THE CITY OF FAYETTEVILLE NOT TO EXCEED $16,375.00, AND TO APPROVE A PROJECT
CONTINGENCY IN THE AMOUNT OF $3,347.00
WHEREAS, South Block Partners, LLC will be developing property located at the northeast corner of West
5th Street and South Block Avenue and has requested that the City share in the cost of constructing an 8 -
inch sewer main along a portion of South Block Avenue between West 5th Street and West 4th Street, a
distance of approximately 110 feet; and
WHEREAS, the City of Fayetteville would benefit from the cost share as it will extend sewer service to
an area in the core of the City that has never been served before and provide for ample future capacity
which the City recognizes will be necessary for the area that is served by this sewer main; and
WHEREAS, § 51.113 of the Fayetteville City Code provides that "the City shall pay the excess material
cost of facilities of a size larger than required to service subdivisions when such excess size is specified
and required by the water and wastewater director for the general benefit of the sewerage system"; and
WHEREAS, waiving formal competitive bidding will save time and cost by utilizing the developer's
contractor who will be on-site installing the line for the developer's project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and approves a cost share agreement with

SUBJECT: Cost Share Agreement with South Block Partners, LLC
RECOMMENDATION:
Staff recommends approval of a cost -share agreement between the City of Fayetteville and South
Block Partners, LLC, to share the costs of installing a sewer main in South Block Avenue between
West 411 and West 51h Streets. The estimated total cost of the project is $35,270.00 The City's
portion of the cost share is approximately 50% of the estimated project cost, in the amount of
$16,735.00, with a 20% contingency of $3,347.00.
BACKGROUND:
South Block Partners, LLC has requested that the City share in the cost of installing an 8 -inch
sewer line along a portion of South Block Avenue between West 41h and West 51h Streets,
approximately 110 feet, so that South Block Partners, LLC may develop the property located at
the NE corner of West 5th Street and South Block Avenue.
DISCUSSION:
Constructing this segment of 8 -inch main will allow development of these properties and will
also provide for ample future capacity which the City recognizes will be necessary for the area
that is served by this sewer main.
BUDGET/STAFF IMPACT:
Funds for the City portion of work are available in the Water/Sewer Impact Fee Cost Sharing
Project.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF SEWER MAIN INSTALLATION COSTS
This Agreement, made and entered into on this ( WA-kday of May, 2017, by and between
the City of Fayetteville, Arkansas ("City") and South Block Partners, LLC ("South Block"),
witnesseth:
WHEREAS, South Block has requested that the City share in the cost of constructing an
8 -inch sewer main along a portion of South Block Avenue between West 4"' Street and West 50'
Street, a distance of approximately 110 feet, so that South Block may develop the property located
at the northeast corner of West 5a' Street and South Block Avenue; and
WHEREAS, constructing this segment of 8 -inch sewer main will allow development of
this property, will extend sewer service to an area in the core of the City that has never been served
before, and will also provide for ample future capacity which the City recognizes will be necessary
for the area that is served by this sewer main; and
WHEREAS, § 51.113 of the Fayetteville City Code provides that "the City shall pay the
excess material cost of facilities of a size larger than required to service subdivisions when _such
excess size is specified and required by the water and wastewater director for the general benefit
of the sewerage system."
NOW, THEREFORE, the City of Fayetteville, Arkansas and South Block Partners, LLC
agree as follows:
1:. The City of Fayetteville, Arkansas agrees to:
A. Reimburse South Block Partners, LLC for 50% of the cost to install
approximately 110 linear feet of 8 -inch sewer main in the area identified in
Exhibit "A" up to a maximum -not -to -exceed amount of $16,735 with a
contingency fund not -to -exceed $3,347.00, as was estimated by the builder's
representative and shown on Exhibit `B", attached.
B. Payments due to South Block Partners, LLC, shall be remitted within sixty (60)
days after receipt of valid invoices.
2. South Block Partners, LLC agrees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary for a complete and acceptable sewer main installation, including
submittal of plans and specifications to the City's Engineering Department, per
their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.

SUBJECT: Change Order to the Agreement with South Block Partners, LLC
RECOMMENDATION:
Staff recommends approval of a 'change order to the cost share agreement with South Block
Partners, LLC to utilized a portion of the project contingency in the amount of $1,260.00 for
the sanitary sewer cost share project on Block Avenue.
BACKGROUND:
Ordinance 5974 was passed on May 16, 2017 that approved a cost share agreement with
South Block Partners, LLC for a sanitary sewer cost share on South Block Avenue. The
agreement was for a not -to -exceed amount of $16,375.00, with a project contingency in the
amount of $3,347.00.
DISCUSSION:
South Block Partners, LLC has sent an invoice in the amount of $17,635.00, which requires
the city to utilize $1,260.00 of the approved contingency.
BUDGET/STAFF IMPACT:
Funds are available in the Water & Sewer Impact Fee Cost Sharing project.

SOUTH BLOCK PARTNERS, LLC COST SHARE AGREEMENT:
AN ORDINANCE TO WAIVE THE REQUIREMENTS OF FORMAL COMPETITIVE BIDDING AND
APPROVE A COST SHARE AGREEMENT WITH SOUTH BLOCK PARTNERS, LLC FOR THE
INSTALLATION OF A SEWER MAIN ALONG A PORTION OF SOUTH BLOCK AVENUE BETWEEN
WEST 4TH STREET AND WEST 5TH STREET, WITH THE ESTIMATED AMOUNT TO BE PAID BY
THE CITY OF FAYETTEVILLE NOT TO EXCEED $16,375.00, AND TO APPROVE A PROJECT
CONTINGENCY IN THE AMOUNT OF $3,347.00
WHEREAS, South Block Partners, LLC will be developing property located at the northeast corner of West
5th Street and South Block Avenue and has requested that the City share in the cost of constructing an 8 -
.inch sewer main along a portion of South Block Avenue between West 5th Street and West 4th Street, a
distance of approximately 110 feet; and
WHEREAS, the City of Fayetteville would benefit from the cost share as it will extend sewer service to
an area in the core of the City that has never been served before and provide for ample future capacity
which the City recognizes will be necessary for the area that is served by this sewer main; and
WHEREAS. § 51.113 of the Fayetteville City Code provides that "the City shall pay the excess material
cost of facilities of a size larger than required to service subdivisions when such excess size is specified
and required by the water and wastewater director for the general benefit of the sewerage system'; and
WHEREAS, waiving formal competitive bidding will save time and cost by utilizing the developer's
contractor who will be on-site installing the line for the developers project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:

Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an
exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and approves a cost share agreement with
South Block Partners, LLC for the installation of an 8 -inch sewer main along a portion of South Block
Avenue between West 4th Street and West 5th Street with the estimated amount to be paid by the City of
Fayetteville not to exceed $16,735.00, and further approves a project contingency in the amount of
$3,347.00.
