tort immunity set forth
under Arkansas Law.
Vance Brothers, Inc. shall furnish a certificate of insurance addressed to the City of Fayetteville, showing that he
carries the following insurance which shall be maintained throughout the term of the Contract. Any work sublet,
the contractor shall require the subcontractor similarly to provide worker's compensation insurance. In case any
employee engaged in work on the project under this contract is not protected under Worker's Compensation
Insurance, Vance Brothers, Inc. shall provide and shall cause each Subcontractor to provide adequate employer's
liability insurance for the protection of such of his employees as are not otherwise protected.

The premiums for all insurance and the bond required herein shall be paid by Vance Brothers, Inc.

9, This contract may be terminated by the City of Fayetteville or Vance Brothers, Inc. with 30 days written notice.
10. This project shalt be completed within 30 calendar days from issue date of Notice to Proceed.
11. Liquidated Damages: N/A
12. Freedom of Information Act: City of Fayetteville contracts and documents prepared while performing city
contractual work are subject to the Arkansas Freedom of Information Act. If a Freedom of Information Act
request is presented to the City of Fayetteville, the contractor will do everything possible to provide the
documents in a prompt and timely manner as prescribed in the Arkansas Freedom of Information Act (A.C.A. 25-
19-101 et. Seq.). Only legally authorized photo coping costs pursuant to the FOIA may be assessed for this
compliance.
13. Changes in Scope or Price: Changes, modifications, or amendments in scope, price or fees to this contract shall
not be allowed without a prior formal contract amendment approved by the Mayor and the City Council In
advance of the change in scope, cost or fees.

GENERAL NOTES
1. THE CONTRACTOR SHALL PROVIDE A TRAFFIC CONTROL PLAN THAT INDICATES
TYPE OF SIGNING, SPACING OF SIGNING, FLAGGERS, CHANNELIZERS AND OTHER
TRAFFIC CONTROL ITEMS IN ACCORDANCE WITH THE CURRENT EDITION OF THE
MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES (MUTCD).
2. IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO PROVIDE, INSTALL
AND MAINTAIN SUCH SIGNS, CONES, LANE DELINEATORS, AND OTHER FACILITIES
THAT MAY BE NECESSARY TO PROTECT THE WORK AND PROVIDE FOR SAFE
TRAVEL THROUGH THE CONSTRUCTION AREA. ALL SIGNING SHALL CONFORM TO
THE LATEST EDITION OF THE MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES.
3. UTILITY COVERS, MANHOLES, GRATED INLETS, CURB INLETS AND TRAFFIC
DEVICE COVERS LOCATED IN THE ROADWAY TO BE PAVED SHALL BE PROTECTED
FROM COVERAGE BY THE MICROSURFACING AND REFERENCED FOR PROMPT
LOCATION AND CLEANING FOLLOWING APPLICATION. THE ABOVE ITEMS SHALL BE
CLEANED TO THEIR PRE -SURFACING CONDITION OR AS DIRECTED BY THE CITY.
4. WORK AT INTERSECTIONS SHALL BE DONE IN STAGES, OR BLOTTER MATERIALS
SHALL BE USED, TO ALLOW CROSSING AND TURNING MOVEMENTS.
5. WHEN CONSTRUCTION IS BEING PERFORMED UNDER TRAFFIC, ALL EQUIPMENT.
INCLUDING LOADING VEHICLES AND SUPPLY TRUCKS WILL BE REQUIRED TO
OPERATE IN A SINGLE LANE ON WHICH THE MICROSURFACING IS BEING APPLIED,
UNLESS OTHERWISE APPROVED.
6. THE CONTRACTOR SHALL PROVIDE NOTICE TO THE CITY AND AFFECTED
RESIDENTS A MINIMUM OF 3 BUSINESS DAYS PRIOR TO COMMENCEMENT OF THE
PROJECT.

SUBJECT: Purchase of one Aerial Platform Truck for Transportation
RECOMMENDATION:
City Council approve the purchase of a Ford F550 with Dakota Body and Aerial Platform in the
amount of $103,115.00 available through Grand Truck Equipment Company of Afton, OK for
use by the Transportation Department and to approve a budget adjustment.
BACKGROUND:
This expansion is requested for a second bucket truck for the Traffic Department. The Traffic
Department currently has one aerial bucket truck to service 120 traffic signals, a few hundred
lights along the trails and the downtown Fayetteville lighting, as well as any signs attached to
any of these traffic signals or lights. In a study done by IMSA (International Municipal Signal
Association) showed the national average as 1 truck and technician per every 40 traffic signals.
This expansion will make our ratio closer to that average.
DISCUSSION:
Fleet recommends the purchase of a Ford F550 with Dakota Body and Aerial Platform in the
amount of $103,115.00 available for the lowest bid that met all specifications received through
Bid 17-34 through Grand Truck Equipment Company of Afton, OK.
BUDGET/STAFF IMPACT:
Transportation had excess funds from the sale of several vehicles in the last year to use for this
purchase. A budget adjustment will be presented to Council for the approval to use fund
balance.
This purchase was approved by the Equipment Committee on June 13, 2017.
