WHEREAS, pursuant to the Fayetteville Code of Ordinances Section 39.10(C)(4), the City Council must
approve the payment of wastewater damage claims exceeding $8,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas, pursuant to Fayetteville Code of
Ordinances § 39.10(C)(4), authorizes the Mayor to pay $6,258.18 to Erin Kaiser for a wastewater
damage claim arising at 2232 North Briarwood Lane in addition to the previous payment of $14,557.62 to
Servpro for sewer damage mitigation services.

RECOMMENDATION:
City Staff recommends approving a claim settlement for sewage damage with Erin Kaiser in the
amount of $6,258.18 for damage to the home 2232 Briarwood Lane.
BACKGROUND:
At approximately 10:30 AM on Friday, October 28, 2016, there was a wastewater blockage
caused by a collapsed sewer main. This caused the sewer main to backup and surcharge into
the lower floor of the house. Four parties were affected by the damage. The owner contacted
the City. City Staff repaired the collapsed pipe, returning the sewer main -to normal flow.
DISCUSSION:
Ordinance 5504 -identifies the water and wastewater claims process. Normally in a situation
such as this, City Crews will contact a licensed, accredited restoration service company to clean
and disinfect the affected areas, and the Water and Sewer Division will be directly billed by the
restoration service contractor. Servpro has already been paid by the city for sewer damage
mitigation in the amount of $14,557.62. Repairs to the house are $10,673.18, less $5,000 paid
by Nationwide Insurance.
BUDGET/STAFF IMPACT:
Funds are available in the sewer maintenance self-insurance account.

The following has been prepared by the homeowner to the best of his ability to
estimate costs incurred by the incident. The homeowner has prepared the
following document in order to satisfy the City of Fayetteville, Arkansas'
wastewater damages claim process in full transparency and under the
supervision of legal council.
Description of Incident and Basis of Additional Claims Being Made:
On October 28, 2016 the City of Fayetteville, Arkansas' sewer line main near the
property of 2232 N Briarwood Ln had a full stoppage resulting in the discharge of
several hundred gallons of wastewater into the bottom floor of the residence at
2232 N Briarwood Ln. Four parties were affected by the damage incurred by this
incident:
1. Homeowner
2. Sublessee "X"
3. - Sublessee "Y"
4. Sublessee "Z"
Homeowner is claiming damages from:
1. Mitigation Repairs (See "Exhibit B", "Exhibit C" & "Exhibit D")
2. Personal Damages — Living Area
3. Personal Damages — Office
4. Personal Damages — Laundry Room
Servepro Industries Inc was contracted by the City of Fayetteville for category 3
wastewater mitigation for structural aspects of the residence. See "Exhibit A" for
full details of mitigation. Much of what is being claimed by homeowner and
Sublessee "X", "Y", and "Z" was removed and discarded by Servepro Industries
Inc in matter of hours. For reference, there were from 5-8 Servepro crew
removing wastewater, debris, personal items, and structural components from
most of the bottom floor of the residence. All the aforementioned items were
treated as category 3 wastewater contaminated materials and appropriately
discarded as such. Many personal items were documented others were not. Of
note, the homeowner was the only one home at the time of the occurrence and
many personal item losses (especially from Sublessee "X" and "Y") were
assessed after they had been removed during mitigation. The homeowner and
Servepro had to discard many items without the consent of the sublessee "X", "Y"
& «Z„
Sublessee "X" and Sublessee "Y" share a bedroom.
Sublessee "Z" resides in the adjacent bedroom
Homeowner is claiming damages from mitigation repairs:

Sublessee "X" and Sublessee "Y" had just returned from a 3 -week cross-country
trip at the time of the incident and because of that much of their gear was in the
floor of their room as opposed to higher shelving units. The room Sublessee "X"
and Sublessee "Y" shared also happened to be the low point in the bottom floor
and the received a fair amount more damage to their personal belongings than
the rest of the bottom floor including the homeowner and Sublessee "Z".

Our ordinance requires a homeowner to submit a claim under his or her homeowners
insurance policy regardless of fault. Once we have all of the documentation required to
consider the claim, the Utilities Director will make a determination about whether the City
approves the claim. If, after filing a claim with your insurance company, the insurance
company accepts and agrees to pay for the claim; we will pay the deductible so you aren't
out of pocket any money. If we approve the claim and your insurance company denies

Roommate X Janome Jem Platinum 760: This is a sewing machine. Reduce price
to $500
We originally thought it could be salvaged but at current it will not turn on.
Roommates "Y"'s damages: this is my fault for not photo documenting the
damages here. My phone had died at the time of my arrival at the house and I was
in crisis mode which maybe you can understand. Most of the waste water went
under his floorboards but his closet was pooled. 1 put everything in a trash bag and
sent it to the dump haphazardly. We salvaged roughly 80% of closet contents and
damages claimed are low estimates.
Mark, I also ask you to keep in mind the following:
• The downstairs is the living quarters of 3 people which had to accommodate
new living situations for 5 days while deconstruction and mitigation (drying
and dehumidification) was occurring. Roommate Z luckily had a girlfriend
to stay with and the X and Y were moved to my fiance's massage room.
Another way of saying this, was that there was no additional costs of hotels
while mitigation repair took place (5 days x $70 = $350 x 2 rooms = $700)
because we accommodated.
• The downstairs section of the house is where I and roommate X work out of.
I use my office for conf calls, and much of my computer work. These claims
do not account from work loss which could be factored. Roommate "X" is a
textile designer and uses her floor for pattern creation and keeps most of her
textiles. Some of which are just scraps and have no real value but she did
lose the majority of this as well. She too was without a work space for days.
• The amount of stress and tension due to our living situation and work
situation has been immense. Our house is destroyed, it was loud from the
blowers and dehumidifiers, and we had nowhere to go for peace or work
comfortably. Me and my roommates got into several skirmishes over nothing
just due to the stress. I literally became physically ill because of it. I could
not sleep and it destroyed my immune system. How do you account for this?-
Obviously
his?Obviously we did not, but the psychological damage was real. This is not a
basement. These are people's offices and living spaces. Huge life disruption
and we all work full time, for ourselves, with no form of business plan to
deal with -this type of work disruption.
Anyone at the house when this incident occurred could see a inches of flowing
water from our bathroom out of the house and into X and Y's bedroom. When 1
arrived to the house there was roughly 8" of standing water in the bedroom and
bathroom. The only reason more damage_ did not occur is because roommate X had
enough -sense to barricade the bathroom with dog beds and towels to slow the flow
into the two bedrooms -and force much of the water outside. ,If there would have
been couches and such in the common living area the city would be paying for it
because they would unsalvageable. Luckily, the common area, laundry, and office
was fairly unpopulated with artifacts so few damages had to be claimed.
Regarding the notion that much could be salvaged that we are claiming: I worked
in a biochemistry lab for 6 years and am very familiar with the type of pathogens in
sewage. I care very little about the lack of precautions the city's workers take when
working in these conditions. This is where 7 people live and I am not willing to
accept the "rinse it off and reuse" mentality for what is being claimed. We salvaged
MOST of what was soaked and these damages represent a very small portion of
what was compromised.
I have contacted legal representation and I am keeping them updated on the
progress of the claim. Depending on the progress we are prepared to file civil suit
for actual damages, lost wages, emotional distress and/or punitive damages. I do
not want to do this because it would distance my settlement date but would if
necessary. This has been a giant disruption to my life and continues to interfere
with my daily living. What you have asked for thus far is reasonable and I have
complied but I am not willing to drag this settlement out for such minor claims. I
simply do not have the time. I want to get my house back in order and improve my
current living situation. Nothing more. Nothing less. You are dealing with a moral
person and the claims are not unreasonable in the least.
If you need additional requests please do not hesitate to ask. I appreciate the way
you personally, the city, and Servepro have handled this situation thus far and want
to get this done as timely and as stress free as possible, as I am sure you do too.
