Section 1: That the City Council of the City of Fayetteville, Arkansas hereby ordains that the portion of the
Springwoods Commercial Planned Zoning District as shown on the map (Exhibit A) and the legal
description (Exhibit B) both attached to the Planning Department's Agenda Memo is amended to allow
single family dwellings on Tracts 2, 3 and 4 of Lot 2 and to add the requirements included in Exhibit C to

is to amend the SPRINGWOODS C-PZD, COMMERCIAL PLANNED
ZONING DISTRICT to allow single family dwellings as a use by right on the
subject property.
RECOMMENDATION:
The City Planning staff and Planning Commission recommend approval of an ordinance to amend
the Springwoods C-PZD for Tracts 2, 3, and 4 of Lot 2 to allow single-family dwellings and add
the requirements included in the attachments as an addition to those uses currently permitted.
The proposed amendments are depicted in Exhibits 'A', 'B', and 'C' (attached).
BACKGROUND:
The Springwoods Commercial Planned Zoning District contains approximately 289 acres and is
roughly bordered by Deane Solomon Road to the west, Truckers Drive to the north, Foxglove and
Shiloh Drives to the east and Moore Lane to the south. In 2003 the City Council rezoned the
property to C-PZD 03-08.00. A total of 165 acres of the property was proposed to be developed
in mixed -use residential and commercial uses, with the remaining 124 acres to be set aside
permanently for greenspace.
Since 2003 the development in the C-PZD has been largely residential in nature, with two large
lot, single-family subdivisions and one multi -family subdivision being developed along Deane
Solomon Road. Commercial development has been limited to a car dealership and surgery center
along Shiloh Drive, and two mental and behavioral health facilities on Truckers Drive.
The properties that are the subject of this amendment are currently undeveloped and represent
approximately half of Lot 2 of the Springwoods C-PZD. The remainder of Lot 2, with street frontage
on Deane Solomon Road, is a mixed subdivision of 2- and 4-family dwelling units. As approved
in 2003, the only permitted uses for Lot 2 are Multi -family Dwellings and Dance Halls (Use Units
26 and 29 respectively).

Request: The request is to amend the current Springwoods Commercial Planned Zoning District
requirements for Tracts 2, 3, and 4 of Lot 2 to allow Single-family Dwellings and add the
requirements included in the attachments as an addition to those uses currently permitted.
Public Comment.- Staff has received no public comment.
DISCUSSION:
The proposal for single-family and multi -family use on this property can be compatible with the
surrounding mix of multi -family, greenbelt, and non-residential use. It is also consistent with the
City Plan 2030 designation as a City Neighborhood Area. The proposed lot width and area
minimums create the potential for a diversity of detached housing types that can potentially
relate to both the medium -density housing to the west and the commercial land to the east.
Compatibility is not defined as identical adjacent land uses, but rather in terms of whether the
uses can exist in harmony. Given the setting of Springwoods that has a variety of uses in close
proximity staff feels the proposal can be compatible and recommends in favor.
On August 22, 2016 the Planning Commission forwarded the applicant's request to amend the
Springwoods C-PZD with a recommendation for approval. A motion by Commissioner Selby to
forward the proposal to the City Council with a recommendation for approval was made with a
vote of 8-0-0.

Approval Schedule:
• On October 2111, 2003 the City Council approved C-PZD 03-8.00 (Springwoods). The
approval granted zoning and land use approval for development of 289 acres of residential
dwellings, commercial buildings, and greenspace.
• On December 01, 2005 the Subdivision Committee approved the final plat for the Prairie
View subdivision for 36 single-family dwellings (FPL 05-1831).
• On June 15, 2006 the Subdivision Committee approved the final plat for the Meadow View
commercial subdivision with 22 development lots proposed
• On August 14, 2006 the Planning Commission approved the Creek Meadow subdivision
for 47 single-family dwellings (FPL 06-2154).
• On October 24, 2011 the Planning Commission approved Phase I of the Pines at
Springwoods multi -family subdivision to include seven quadplexes and two duplexes.
Request: The request is to amend the current Springwoods Commercial Planned Zoning District
requirements for Tracts 2, 3, and 4 of Lot 2 to allow Single-family Dwellings and add the
requirements included in the attachments as an addition to those uses currently permitted.
Public Comment: Staff has received no public comment.
FINDINGS:
Staff finds that the proposal to utilize this portion of the site for single family dwellings in a
suburban pattern is somewhat inconsistent with City Plan 2030 and the Springwoods C-PZD
master plan. City Plan 2030 designates this area as City Neighborhood Area which lends itself
to a more intense and dense development pattern than proposed. The C-PZD zoning on
undeveloped lots to the east of this site is for commercial and office use. The intent of
Springwoods was to have multi -family residential use directly adjacent to commercial providing
a transition to single family neighborhoods further to the west and north.
Despite this apparent contradiction, the proposal for single family use on this property can be
compatible with the surrounding mix of multi -family, greenbelt, and non-residential use. The
proposed lot width and area minimums create the potential for a diversity of detached housing
types that can potentially relate to both the medium -density housing to the west and the
commercial land to the east. Compatibility is not defined as identical adjacent land uses, but
rather in terms of whether the uses can exist in harmony. Given the setting of Springwoods that
has a variety of uses in close proximity staff feels the proposal can be compatible and
recommends in favor.
RECOMMENDATION: Staff recommends forwarding ADM 16-5538 to City Council with a
recommendation for approval with the following conditions:

1. All conditions of approval from the previously approved C-PZD 03-08.00 Springwoods
shall apply;
2. Approval of this C-PZD modification does not grant approval of the development details
for the project. The proposed housing will be required to be reviewed for compliance with
all Unified Development Code requirements as part of the standard development review
process; and
3. The attached zoning requirements will be in addition to all previous zoning regulations on
the subject property.
