CITY OF JOHNSON MEMORANDUM OF UNDERSTANDING:
A RESOLUTION TO APPROVE A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY
OF FAYETTEVILLE AND THE CITY OF JOHNSON TO TRANSFER CONTROL, OPERATION,
OWNERSHIP AND MAINTENANCE OF THE TRAFFIC SIGNAL AT THE JOYCE BOULEVARD
AND WILKERSON STREET INTERSECTION IN JOHNSON
WHEREAS, in the 1990's the City of Fayetteville sought a northwestern access to Gregg Street (known
as Wilkerson when it enters Johnson) from the Northwest Arkansas Mall area; and
WHEREAS, the City of Johnson cooperated and worked with the City of Fayetteville to provide right-of-
way through the City of Johnson from its border with Fayetteville to the intersection with Wilkerson to
create this new east -west corridor; and
WHEREAS, the City of Fayetteville installed a traffic signal at this intersection and has operated and
maintained it for the last two decades; and
WHEREAS, the City of Johnson desires to obtain ownership and control over this traffic signal within its
corporate limits and plans to modify it to create protected pedestrian crossings and if Johnson extends
Joyce Avenue toward the west; and
WHEREAS, the City of Fayetteville Transportation Department supports this transfer of ownership and
maintenance responsibilities to the City of Johnson; and
WHEREAS, the City of Johnson has agreed to the proposed Memorandum of Understanding which places
a duty upon the City of Johnson to "properly operate and maintain this traffic signal so that it
continues to operate efficiently and provide the same basic service as the motoring public has enjoyed for the
last couple of decades."

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves the attached
Memorandum of Understanding with the City of Johnson and authorizes Mayor Jordan to sign this contract
which transfers control, operation, ownership and maintenance of the traffic signal at the Joyce Boulevard
and Wilkerson Street intersection to the City of Johnson.

RECOMMENDATION:
A resolution to approve a memorandum of understanding between the City of Fayetteville and
the City of Johnson to transfer control, operation, ownership and maintenance of the traffic
signal at the Joyce Boulevard and Wilkerson Street intersection in Johnson.
BACKGROUND:
In the 1990s the City of Johnson cooperated and worked with the City of Fayetteville to provide
right-of-way access to Gregg Avenue from the Northwest Arkansas Mall area. The City of
Fayetteville installed a traffic signal at the intersection of Joyce Boulevard and Wilkerson Street
and has maintained it for the last two decades.
DISCUSSION: -
The City of Johnson desires to obtain ownership and control over this traffic signal within its
corporate limits and plans to modify it to create protected pedestrian crossings and may
replace with a four way signal if Joyce Boulevard is extended to the west.
BUDGET/STAFF IMPACT:
Transferring this traffic signal would reduce annual utility and general maintenance operating
costs.

A RESOLUTION APPROVING A MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITIES OF JOHNSON AND
FAYETTEVILLE, ARKANSAS, CONCERNING THE TRAFFIC SIGNAL
AT JOYCE AND WILKE,RSON
WHEREAS, the Cities of Johnson and Fayetteville previously entered into an interlocal
agreement that the traffic signal at the intersection of Joyce Boulevard and Wilkerson Street within
the city limits of Johnson would be owned and operated by the City of Fayetteville;
WHEREAS, discussions between the cities over the last several months centered on the
City of Johnson assuming responsibility for the traffic signal and adding pedestrian crossing
sections to tie in with the nearby trailhead;
WHEREAS, future development in the City of Johnson will necessitate that the traffic
signal at that intersection be converted into four-way operation; and,
WHEREAS, the Cities of Fayetteville, Arkansas and Johnson Arkansas have reached a
Memorandum of Understanding regarding the transfer of ownership and responsibility for the
operation of the traffic signal at that intersection;
BE IT RESOLVED BY THE CITY COUNCIL OF JOHNSON, ARKANSAS, that:
Section 1: The Memorandum of Understanding regarding the transfer of the traffic
signal located at the intersection of Joyce Boulevard and Wilkerson Street, as attached to this
resolution, is hereby approved by the Council.
Section 2: The Mayor and Recorder -Treasurer are hereby authorized to sign and execute
the attached Memorandum of Understanding with the Mayor and Clerk of the City of Fayetteville.
Section 3: Regarding the transfer of the traffic signal at Wilkerson and Joyce, that the
Mayor and Recorder -Treasurer are hereby authorized and directed to take such further steps as are
necessary to maintain and operate such traffic signal so as to provide the same basic service as the
motoring public has enjoyed for the last couple of decades and to provide for safe crossings of
Wilkerson Street by pedestrians at that location.

MEMORANDUM OF UNDERSTANDING
The City of Johnson and the City of Fayetteville hereby enter into this
Memorandum of Understanding concerning the control, operation, ownership and
maintenance of the traffic signal located at the intersection of Joyce Avenue and
Wilkerson Street in Johnson, Arkansas.
The City of Fayetteville agrees to transfer its control, operation, ownership and
maintenance of this traffic signal at the intersection of Joyce and Wilkerson to the City of
Johnson under the following terms and conditions:
1. The City of Johnson will properly operate and maintain this traffic signal or
its authorized replacement so that it continues to operate efficiently and provide the same
basic service as the motoring public has enjoyed for the last couple of decades.
2. The City of Johnson may install traffic signal protected crosswalks to
encourage and assist pedestrian use of sidewalks and/or trails.
3. The City of Johnson may replace the existing traffic signal with a four way
signal of the same quality and capabilities if Joyce is extended to the West.
4. Reasonable vehicular access through this intersection to and from Joyce
Avenue toward the East shall be maintained.
In agreement with all the terms, conditions and duties listed above, the Mayors of
the City of Johnson and City of Fayetteville have properly signed below.
