BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a two-month
extension of Amendment No. 7 to the contract with CH2M Hill Engineers, Inc. beginning January 1, 2017
and ending February 28, 2017 at a cost of $656,019.58 per month for operations, maintenance and
management services.

SUBJECT: Approval of a Two Month Contract Extension to Amendment No. 7 with CH2M
Hill Engineers, Inc. beginning January 1, 2017 and ending February 28, 2017
with a monthly cost of $656,019.58.
RECOMMENDATION:
City Administration recommends approval of a Contract extension to Amendment No. 7 with
CH2M Hill Engineers, Inc., beginning January 1, 2017 and ending February 28, 2017.
BACKGROUND:
CH2M has been under contract since 1987 to provide the City wastewater treatment services.
Contract amendment No. 7 was implemented in January 2016, the second year of the first 5 -
year extension of the overall contract beginning January 1, 2015.
DISCUSSION:
The approval to Amendment No. 8 is still under review, and it was not possible to have this
review completed by the beginning of 2017. It is anticipated that the 2017 contract will be
introduced to the City Council at the February 7 meeting.
BUDGET/STAFF IMPACT:
Budgeted 2017 funds are available within the wastewater treatment plant operations budget.

Subject: Letter to confirm temporary continuation and uninterrupted services by CH2M for the City of
Fayetteville at the 2016 rate as outlined in Amendment 7 of the contract.
Dear Tim,
At your request, this letter is to inform the City of the following with respect to the delayed approval of
Amendment 8 of our O&M Services contract with the City of Fayetteville:
CH2M has been notified that our submitted Amendment 8 for the year beginning 2017 is still under
review by the City. Circumstances are such that it will not be possible for this review to be completed
within a time frame to allow submission to and subsequent approval at the next City Council Meeting on
December 20, 2016.
This letter is to inform the City that CH2M will continue to provide the contracted services to the City at
the 2016 Amendment 7 rate on a temporary basis as requested, for a maximum of 60 days. This
temporary continuation at the old rate is based on the expectation that this matter will be resolved as
quickly as possible and that once resolved, the new Amendment 8 rate will be applied/reimbursed retro-
actively to the beginning of the new contract year of 2017. In the meantime, CH2M will continue to
invoice the City at the rate and stipulations outlined in Appendix D of Amendment 7 to the contract.
