FAYETTEVILLE NOT TO EXCEED $103,665.15, AND TO APPROVE A PROJECT CONTINGENCY
IN THE AMOUNT OF $20,733.03.
WHEREAS, Mark Zweig, Inc. will be developing property located at 218 North Church Avenue, a project
which has been approved by the City's Planning Division; and
WHEREAS, during the course of design review by the City of Fayetteville, Mark Zweig, Inc. was made
aware of an existing water volume fire flow issue with the current water piping; and
WHEREAS, increasing -the size of this approximately-625--foot-segment from a 4=inch mainto an 8=inch
main will alleviate the current water volume deficiency, allow the development to connect and also allow
for a secondary water loop to help prevent the possibility of residents losing water service in the event of
a water leak in the area; and
WHEREAS, the City of Fayetteville would benefit from the cost share as it will replace and upgrade
aged infrastructure in the core of the city, providing improved service and fire protection for residents and
business in the area, and will facilitate future development; and
WHEREAS, § 5 1. 112 of the Fayetteville City Code provides that "the City shall pay the excess material
cost of facilities of a size that is larger than required to serve subdivisions when such excess size is
specified and required by the water and wastewater director for the general benefit of the water system";
and

WHEREAS, waiving formal competitive bidding will save time and cost by utilizing the developer's
contractor who will be on-site installing the larger line for the developer's project.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby determines an
exceptional situation exists in which competitive bidding is deemed not feasible or practical and
therefore waives the requirements of formal competitive bidding and approves a cost share agreement with
Mark Zweig, Inc. for a water main upgrade along North Church Avenue between West Spring Street and
West Dickson Street with the estimated amount to be paid by the City of Fayetteville not to exceed
$103,665.15, and further approves a project contingency in the amount of $20,733.03.

Below, is a list of 9 properties that would benefit from a new water main running along Church Ave. The Collier lots and the
empty Three Ten lot in particular have had development requests recently but have fallen through due to downtown
development costs, one of which was this Water Line Extension. Mark Zweig Inc.'s 150' of frontage along the extension
should not bear the full burden of the costs, in turn, we propose MZ Inc. pay the proportional cost of 218 N. Church's (and
the associated empty lot) property length. With the added emphasis from the City Council along with the infrastructure
fund specifically set aside to cost share on downtown infill this makes a fair assessment of the responsibility. In addition,
the lack of a fire hydrant along the block cause safety concerns. Most of these concerns relate to the compact timber frame
apartments with no fire suppression system along the street. They would be alleviated with the installation of the fire
hydrant associated with this upgrade.

RECOMMENDATION:
Staff recommends approval of a cost -share agreement between the City of Fayetteville and
Mark Zweig, Inc., to share the costs of upgrading a waterline on N. Church Ave. between W.
Spring St. and W. Dickson St. The estimated total cost of the project is $135,510.00. The City's
portion of the cost share is 76.5% of the estimated project cost, in the not -to -exceed amount of
$103,665.15, with a not -to -exceed contingency fund of $20,773.03.
BACKGROUND:
Mark Zweig, Inc. has requested that the City share in the cost of upgrading a 4 -inch waterline to
8 -inch along a portion of N. Church Ave. between W. Spring St. and W. Dickson St., a distance
of approximately 625 feet, so that Mark Zweig, Inc. may develop the property located at 218 N.
Church Ave.
DISCUSSION:
Upgrading this waterline will allow development of this property and will also provide for ample
future capacity which the City recognizes will be necessary for the area that is served by this
waterline. There are 9 other properties mentioned in Exhibit "B" that will also benefit from the
waterline upgrade. Exhibit "A" shows a map of the area and the waterline to be upgraded.
BUDGET/STAFF IMPACT:
Funds for the City portion of work are available in the Water Impact Fee Cost Sharing Project.
The final actual cost to the City will be based upon actual bid price for this project.

CONTRACTUAL AGREEMENT FOR
COST SHARE OF WATER MAIN UPGRADE COSTS
This Agreement, made and entered into on this 3 midday of January, 2017, by and between
the City of Fayetteville, Arkansas ("City") and Mark Zweig, Inc., witnesseth:
WHEREAS, Mark Zweig, Inc. received approval by the City's Planning Department on
November 21, 2016, for a renovation project in the 200 block of Church Avenue; and
WHEREAS, during the course of design review by the City of Fayetteville, Mark Zweig,
Inc. was made aware of an existing water volume fire flow issue with the existing water piping;
and
WHEREAS, increasing the size of this approximately 625 -foot segment from a 4 -inch
main to an 8 -inch main will alleviate the current water volume deficiency, allow the development
to connect and also allow for a secondary water loop to help prevent the possibility of residents
losing water service in the event of a water leak in the area; and
WHEREAS, the City of Fayetteville would benefit from the cost share as it will replace
and upgrade aged infrastructure in the core of the city, providing improved service and fire
protection for residents and business in the area, and will facilitate future development; and
WHEREAS, the Fayetteville City Plan 2030, adopted in 2011 as the City's comprehensive
land use plan, lists infill development as one of its top two goals.; and
WHEREAS, § 51.112 of the Fayetteville City Code provides that "the City shall pay the
excess material cost of facilities of a size that is larger than required to serve subdivisions when
such excess size is specified and required by the water and wastewater director for the general
benefit of the water system."
NOW, THEREFORE, the City of Fayetteville, Arkansas and Mark Zweig, Inc. agree as
follows:
1. The City of Fayetteville, Arkansas agrees to:
A. Reimburse Mark Zweig, Inc. for 76.5% of the cost to upgrade approximately
625 linear feet of 4 -inch water main in the area identified in Exhibit "A" to 8 -
inch main up to a maximum -not -to -exceed amount of $103,665.15 as was
estimated by the builder's representative and shown on Exhibit `B", attached.
The 76.5% cost represents the excess materials and labor cost required to fully
upgrade the water line, as well as sharing in the cost of Mark Zweig, Inc.'s
portion of the project.
B. Payments due to Mark Zweig, Inc. shall be remitted within sixty (60) days after
receipt of valid invoices.
2. Mark Zweig, Inc. agrees to:
A. Provide the necessary and normal project management, inspection, and testing
as necessary for a complete and acceptable water main installation, including
submittal of plans and specifications to the City's Engineering Department, per
their standard procedures.
B. Provide a copy of the invoices from the Contractor upon City approval of the
water main upgrade.
C. Pay for the water main installation (with reimbursement of 76.5% of the cost
by the City of Fayetteville in a not -to -exceed amount of $103,665.15 with a
contingency fund not -to -exceed $20,773.03).
3. It is further understood that the contract for construction of the water main upgrade is
between Mark Zweig, Inc. and its Contractor and that the City has no contractual
obligation with either the Contractor or the Engineer. The City's only obligation shall
be to participate in this agreement with a not -to -exceed reimbursable amount of
$103,665.15 for the water main upgrade, with a contingency fund not -to -exceed
$20,733.03.
