competitive bidding and authorize the purchase of a leak detection system pilot program
from Mueller Systems, LLC in the amount of$26,985.00.

grant the appeal of Tim Briseiel of Legacy Ventures and to approve large scale
development 16-5488 Macey Drive Townhomes.
THIS RESOLUTION WAS TABLED TO THE NOVEMBER 1, 2016 CITY
COUNCIL MEETING.
7. AMEND § 157.03 AND § 157.04: An ordinance to amend § 157.03 annexation and
zoning map amendments to include planned zoning districts and to replace § 157.04 with
a new notification requirement if an indefinitely tabled rezoning ordinance is removed from
the table.

NOTICE TO MEMBERS OF THE AUDIENCE
All interested persons may address the City Council on agenda items of New and Old Business. Please wait for
the Mayor to request public comment and then come to the podium, give your name, address, and comments
about the agenda item. Please address only the Mayor. Questions are usually answered by the Mayor, Aldermen
or Staff after the public comment period is over. Please keep your comments brief and respectful. Each person is
only allowed one turn at the microphone for discussion of an agenda item.
All cell phones must be silenced and may not be used within the City Council Chambers.
Below is a portion of the Rules of Order and Procedure of the Fayetteville City Council pertaining to City
Council meetings:
Agenda additions: A new item which is requested to be added to the agenda at a City Council meeting should
only be considered if it requires immediate City Council consideration and if the normal agenda setting process
is not practical. The City Council may only place such new item on the City Council meeting's agenda by
suspending the rules by two-thirds vote. Such agenda addition shall be heard prior to the Consent Agenda.
Consent Agenda: Consent Agenda items shall be read by the Mayor and voted upon as a group without
discussion by the City Council. If an Alderman wishes to comment upon or discuss a Consent Agenda item, that
item shall be removed and considered immediately after the Consent Agenda has been voted upon.

Old business and new business.
Presentations by staff and applicants. Agenda items shall be introduced by the Mayor and, if an ordinance, read
by the City Attorney. City staff shall then present a report. An agenda applicant (city contractor, rezoning or
development applicant, etc.) may present its proposal only during this presentation period, but may be recalled
by an alderman later to answer questions. Staff and applicants may use electronic visual aids in a City Council
meeting as part of their presentation.
Public comments. Public comment shall be allowed for all members of the audience on all items of old and new
business and subjects of public hearings. No electronic visual aid presentations shall be allowed, but the public
may submit photos, petitions, etc. to be distributed to the City Council. If a member of the public wishes for the
City Clerk to distribute materials to the City Council before its meeting, such materials should be supplied to the
City Clerk office no later than 9:00 a.m. on the day of the City Council meeting. Any member of the public shall
first state his or her name and address, followed by a concise statement of the person's position on the question
under discussion. Repetitive comments should be avoided; this applies to comments made previously either to
the City Council or to the Planning Commission when those Planning Commission minutes have been provided
to the Aldermen. All remarks shall be addressed to the Mayor or the City Council as a whole and not to any
particular member of the City Council. No person other than the Aldermen and the person having the floor shall
be permitted to enter into any discussions without permission of the Mayor. No questions shall be directed to an
Alderman or city staff member except through the Mayor.
Courtesy and respect.
All members of the public, all city staff and elected officials shall accord the utmost courtesy and respect to each
other at all times. All shall refrain from rude or derogatory remarks, reflections as to integrity, abusive
comments and statements about motives or personalities. Any member of the public who violates these
standards shall be ruled out of order by the Mayor,must immediately cease speaking and shall leave the podium.
Interpreters or TDD for hearing impaired are available for all City Council meetings, a 72 hour advance notice is

RECOMMENDATION:
The County Judges proposal to apportion cost by population as determined by decennial census
seem reasonable and the administration recommends the Council authorize the Mayor to sign
the `2017 Calendar Year Proportional Share Agreement' committing the City to pay $82,294.99
for this program and forward that agreement to the Department of Finance and Administration as
well as the Washington County Judges Office.
BACKGROUND:
Beginning 2017 the State District Judges Program will be implemented. In Washington County
there will be 4 judgeships with the base salary of$58,650 per judge which totals$234,600 in base
salary costs. Arkansas Code Chapter 16 Section Seventeen mandates that each county, town,
or city within the district pay its proportionate share of one half of the salary costs of the judges.
The County Judge proposes the proportionate amounts be determined by population using the
latest decennial census. However, the total number of Springdale residents should be added to
the base district population which includes those living in Benton County.
BUDGET/STAFF IMPACT:
This amount will be appropriated in the 2017 budget.

Dear Mayor Jordan:
I would like to welcome you to the State District Judges Program beginning January 1, 2017.
Under Ark. Code Ann. § 16-17-1106, each county, town or city located in a State district court judgeship shall
pay to the State an amount equal to its proportionate share of one half(1/2) of the base salary established by law
for FY2009. The base salary for FY2009 was $117,300. Half of that amount is $58,650, with the remainder to
be paid by the State. The purpose of this letter is to certify the proportionate share of$58,650 per judge to be
paid by the county and the cities and towns in your State district court judgeship(s).
Under the code, the amount to be paid by each county and town or city can be established by written agreement.
The Proportionate Share Agreement is included with this letter to establish an agreement as to your
proportionate share of the salary paid among the county, cities and towns in your State district court judgeship.
Please sign and return the Proportionate Share Agreement to this office at the address listed above by
October 31, 2016. If you are unable to reach an agreement, please contact this office. The Department of
Finance and Administration—Administration of Justice Fund Section will certify proportionate share amounts
according to the terms of Ark. Code Ann. § 16-17-1106.

WHEREAS; Act 1219 of 2011 states that the State of Arkansas shall pay the salary and benefits of state
district courtjudges;Act 663 further provides that each county and town or city that has a state district
court judgeship created shall pay to the state an amount equal to its proportionate share of one-half
(%) of the base salary established by law for that county and town or city's state district court judge;
and
WHEREAS; Act 1219 of 2011 established a base salary of$117,300 in 2011 for a state district court judge;
and
WHEREAS; Act 1219 of 2011 provides that a county and town or city that has a state district court
judgeship created may agree in writing on the amount to be paid to the state by the county and town
or city for its proportionate share of one-half(%) of the salary established by law for its state district
court judge;
THEREFORE; an agreement has been reached between the Washington County and the cities of Elkins,
Elm Springs, Farmington, Fayetteville, Greenland, Johnson, Lincoln, Prairie Grove,
Springdale and West Fork to pay to the state one-half(%) of the state district court judge's salary
of$58,650 per judge totaling to $234,600 as follows:

Good Morning Mayors,
County Judge Marilyn Edwards asked that I contact you regarding the county/city obligation regarding its
share of the State District Court Judge's beginning January 1, 2017.
Under Ark. Code. Ann. § 16-17-1106, each county, town or city located in a State district court judgeship shall
pay to the State an amount equal to its proportionate share of one half (1/2) of the base salary. You should
have received a letter from the Department of Finance and Administration about this. I have attached our
copy for reference.
Judge Edwards is suggesting that that the County and cities divide our obligation based on population using
the latest decennial census data. I have attached a document prepared by County Comptroller Ashley Farber
showing the financial impact on each of us using this method.
We are all being requested to reach and sign an agreement regarding this matter and have it to DFA no later
than October 31.

Judge Edwards would like to hear from each of you as soon as possible regarding this matter. I know we are
all in the budget process for 2017. 1 wish we had more time to discuss this but this is the hand that we have
been dealt.
