approximately 14.20 acres. The request is to rezone the property to P-1,
INSTITUTIONAL.
RECOMMENDATION:
The City Planning staff recommend approval of an ordinance to rezone the subject City -owned
property to P-1, Institutional, as requested by the applicant and as shown in the attached Exhibits
'A' and 'B'.
BACKGROUND:
The subject property includes approximately 14.20 acres at the east end of East Borick Drive.
The property is largely clear, but with significant amounts of vegetation along its property lines.
Although annexed in to the City along with several hundred acres to the north and west in 1971,
this property has remained undeveloped. The zoning on the property is split along a north -south
axis, with about a third of the western portion zoned 1-2, General Industrial, and the remainder
zoned R-A, Residential Agriculture.
Request: The property is owned by the City of Fayetteville and the request is to rezone the subject
property from 1-2, General Industrial and R-A, Residential to P-1, Institutional. The Fire
Department has received a grant and intends to construct a firefighter training facility on the site.
Land Use Compatibility: The uses allowed by right under the P-1 zoning district are generally
compatible with all neighboring land uses. Most government facilities do not have significant
impacts on adjacent properties, and those that do would be appropriate for the subject property,
particularly given its peripheral location within the City. The only potential conflict in land uses is
with the public parkland to the north and east.
As it currently stands however, Combs Park is minimally developed. Although the 2002 Parks and
Recreation 10 Year Master Plan recommends the park's use for a large model airplane landing
strip and a possible greenway trail along the White River, neither has come to fruition.
Furthermore, 72 acres of Combs park, including the portion that is adjacent to the subject

property, has been identified as an area to be maintained at a lower service level. That said, the
proposed rezoning will likely have little to no effect on activities in Combs Park.
Land Use Plan Analysis: City Plan 2030 designates the subject property as Industrial Area.
Although the proposed rezoning does not facilitate industrial development, a P-1 district allows
the City to utilize the property for activities that are more appropriate in, and compatible with, an
industrial district as opposed to most other areas of the City.
DISCUSSION:
On August 22, 2016 the Planning Commission forwarded the applicant's request for a rezoning
to P-1, Institutional. A motion by Commissioner Hoffman to forward the proposal to the City
Council with a recommendation for approval was made with a vote of 8-0-0.

RECOMMENDATION:
Staff recommends forwarding RZN 16-5535 to the City Council with a recommendation for
approval based upon the findings herein.
BACKGROUND:
The subject property includes approximately 14.20 acres at the east end of East Borick Drive.
The property is largely clear, but with significant amounts of vegetation along its property lines.
Although annexed in to the City along with several hundred acres to the north and west in 1971,
this property has remained undeveloped. The zoning on the property is split along a north -south
axis, with about a third of the western portion zoned 1-2, General Industrial, and the remainder
zoned R-A, Residential Agriculture. Surrounding land use and zoning is depicted on Table 1

Request: The request is to rezone the subject property from 1-2, General Industrial and R-A,
Residential to P-1, Institutional.
Public Comment: Staff has received no public comment.
INFRASTRUCTURE:
Streets: The subject parcel has a 50-foot strip of land connecting it to East Borick Drive,
an improved street with sidewalk, curb, and gutter.

Water: Public water is available to the site. An 8-inch water main runs along Borick
Drive.
Sewer: Public sewer is available to the site. A sewer manhole stubs out to this parcel at
the east end of the Borick Drive right of way.
Drainage: Any additional improvements or requirements for drainage would be determined
at time of development. Portions of this parcel lie within the FEMA designated
100-yr floodplain and floodway. Any developments will be required to obtain
Floodplain Development Permits through the city engineering office. No
protected streams are present on this parcel. No portions of this parcel lie within
the HHOD.
Fire: The Fire Department did not express any concerns with this request.
Police: The Police Department did not express any concerns with this request.
CITY PLAN 2030 FUTURE LAND USE PLAN: City Plan 2030 Future Land Use Map designates
the property as an Industrial Area.
Industrial Areas are those areas with buildings that by their intrinsic function, disposition or
configuration, cannot conform to one of the other designated areas and/or its production process
requires the area to be separated from other sues.
FINDINGS OF THE STAFF:
1. A determination of the degree to which the proposed zoning is consistent with land use
planning objectives, principles, and policies and with land use and zoning plans.
Finding: In staff's opinion, a rezoning of the subject property from the current split -
zoned status to the proposed P-1, Institutional designation is compatible
with surrounding uses and with City Plan 2030.
Land Use Compatibility: The uses allowed by right under the P-1 zoning
district are generally compatible with all neighboring land uses. Most

rezoning is proposed.
Finding: The proposed rezoning is justified at this time, as it will allow development
of the property in such a way as to facilitate and improve future City services.
3. A determination as to whether the proposed zoning would create or appreciably increase
traffic danger and congestion.
Finding: Rezoning the property will not likely increase traffic danger or congestion in
this location due to the limited planned use. East Borick Drive is improved
with curb, gutter, and sidewalk, and although off -site improvements will
likely be unnecessary, they will be evaluated at the time of development.
4. A determination as to whether the proposed zoning would alter the population density and
thereby undesirably increase the load on public services including schools, water, and
sewer facilities.
Finding: As proposed, the property will not be consistently utilized, and certainly not
for habitation. As such, the proposed rezoning will not increase density. The
planned use for the property will increase the demands on the local public
water mains, but not in an undesirable manner.
If there are reasons why the proposed zoning should not be approved in view of
considerations under b (1) through (4) above, a determination as to whether the proposed
zoning is justified and/or necessitated by peculiar circumstances such as:
a. It would be impractical to use the land for any of the uses permitted
under its existing zoning classifications;
b. There are extenuating circumstances which justify the rezoning even
though there are reasons under b (1) through (4) above why the
proposed zoning is not desirable.
Finding: N/A
RECOMMENDATION:
Planning staff recommends forwarding RZN 16-5535 to City Council with a recommendation for
approval based on the findings discussed throughout this report.

Request Letter
Request to change zoning for Fire Training Facility (P-1 institutional)
To: Fayetteville City Planning Commission and City Council,
The City of Fayetteville, Arkansas owns 14.2 acres at the east end of Borick Drive in Fayetteville
(Parcel Number 765-19956-000). This property was offered to the Fayetteville Fire Department
in 2014 for future use as a Fire Training Facility. Currently the property has two zoning
designations: 1-2, General Industrial and R-A, Residential Agriculture. These two designations
divide the property almost equally along a north -south axis. Neither zoning designation can
facilitate the use of the property as is needed by the City. The intent is to rezone the property to
P-1, Institutional, to facilitate the development of the aforementioned Fire Training Facility.
The proposed P-1 zoning district will be compatible with the surrounding land uses and zoning
districts. Superior Wheel Manufacturing is located to the west and is zoned 1-2. To the north and
east is the City -owned Combs Park property, which is zoned P-1, Institutional. To the south of
the subject property is agricultural land located outside of Fayetteville city limits in Washington
County.
City engineers have determined that the property has access to a 12-inch water line and an 8-
inch sanitary sewer connection, both of which are available at the intersection of South and East
Borick Drives.
City of Fayetteville Planners have advised us to seek this zoning change because it fits with the
development goals of the Fire Department and the City of Fayetteville. The proposed project
associated with this re -zone is only for Fire Department use, and therefore will not create
increased vehicle or pedestrian traffic, nor will it lead to population growth or negative strains on
public services. If anything, rezoning this property for its intended use by the City of Fayetteville
Fire Department will improve the quality of public service and safety, benefitting the general
welfare of City residents at large.

Please find attached the Site Improvement Plan application for the Fire Department Training
Facility project. This project consists of the construction of a 120'x150' concrete pad for the
installation of a pre -fabricated mobile fire training structure. Also included is a 20' access
drive off of the east end of Borick Drive. The Engineering Division has prepared plans for this
project and are prepared to submit the plans to the Planning Division for the technical plat
process.
At your convenience, please sign and date the application. Once this has been done, we will
submit the project for approval and move on towards bidding the construction work.

(2) Correspondence in the form of a written letter to Planning Staff describing the scope, nature and intent of
the proposal. Waivers and variances from requirements of the Unified Development Code will be
reviewed and processed in accordance with the procedures set forth therein. Please indicate in the letter to
staff if any waivers are sought and if so, justification for the request. Most waivers require a Planning
Commission decision.
(3) A copy of the county parcel map from the Washington County Assessor's office or from the Washington
County website (www.co.washington.ar.us). The subject property and all adjacent parcels should be
identified on this parcel map. The owner's name, official mailing address, and the parcel number for
every adjacent property shall be shown on this map.
(4) One (1) hard copy and one (1) digital copy in PDF format on CD of the proposed SIP site, landscaping,
grading, utility, and tree preservation plans. These plans should include all required information for an
LSD listed on the Plat Requirements checklist in Section 166.03 of the Fayetteville Unified Development
Code. These requirements are listed on the Plat Requirements and grading permit checklist pages in this
application.
(5) The digital copy should be provided on CD with all of the required documents in separate, named, PDF
format files. Note: A PDF copy of the Drainage report is required; we do not need a hard copy (if
required for your project).
