Amendment No. 6 with Mitchell, Williams, Selig, Gates & Woodyard, for legal representation relating to the White River Water Quality Standards. The unique circumstances of performing the UAA on the White River has led to a very lengthy process up to this point. To get the agreement from ADEQ to stand with the City on this process, we were required to perform additional calculations as well as put the changes in the original process, out for public comment a second time. While this has presumably satisfied the ADEQ staff, the EPA is now questioning the methodology of ADEQ's statistical calculations in arriving at site specific minerals numbers that (1) has no detriment to the water quality and the aquatic life of the stream and, (2) established discharge permit numbers that the Noland WWTP can achieve without an expensive addition to the treatment process. There are still several tasks to be performed. Below is the list of items that still need to be done: • Team conference(s) to deal with comments by ADEQ and EPA • Prepare and file Statement of Basis and Responsiveness Summary (Response to Comments) with the APCEC • Prepare for and attend (defend) legislative review of the Third -Party Rulemaking by Joint Legislative Public Health and Welfare Committee and the Joint Legislative Rules and Regulations Committee • Prepare and File with APC&EC the Motion to Adopt Water Quality Standard Changes and the Draft Order adopting same • Prepare for and attend the APC&EC meeting seeking final adoption of the changes • Track submission and approval of the water quality changes to EPA Mauling Address: 113 W. Mountain Street www.fayetteville-ar.gov Fayetteville, AR 72701 City staff feels that they are presenting to the Council a final number for legal services Pertaining to this 3rd party rulemaking, although we are not sure at this point how the EPA is going to respond the City's lengthy efforts. However, the staff feels that there are signs of favorability coming from EPA that this rulemaking process will be completed in the near future. STAFF REQUESTS THIS BE FORWARDED TO THE CITY COUNCIL FOR APPROVAL b. Backflow Ordinance The City has revised the backflow ordinance to meet state regulations. The changes contained in the new Ordinance are highlighted in the attachment (handout). It has been reviewed and approved by the City Attorney. These changes will be discussed with the committee. Block Avenue — install approximately 110 feet of 8 -inch sewer main to serve three new homes that will be constructed as a result of demolition of the existing structure and a lot split. Sewer needs to be extended north on Block Avenue to meet the City's sewer service policy. The cost of the City's portion of the cost share is approximately $16,735. Recognition for the Safety Award On January 17, 2017, the Arkansas Department of Labor and Arkansas Workers' Compensation Commission recognized the CH2M Fayetteville team with the 10 -year Accumulative Years Safety Award. To achieve this milestone, the CH2M staff accumulated 10 years without a lost day away from work due to a work-related injury or illness. The attached memo describes in detail the prestigious achievement by the Fayetteville Project. STAFF REQUESTS THIS BE FORWARDED TO THE CITY COUNCIL FOR RECOGNITION b. Agreement for Accepting Wastewater from the SEFOR Decommisioning Project. The University of Arkansas is currently conducting Phase 2 of the decommisioning of the Southwest Experimental Fast Oxide Reactor facility. Specifically there is 2 accumulated groundwater in the facility basements that they are requesting to be pumped out and hauled to Fayetteville for Discharge into the public sewer system. This is similar to the agreement that was approved in 2011. The committee will be informed about the details of this project. Masters Lift Station Elimination Engineering Contract Hawkins Weir Engineers Inc. was selected in a formal engineering selection committee meeting on February 23, 2016, to provide the survey and design for a future construction project to eliminate the existing back yard lift station and force main by providing a future gravity sewer line from the lift station location in south Fayetteville. The proposed engineering contract with Hawkins -Weir Engineers Inc. is for the not to exceed amount of $71,820.00 and a ten percent engineering contract contingency of $7,182.00. BACKGROUND The University of Arkansas owns the facility known as the Southwest Experimental Fast Oxide Reactor (SEFOR) in Washington County. In 2011, City of Fayetteville accepted water that had accumulated in the basement rooms because of roof leaks during Phase 1, the Initial Site Preparations and Development of Decommissioning Plan. The University has replaced one of the roofs, but water has again accumulated in the basements. To move forward with Phase 2, Demolition of the Operations Support Building and the Reactor Support Facility, the University needs to remove and properly dispose of the water that has accumulated in the basements. This water contains minute amounts of metals and radioactive material, and must thus be disposed of within specific federal and state guidelines. There will also be a small amount of water from asbestos abatement that will be treated for disposal. A wastewater treatment facility is the optimum disposal method. DISCUSSION Under this agreement, the City will accept the water pumped out of the basement rooms of the University of Arkansas' SEFOR facility and the treated asbestos abatement water into our wastewater collection system. The water will be discharged by a hauler contracted by the University into the collection system via a manhole on University of Arkansas property on South Razorback Road. The discharge will be time phased to allow City wastewater treatment staff to track plant operations during the process. The wastewater has been tested by multiple laboratories, and meets all discharge requirements for being discharged into a wastewater system. The Arkansas Department of Health, who has primacy in Arkansas over radioactive materials, has approved the discharge of this water into our wastewater facilities (letter attached). BUDGET IMPACTS None. The University will be charged based on the volume of wastewater discharged. Mailing Address: 113 W. To achieve this milestone, the CH2M staff accumulated 10 years without a lost day away from work due to a work-related injury or illness between September 21, 2006 and September 21, 2016. Representatives from Senator Boozman's office, Senator Cotton's office and Congressman Womack's office were in attendance to read letters of congratulations as well. CH2M's adopted culture works towards eliminating all incidents every day based on individual commitments. This culture is achieved when their employees value the Heath, Safety & Environment program and take responsibility for their own behavior and for the behavior of every employee around them. When an incident does occur, they seek continual improvement by evaluating the causes, implementing corrective actions, and learning from their mistakes. Every employee must take responsibility and continually strive to achieve zero incidents which include (1) zero injuries and illnesses, (2) ensuring that they have an effective and comprehensive health and safety program in place, and (3) ensuring their staff feels that they have some ownership in their program. The Fayetteville Project has a safety committee, which consists of employees and management, to execute the safety plan. The safety team meets monthly to discuss safety concerns and updates at the project, and often organizes training opportunities and celebrations to keep safety fun. CH2M departments and staff meet each morning before any project or task is performed. The team completes the pre -task plan and an activity hazard analysis by discussing the work to be performed, ensuring hazards are identified, then discussing the controls involved to ensure a safe work performance can be provided. Because of their daily focus to provide a safe work environment, the CH2M Fayetteville team has won many awards to date. Congratulations to the CH2M Team for their outstanding commitment to Safety!
