Adjournment City of Fayetteville, Arkansas Page 2 Printed on 113112017 City Council Special Meeting Meeting Agenda - Final Agenda January 31, 2017 NOTICE TO MEMBERS OF THE AUDIENCE All interested persons may appear and address the City Council on Unfinished Business, New Business, and Public Hearings at City Council meetings. If you wish to address the City Council on an agenda item, please wait for the Mayor or Chair to request public comment then queue behind the podium. When the Mayor or Chair recognizes you, approach the podium and give your name and address. Comments are to be addressed to the Mayor or Chair. The Mayor or Chair will direct your comments to the appropriate elected officials, staff, or others for response. Keep your comments respectful, brief, to the point, and relevant to the agenda item being considered. Each speaker from the public will be allowed one turn at the microphone for discussion of an agenda item. Agenda Additions: A new item which is requested to be added to the agenda at a City Council meeting should only be considered if it requires immediate City Council consideration and if the normal agenda setting process is not practical. The City Council may only place such new item on the City Council meeting's agenda by suspending the rules by two-thirds vote. Such agenda addition shall be heard prior to the Consent Agenda. Consent Agenda: Consent Agenda items shall be read by the Mayor and voted upon as a group without discussion by the City Council. If an Alderman wishes to comment upon or discuss a Consent Agenda item, that item shall be removed and considered immediately after the Consent Agenda has been voted upon. Old Business and New Business: Presentations by Staff and Applicants: Agenda items shall be introduced by the Mayor and, if an ordinance, read by the City Attorney. City staff shall then present a report. An agenda applicant (city contractor, rezoning or development applicant, etc.) may present its proposal only during this presentation period, but may be recalled by an alderman later to answer questions. City staff, City Council members, and applicants may use electronic visual aids in the City Council meeting as part of the presentation of the agenda item. Public Comments: Public comment shall be allowed for all members of the audience on all items of old and new business and subjects of public hearings. A simple majority of the City Council members, present and voting, may authorize a representative of a Fayetteville citizens' group opposing the ordinance or resolution to present an electronic visual aid not to exceed five minutes, but no other electronic visual aid presentations will be allowed; however, the public may submit photos, petitions, etc. to be distributed to the City Council. If a member of the public wishes for the City Clerk to distribute materials to the City Council before its meeting, such materials should be supplied to the City Clerk's Office no later than 9:00 A.M. on the day of the City Council meeting. Any member of the public shall first state his or her name and address, followed by a concise statement of the person's position on the question under discussion. Repetitive comments should be avoided; this applies to comments made previously either to the City Council or to the Planning Commission when those Planning Commission minutes have been provided to the Aldermen. All remarks shall be addressed to the Mayor or the City Council as a whole and not to any particular member of the City Council. No person other than the Aldermen and the person having the floor shall be permitted to enter into any discussions without permission of the Mayor. No questions shall be directed to an Alderman or city staff member except through the Mayor. All shall refrain from rude or derogatory remarks, reflections as to integrity, abusive comments and statements about motives or personalities. Any member of the public who violates these standards shall be ruled out of order by the Mayor, must immediately cease speaking and shall leave the podium. Interpreters or Telecommunications Devise for the Deaf (TDD), for hearing impaired are available for all City Council meetings, a 72 -hour advance notice is required. City of Fayetteville, Arkansas Page 4 Printed on 113112017 City of Fayetteville, Arkansas 113 West Mountain Street Fayetteville, AR 72701 (479) 575-8323 Text File File Number: 2017-0060 Agenda Date: 1/31/2017 Version: 1 Status: Agenda Ready In Control: City Council Special Meeting File Type: Resolution Agenda Number: A. 1 SEVEN HILLS HOMELESS CENTER EMERGENCY FUNDING: AN ORDINANCE TO WAIVE COMPETITIVE BIDDING, TO APPROVE AN EMERGENCY TWO MONTH PURCHASE OF SERVICES CONTRACT WITH SEVEN HILLS HOMELESS CENTER WITH POSSIBLE EXTENSIONS OF UP TO FOUR ADDITIONAL MONTHS AND TO APPROVE A BUDGET ADJUSTMENT WHEREAS, the Board of Directors of Seven Hills has operated a day time facility to serve numerous homeless and needy Fayetteville residents for over 15 years relying upon the support of several local churches, charities and charitable persons, as well as some governmental support (for veterans, etc.); and WHEREAS, through generous contributions by the Walker Family and others, Seven Hills was able to construct and operate the Walker Family Residential Community complex for transitional housing for homeless residents of Fayetteville on leased City property south of Huntsville Road for many years; and WHEREAS, Seven Hills is currently suffering an operating income emergency and is in dire need of temporary assistance from the City of Fayetteville to be able to weather the storm and continue to offer vital services to Fayetteville's homeless residents during winter; and WHEREAS, if Seven Hills could no longer operate its Walker Family Residential Community transitional housing facility, currently housed citizens might become homeless again and have to live on the streets or in the woods during these harsh winter months; and WHEREAS, if Seven Hills could no longer operate its day time facility, the large number of homeless residents who depend upon this facility for showers and washing, hot food, a warm place to stay during the day, as well as access to a telephone and other job assistance services could not find such comparable services elsewhere; and WHEREAS, the facilities and services provided by Seven Hills need to be continued and should be temporarily supported by the City taxpayers to prevent our homeless and needy residents from suffering undue hardship and deprivation during these winter months. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. ARKANSAS MEETING OF JANUARY 31, 2017 SPECIAL CITY COUNCIL MEETING TO: Mayor Jordan, Mayor and Members of the City Council THRU: Don Marr, Chief of Staff FROM: Paul A Becker, Chief Financial Officer DATE: January 30, 2017 SUBJECT: Emergency Funding for Seven Hills Homeless Center RECOMMENDATION: To approve a 2 months funding agreement with Seven Hills Homeless Center with the option to renew up to an additional four months' contingent on satisfactory contractual performance. BACKGROUND: The Seven Hills Homeless Center has provided services to homeless and needy residents in Fayetteville for over 15 years. Seven Hills is a non for profit organization that has relied almost exclusively on private donations for operational funding during that period. The City Administration was notified last week that without some type of immediate financial support the Homeless Shelter would be forced to shut down operations as needed donations were short of necessary operating costs. Since this would cause immediate suffering and undue hardships on the homeless and needy residents during the current winter months, the Mayor is recommending the City Council approve temporary emergency funding in the amount of $25,000 per month be used to supplement current donations committed on a monthly basis by the Shelter's current generous donors. This would keep the Shelter in operation on a temporary basis until a sufficient funding base or alternate provider is secured. If necessary, this could be renewed for up to an additional 2 periods of 2 months based on compliance with the terms of the attached contract. BUDGET/Staff Impact: This contract would be funded by the attached budget amendment. Which requests an appropriation from fund balance in the maximum amount of $150,000. Mauling Address: 113 W. Mountain Street www.fayetteville-ar.gov Fayetteville, AR 72701 CONTRACT THIS CONTRACT is made by and between the City of Fayetteville, Arkansas (hereinafter "City") and Seven Hills Homeless Center, which is an Arkansas nonprofit corporation which filed its corporate documents with the Secretary of State in 2001 (hereinafter "Seven Hills") on this day of January, 2017. NOW, THEREFORE, The City of Fayetteville and the Board of Directors of Seven Hill Homeless Center agree as follows: 1. The term of this contract shall be February 1, 2017 until March 31, 2017, for a total of two (2) months unless ended earlier by the City for failure of Seven Hills to comply with all provisions and requirements of this contract. Mayor Jordan may extend the term of this contract pursuant to Paragraph 7. 2. Seven Hills Homeless Center agrees to and shall provide all necessary personnel, supplies, utilities and maintenance of its facility to serve all Fayetteville's needy homeless residents who are utilizing and will continue to need to utilize the day time facility. Seven Hills agrees to continue to offer all programs and services which Seven Hills has been normally supplying in the past in its day time facility. 3. Seven Hills Homeless Center further agrees to and shall provide all necessary personnel, supplies, utilities and maintenance of the Walker Family Residential Community transitional facility to serve the transitional housing occupants. Seven Hills is authorized to use some of the City revenue for these purposes where appropriately authorized by the earlier agreement between the City and Seven Hills. Seven Hills agrees to continue to offer all programs and services to these Fayetteville transitional housing tenants as it has normally been providing in the past. 4. Seven Hills Homeless Center further agrees to make diligent efforts to regain its financial footing by increasing its revenues and/or reducing its expenses so that at the end of this two month emergency assistance by the taxpayers of Fayetteville, Seven Hills Homeless Center can once again pay all of its own bills and will not need further financial support from the City of Fayetteville. 5. Seven Hills Homeless Center further agrees to make a report to the Fayetteville City Council at its Agenda Session on March 14th, 2017 to report on Seven Hills' operational activities, fundraising and expense reductions. Seven Hills also agrees to present any other report as requested by the Mayor or City Council during this two month period. 6. The City of Fayetteville agrees to pay the sum of TWENTY FIVE THOUSAND DOLLARS ($25,000.00) after the effective date of the ordinance which approves this contract and on the first Wednesday of March and every other month while this contract is effective (if renewed pursuant to paragraph 7.) as long as the Finance Director and the City Administration are satisfied that Seven Hills is satisfactorily complying with all terms and conditions of this contract. 7. Renewal possible. On or before April 1, 2017, the Mayor and Seven Hills may jointly renew this contract for an additional two months if Seven Hills has complied with all terms of the contract and has made progress in becoming self-sufficient again, but still needs temporary assistance from the City's taxpayers. Prior to this renewed contract's anticipated ending date on May 30, 2017, Seven Hills and the Mayor may further extend this contract for an additional two (2) month term unless the City Council has passed a resolution opposing such final term of this contract.
