WHEREAS, § 72.58(I)(1) of the City Code currently sets monthly parking rates for the Meadow Street parking garage at $50.00 per space per month for the first and second levels and $30.00 per space per month for the third level; and WHEREAS, the Administration is allowed to establish parking rates of up to $70.00 per month per space in all other parking structures built or purchased after January 1, 2000; and WHEREAS, permitting similar flexibility in setting rates for the Meadow Street parking garage as other parking garages will allow the City to respond to market demands and also provide incentives for access to parking on certain levels while allowing reserved spaces to be priced according to demand. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby repeals § 72.58(I) and § 72.58(I)(2) of the Fayetteville City Code and enacts a replacement § 72.58(I)(1) and 72.58(I)(2) as follows: "(I) Rates for Parking in City Parking Garages. BACKGROUND: Rental rates for the Meadow St. Parking Deck were last amended by Ordinance 5340 of 2010 which set the rates at $50 per space/per month for the first and second levels and maintained the rate of $30 per space/per month for the third level. Previous ordinances have amended these rates at various times over the years. The City currently leases the first and third levels at $50 per space/per month to the owner of the Chancellor Hotel, Southwind Hospitality, LLC. This lease was entered into in 2011 and is up for automatic renewal in 2019. The second level of the deck contains 87 spaces which are leased by space, Monday -Friday from 7:00 a.m. — 6:00 p.m., to area businesses and employees. This current structure ensures lessees have a reserved parking space within the second level. DISCUSSION: The purpose for removing the specific rental rates and stating that the deck shall be rented at a market rate not to exceed a uniform fee of $70.00 per month/per space is threefold: 1. This amendment would reflect the terms of the City's current lease agreement with Southwind Hospitality, LLC. Although the language in city code sets the rental rate for the third level of the deck at $30 per space/ per month, the lessees and the City agreed in 2011 to a different rate ($50 per space/ per month). 2. This proposed language would mirror the existing language in §72.58(1)(2) which sets the rental rates for all parking decks built after January 1, 2000, including the Town Mailing Address: 113 W. Mountain Street www_fayetteville-ar.gov Fayetteville, AR 72701 Center Deck. Although authorized to establish rental rates up to $70 per space/per month, spaces in the Town Center Deck are currently rented for $50 per space/per month. 3. Lastly, this amendment would give the City much needed flexibility to not only revise rental rates as market demand shifts, but it would also allow the City to provide a price incentive for access to parking while allowing reserved spaces to be priced according to demand.
