WHEREAS, Hogwash Carwash, LLC has requested that the City construct and share in the cost of constructing an 8 -inch sewer main along a portion of East Huntsville Road between South Erika Avenue and South Seven Hills Drive, a distance of approximately 100 feet, so Hogwash may develop property located on East Huntsville Road; and WHEREAS, construction of the sewer main will provide sewer service to an infill project which is increasing the population density in this area, and will also allow for ample future capacity which the City recognizes will be necessary for the area that is served by this sewer main; and WHEREAS, § 51.113 of the Fayetteville City Code provides that "the City shall pay the excess material cost of facilities of a size larger than required to serve subdivisions when such excess size is specified and required by the Water and Wastewater Director for the general benefit of the sewerage system." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a cost share agreement with Hogwash Carwash, LLC for construction of a sewer main along a portion of East Huntsville Road between South Erika Avenue and South Seven Hills Drive, with the total estimated project cost of $8,232.00 to be shared equally between the City and Hogwash Carwash, LLC. BACKGROUND: Hogwash Carwash has requested that the City construct -and share in the cost of constructing an 8 -inch sewer main along a portion of East Huntsville Road between South Erika Avenue and South Seven Hills Drive, a distance of approximately 100 feet, so that Carwash may develop the property located on 1096 East Huntsville Road and 1116 East Huntsville Road. DISCUSSION: Constructing this segment of 8 -inch main will allow development of these properties and will also provide for ample future capacity which the City recognizes will be necessary for the area that is served by this sewer main. BUDGET/STAFF IMPACT: The Water & Sewer Division will be able to provide the labor and equipment needed without impeding upon the overall mission of the Utilities Department. Bear any costs associated with the sewer main installation that exceed the amount Carwash agrees to pay below. 2. Hogwash Carwash, LLC agrees to: A. Reimburse the City for one-half of the cost of the sewer main installation up to a maximum -not -to -exceed amount of $4,116.00 which represents one-half of the project cost estimated by the City of Fayetteville. B. Deposit the funds in the amount of $4,116.00 with the City of Fayetteville prior to City Council consideration of the agreement.
