RECOMMENDATION:
Staff recommends approval of a resolution allocating up to $415,000 to fulfill the AHTD's
request for the City's share of the proposed bicycle and pedestrian sidepath on the Wedington
Drive Bridge to be constructed as part of the Wedington Drive/1-49 Interchange Improvement
Project.
BACKGROUND:
Improvements to the Wedington Drive Interchange are planned by the Arkansas Highway and
Transportation Department as part of their overall plan to improve operations and traffic flow
along 1-49. The project includes a double loop ramp for eastbound Wedington Drive traffic
entering 1-49, along with widening Wedington Drive across the bridge and west to Salem Drive.
The loop ramp design, while providing much improved vehicular traffic flow, creates challenges
for bicycle and pedestrian accommodations. The original design provided by the AHTD
included bike lanes in each direction, and a sidewalk on the north side. The City provided
comments on the bike lane design, and recommended that the bike lane width be reallocated to
the north side of the road way to create a shared use path, that would create a much safer and
more comfortable pedestrian and bicycle accommodation without any additional cost.
After further discussion with the AHTD, and upon their recommendation, the City Council
approved a change to the City's Active Transportation Plan and Master Street Plan to change
the standards across interchanges and on major arterials to a sidepath. Subsequently, the
AHTD revised their plans to include a sidepath on this project, in accordance with our master
plans.

DISCUSSION:
In March of this year, the Mayor received a letter requesting payment in the amount of
$415,000, representing the cost of the additional width for the sidepath versus the standard with
for only vehicular lanes and a 6.5 foot sidewalk. Since that time, staff has been negotiating with
the AHTD, and have reiterated the City's position that reallocation of the space provided in the
original cross section would provide adequate pedestrian and bicycle accommodations.
However, the AHTD's bicycle and pedestrian accommodation policy states that sidepaths are
primarily for recreation purposes, and they are steadfast in their request for payment from the
City. In order to ensure that this critical connection for pedestrians and bicyclist is included in
the project, staff requests approval of this request from the AHTD.
BUDGET/STAFF IMPACT:
Funds are available in the Transportation Bond Program for this item. Funds available in the
Transportation Bond Program are limited, and adding this project to the Bond Program would
impact other projects.
As has been discussed previously with the Transportation Committee, multiple projects,
including Old Wire Road, additional phases of Rupple Road, Van Asche Drive, and Zion Road
Improvements, have been added to the Bond Program over the years. This has been made
possible through a combination of using contingency funds built into the program, reduced
construction costs during recessionary times, and leveraging of bond funds to apply for federal
aid funding. Of these added projects, most have either been completed, or are in various
stages of final design or construction. However, Zion Road Improvements is currently
underfunded due to recent increases project costs as construction costs rise; adding the
Wedington Drive Project to the program will exacerbate this funding issue.
Finally, the sidepath is eligible for funding under the Transportation Alternatives Program, an
80/20 federal aid program administered by the AHTD through an application process. There will
likely be 2 rounds of applications before this payment is due, so it is possible that TAP funding
could be secured to cover at least 80% of this payment.

RECOMMENDATION:
Execution of Supplemental Agreement 01 to the Agreement of Understanding between the City
of Fayetteville and the Arkansas Department of Transportation (hereinafter called the
"Department") for a cost share agreement to add a shared-use path to the Wedington Drive
Bridge over Interstate 49.
BACKGROUND: .
In September of 2016, Resolution 173-16 approved a cost-share agreement with the Arkansas
State Highway and Transportation Commission to add a pedestrian and bicycle shared-use path
to the Wedington Bridge over 1-49 with the City's portion of the cost not to exceed $415,000.00.
On March 21, 2017, the Agreement of Understanding was executed between the City and the
Department to include the shared-use path over the Wedington Bridge at the City's expense not
to exceed $415,000.
On October, 18, 2017, the City was awarded $332,000 in Federal-aid from the Transportation
Alternatives Program (TAP) administered through the Department.
DISCUSSION:
The Department is requesting that the City agree to modify the original Agreement of
Understanding to address the change in funding now available from Federal-aid dollars.
BUDGET/STAFF IMPACT:
Funds have been obligated for this cost share through the Transportation Bond Program.
The shared-use path is estimated to be$415,000 with the TAP grant funding 80% or$332,000
and the City's funding the 20% match which is $83,000.

Fayetteville (hereinafter called the "Project").
WHEREAS, on March 21, 2017, the City of Fayetteville (hereinafter called "City") entered
into an Agreement of Understanding with the Arkansas Department of Transportation
(hereinafter called the "Department") to include a shared-use path along the Highway 16
(Wedington Drive) bridge over Interstate 49; and
WHEREAS, the City agreed to contribute the additional costs associated with the shared-use
path estimated to be $415,000; and
WHEREAS, the City was awarded $332,000 in Federal-aid Transportation Alternatives
Program funds for the construction of the shared use path on October 18, 2017; and
WHEREAS, the City intends to use these funds as part of its $415,000 commitment for the
shared-use path; and
WHEREAS, because of the change in funding, it is now determined that the original
Agreement of Understanding must be modified.
NOW THEREFORE, BE IT UNDERSTOOD, the following modification is made to the
original Agreement of Understanding:
1. Roles and Responsibilities of the City are modified as indicated below:
a. Replace Item 1: When requested, provide the Department with the 20% match for
the Transportation Alternatives Program funds for construction of the shared-use

In Cooperation with the

RELATIVE TO
Design and construction of Job BB0411, Hwy. 16/112 Spur Intchng. Impvts. (S) in
Fayetteville(hereinafter called the"Project").
WHEREAS,the City of Fayetteville (hereinafter called the "City") has requested a modification
to the proposed design for the Project to include a shared-use path along the south side of the
Highway 16(Wedington Drive)bridge over Interstate 49; and
WHEREAS,the Arkansas State Highway and Transportation Department(hereinafter called the
"Department")has agreed to accommodate this design modification; and
WHEREAS,the City has agreed to contribute the additional costs associated with the shared-use
path estimated to be$415,000;and
WHEREAS, City Resolution No. 173-16 expresses the City's commitment to contribute funds
for inclusion of the shared-use path, not to exceed$415,000; and
WHEREAS, Arkansas State Highway Commission Minute Order 2017-011 has authorized the
Director to enter into the necessary partnering agreements with the City and to proceed with the
Project as funds become available.
IT IS HEREBY AGREED that the City and the Department, in cooperation with the Federal
Highway Administration (FHWA), will participate in a cooperative program for implementation
and will accept the additional responsibilities and assigned duties as described hereinafter.
THE CITY WILL:
1. When requested, provide the Department with funding for construction of the Project in an
amount not to exceed $415,000.
2. Agree to promptly refund to the Department in full any and all revenue paid by the
Department based upon claims adjudicated by the Arkansas Claims Commission or other
legal forum sustained on account of the operations or actions of the City, including any act of
omission, neglect or misconduct of the City. This obligation survives the termination or
expiration of this Agreement.

3. Assure that its policies and practices with regard to its employees, any part of whose
compensation is reimbursed from federal funds, will be without regard to race, color,
religion, sex, national origin, age, or disability in compliance with the Civil Rights Act of
1964, the Age Discrimination in Employment Act of 1967, The Americans with Disabilities
Act of 1990, as amended, and Title 49'of the Code of Federal Regulations Part 21 (49 CFR
21),Nondiscrimination in Federally-Assisted Programs of the Department of Transportation.
THE DEPARTMENT WILL:
1. Be responsible for all design, environmental documentation, right of way acquisition, and
utility relocation for the Project.
2. Request funds from the City prior to awarding a construction contract for the Project.

SUBJECT: 2017-0128 — AHTD Agreement of Understanding — Wedington Bridge Trail
RECOMMENDATION:
Approval of an Agreement of Understanding with the Arkansas State Highway and
Transportation Department formalizing resolution 173-16 for a cost share agreement to add a
pedestrian and bicycle shared use path to the Wedington Bridge over Interstate 49 with the
City's Portion of the cost not to exceed $415,000.00.
BACKGROUND:
In September of 2016, resolution 173-16 approved a cost -share agreement with the Arkansas
State Highway and Transportation Commission to add a pedestrian and bicycle shared use
path to the Wedington Bridge over 1-49 with the City's portion of the cost not to exceed
$415,000.00. The Arkansas State Highway and Transportation Department has prepared the
attached Agreement of Understanding to formalize this cost share agreement and requests
approval by the City Attorney and Mayor.
The Agreement of Understanding includes indemnification language that is standard for the
Arkansas State Highway and Transportation Department. If this language is found to be
unacceptable by the City Attorney, staff can request modified language.
DISCUSSION:
The bicycle and pedestrian components of the Wedington project are eligible for funding
through the Transportation Alternatives Program administered through the Arkansas State
Highway and Transportation Department. Upon approval by the City Council on March 7th, a
grant application will be submitted for the entire amount of the cost chare plus additional trail
improvements associated with the project.
BUDGET/STAFF IMPACT:
Funds have been obligated for this cost share through the Transportation Bond Program.
If the Transportation Alternatives Program grant is approved and fully funded at $500,000, the
City will be responsible for 20% of the total project cost, or up to $125,000.

In order to proceed with these modifications, you and the City Attorney must sign and return the
enclosed Agreement of Understanding. A copy of the executed Agreement will be returned to you.

AGREEMENT OF UNDERSTANDING
BETWEEN
THE CITY OF FAYETTEVILLE
AND
THE ARKANSAS STATE HIGHWAY AND TRANSPORTATION DEPARTMENT
In Cooperation with the
U.S. Department of Transportation, Federal Highway Administration
RELATIVE TO
Design and construction of Job BB0411, Hwy. 161112 Spur Intchng. Impvts. (S) in
Fayetteville (hereinafter called the "Project").
WHEREAS, the City of Fayetteville (hereinafter called the "City") has requested a modification
to the proposed design for the Project to include a shared -use path along the south side of the
Highway 16 (Wedington Drive) bridge over Interstate 49; and
WHEREAS, the Arkansas State Highway and Transportation Department (hereinafter called the
"Department") has agreed to accommodate this design modification; and
WHEREAS, the City has agreed to contribute the additional costs associated with the shared -use
path estimated to be $415,000; and
WHEREAS, City Resolution No. 173-16 expresses the City's commitment to contribute funds
for inclusion of the shared -use path, not to exceed $415,000; and
WHEREAS, Arkansas State Highway Commission Minute Order 2017-011 has authorized the
Director to enter into the necessary partnering agreements with the City and to proceed with the
Project as funds become available.
IT IS HEREBY AGREED that the City and the Department, in cooperation with the Federal
Highway Administration (FHWA), will participate in a cooperative program for implementation
and will accept the additional responsibilities and assigned duties as described hereinafter.
THE CITY WILL:
I. When requested, provide the Department with funding for construction of the Project in an
amount not to exceed $415,000.
2. Agree to promptly refund to the Department in full any and all revenue paid by the
Department based upon claims adjudicated by the Arkansas Claims Commission or other
legal forum sustained on account of the operations or actions of the City, including any act of
omission, neglect or misconduct of the City. This obligation survives the termination or
expiration of this Agreement.

Assure that its policies and practices with regard to its employees, any part of whose
compensation is reimbursed from federal funds, will be without regard to race, color,
religion, sex, national origin, age, or disability in compliance with the Civil Rights Act of
1964, the Age Discrimination in Employment Act of 1967, The Americans with Disabilities
Act of 1990, as amended, and Title 49 -of the Code of Federal Regulations Part 21 (49 CFR
21), Nondiscrimination in Federally -Assisted Programs of the Department of Transportation.
THE DEPARTMENT WILL:
1. Be responsible for all design, environmental documentation, right of way acquisition, and
utility relocation for the Project.
2. Request funds from the City prior to awarding a construction contract for the Project.

RECOMMENDATION:
-'Staff recommends approval of a resolution allocating up to $415,000 to fulfill the AHTD's
request for the City's share of the proposed bicycle and pedestrian sidepath -on the Wedington
Drive Bridge to be constructed as part of the Wedington Drive/1-49 Interchange Improvement
-Project.
_BACKGROUND:
Improvements -to the Wedington Drive Interchange are planned by the Arkansas Highway and
Transportation Department as part of their overall plan to improve operations and traffic flow
along 1-49. The project includes a double loop ramp for eastbound Wedington Drive traffic
entering 1-49, along with widening Wedington Drive across the bridge and west to Salem Drive.
The loop ramp design, while providing much improved vehicular traffic flow, creates challenges
for bicycle and pedestrian accommodations. The original design provided by the AHTD
included bike lanes in each direction, and a sidewalk on the north side. The City provided
comments on the bike lane design, and recommended that the bike lane width be reallocated to
the north side of the road way to create a shared use path, that would create a much safer and
more comfortable pedestrian and bicycle accommodation without any additional cost.
After further discussion witti the AHTD, and upon their recommendation, the City Council
approved a change to the City's Active Transportation Plan and Master Street Plan to change
the standards across interchanges and on major arterials to. a sidepath. Subsequently, the
AHTD revised their plans to include a sidepath on this project, in accordance with our master
plans.

DISCUSSION:
In March of this year, the Mayor received a letter requesting payment in the amount of
$415,000, representing the cost of the additional width for the sidepath versus the standard with
for only vehicular lanes and a 6.5 foot sidewalk. Since that time, staff has been negotiating with
the AHTD, and have reiterated the City's position that reallocation of the space provided in the
original cross section would provide adequate pedestrian and bicycle accommodations.
However, the AHTD's bicycle and pedestrian accommodation policy states that sidepaths are
primarily for recreation purposes, and they are steadfast in their request for payment from the
City. In order to ensure that this critical connection for pedestrians and bicyclist is included in
the project, staff requests approval of this request from the AHTD.
BUDGET/STAFF IMPACT:
Funds are available in the Transportation Bond Program for this item. Funds available in the
Transportation Bond Program are limited, and adding this project to the Bond Program would
impact other projects.
As has been discussed previously with the Transportation Committee, multiple projects,
including Old Wire Road, additional phases of Rupple Road, Van Asche Drive, and Zion Road.
Improvements, have been added to the Bond Program over the years. This has been made
possible through a combination of using contingency funds built into the program, reduced
construction costs during recessionary times, and leveraging of bond funds to apply for federal
aid funding. Of these added projects, most have either been completed, or are in various
stages of final design or construction. However, Zion Road Improvements is currently
underfunded due to recent increases project costs as construction costs rise; adding the
Wedington Drive Project to the program will exacerbate this funding issue.
Finally, the sidepath is eligible for funding -under the Transportation Alternatives Program, an
80/20 federal aid program administered by the AHTD through an application process. There will
likely be 2 -rounds of applications before this payment is due, so it is possible that TAP funding
could be secured to cover at least 80% of this payment.

It is our understanding from previous communications that you are requesting modification to the
proposed design of AHTD Project BB041 I on Highway 16 to include a shared -use -path along the south
side of the Highway 16 Bridge over 1-49. Based on your comments, the addition of the shared -use -path
can be accommodated.
The additional width needed to accommodate the shared -use -path is depicted on the enclosures. In order
for this shared -use -path to be included in the project, the City would need to fund the additional cost
associated with the shared -use -path, which has been estimated to be $415,000.

I have received your letter dated March 221°, and have asked my staff to review the
information provided. Upon review, we offer the following:
• Original conceptual drawings presented to the City in late 2013, and to the public in early
2014, included sidewalks on one or both sides of the highway, and bike lanes in both
directions. The total bridge width in these drawings was 117 feet.
• In April of 2014, 1 sent a letter to the Department requesting the bike lanes be _
reallocated to a side path on the north side of the roadway, with the intent to maintain
the same 117 feet'of total bridge width.
• In February of 2015, after City staff met with you and other Department representatives
(including the Director of the Department) regarding the cross section of Highway 16, the
City Council approved revisions to the Fayetteville Alternative Transportation and Trails
Plan and to the City's Master Street Plan to clarify that the on -street linkages identified in
the FATT Plan were intended to be side paths, and to provide a Master Street Plan
cross section including the side path, to be used at freeways and expressways on
arterial streets. This Council action was based on clear Department guidance that the
City's Master Street Plan cross sections would be used to develop cross sections for
construction, and that if the City's adopted plan was amended, the shared path concept
could be accommodated.
• 30% complete plans received in December include a 118 foot wide bridge option, with a
12 foot wide protected shared use path, an almost identical width to the original 117 foot
wide conceptual design.
The point of recreating the history of this discussion around the bridge cross section and
how the pedestrian cyclist traffic can be more safely accommodated is to reiterate that that we
believe the City's standards and adopted plans specify the construction of a side path in this
situation, at the guidance and direction of the Department, and do not consider it the City's
responsibility to pay for any of the cost of this side path. As we have stated in the past,
reallocation of the bridge width presented at conceptual and 30% level designs to provide for

the side path instead of bike lanes would provide a safer and more usable facility for all users at
little or no additional cost. It appears that the 118 foot bridge width in the 30% plans
accomplishes this goal, and the City requests that the Department proceed with that cross
section, which is attached for your reference.
As I have said in the past, provision of bicycle and pedestrian access across 1-49 is a
major goal of the City of Fayetteville, and is imperative to the safety of the cycling and
pedestrian community. The current lack of adequate bicycle and pedestrian connections
across the interstate is a significant safety issue, and is one that simply must be addressed with
this project. I hope that we can find a solution that addresses this safety concern without
costing either the City or the Department any additional money.

This is to acknowledge receipt of your recent correspondence regarding Highway 161112 Spur
Interchange Improvements (Job BB0411) on Interstate 49 in Fayetteville.
As you are aware, the Department's policy is to provide bike lanes when a proposed highway
project is on a route that has been designated as a bicycle route by a locally adopted bicycle plan or master
street plan and the Department concurs with the designation. As -defined by the American Association of
State Highway and Transportation Officials (AASHTO), a bike lane is "a portion of a roadway which has
been designated by striping, signing, and pavement markings for the preferential or exclusive use of
bicyclists". Bike lanes are located adjacent to motor vehicle travel lanes for the purpose of providing an
alternative mode of transportation to move people to and from their destinations. A shared -use path is not
considered a mode of transportation but rather a recreational enhancement.that increases the quality of life
for local residents, as well as attracting tourism that benefits the local economy.. If requested, we will gladly
partner with local agencies when possible to enhance a facility's recreational features, provided adequate
funding is provided to offset the additional cost, The Department must focus its limited resources to keep
the State Highway System in a state of good repair, enhance safety, and increase mobility for road users.
The original design of Porter Road — Highway 112171E (Widening 8 Interchange
Improvements) (Job 880414) included bike lanes since the route was included in the Fayetteville
Alternative Transportation and Trails Plan (FATT Plan). This design also included sidewalks, which are
added to all bridges for safety. The City requested that the Department substitute the planned bike lanes
and sidewalks along the Highway 112 Bridge with a shared -use path. This request was based on the City's
desire to revise your FATT* Plan to eliminate some or all on -street bike lanes as a mode of transportation
and to identify the location of future shared -use paths that would enhance the recreational trail system in
the region. Because the net increase to the width of the bridge was minimal, the Department made a "one-
time exception" to our policy. We agreed to partner with the City to change the design of Job BB0414
without requiring total reimbursement for this recreational enhancement.

Concerning Job 660411, please refer to the enclosed Attachments A and B. Consistent with our
policy as described above, the Highway 16 Bridge is currently being designed as an approximately 110 -foot
wide structure that will include a 6.5 -foot sidewalk. The Highway 16 Bridge is not identified for bike lanes in
the FATT Plan. It is identified for a shared -use path, which is considered a recreational enhancement. If
the bridge is modified to include a shared -use path, the width of the structure will increase to approximately
122 feet. It is estimated that the.additional width of 12 feet will add $415,000 to the cost of the structure,
which will be the responsibility of the City. Please understand that if the City was substituting bike lanes for
a shared -use path, as was the case with Job BB0414, the City would still be responsible for the additional
cost since it would be considered a recreational enhancement, which the Department does not fund.
Again, a one-time exception was made in the case of Job B130414.
You have stated that it is our responsibility to build the Highway 16 structure to a higher design
standard. to include a shared -use path in order to meet the in 2015 by
the City of Fayetteville's City Council. The following points are offered to address your statement
concerning the Department's design standard responsibility and practice:
• The Department's policy is to accommodate a City's Master Bike/Pedestrian Plan when designing
improvements to the State Highway System and to provide bike lanes and/or sidewalks as a mode
of transportation (not recreation) as appropriate. However, the Department is not required to
- — accommodate higher design standards adopted by cities for the overall city street system, including
recreational enhancements, which may include some State Highways. The Department has the
authority by State law to set appropriate design standards -for the State Highway System. The
Department is not legally required to comply with local ordinances except where compliance is
required by specific State statute.
In general, state highway projects are designed using State, Federal Highway Administration
(FHWA) and American Association of State Highway and Transportation Officials (AASHTO)
design standards. The nation's State highway departments, working through AASHTO, develop
design standards through a series of committees and task forces. FHWA contributes to the
development of the design standards through membership on these working units, sponsoring and
participating in research efforts, and many other initiatives.
The Department is not bound to any local jurisdiction's adopted design standards that are contrary to
these aforementioned standards. With limited tax dollars available to meet all the needs of Arkansas' State
Highway System, it is important that the Department adopt reasonable and appropriate standards that are
applied fairly. If a local jurisdiction desires a higher more elaborate design standard than is proposed, the
additional cost is their responsibility.

The Department's practice as the agency responsible for the construction and maintenance of the
State Highway System is to set consistent and appropriate design standards to enhance the safety and
mobility of the road user, while at the same time maximizing the return on taxpayer dollars. The
Department is willing to deviate from those standards for local purposes provided (1) any new design meets
or exceeds the necessary safety and engineering requirements; and (2) any additional cost is borne by the
party seeking the deviation. Because the City of Fayetteville's design standards are in excess of the
Department's standards for Highway 16, all requested improvements exceeding those standards will need
to be funded by the City. I also understand that my staff encouraged the City staff to apply for a
"Transportation Alternatives Program (TAP) Grant" to secure funding for this improvement; however, this
funding source was not pursued.
In closing, it is hoped that we have adequately answered your comments and you now understand
our practice concerning design standards. Cities have jurisdiction over city streets. The Department has
jurisdiction over state highways. As you can imagine, cities across the State could adopt a variety of very
expensive design standards. This may be acceptable for city street projects, but when applied to state
highways, it should .be viewed as an additional cost investment to a city's infrastructure that should be
borne by the city.
As previously stated in our letter of March 22, 2016 and again mentioned above, the additional
width needed to accommodate the shared -use path is depicted on the enclosures. In order for this shared- _
use path to be included in the project, the City would need to fund the additional cost of $415,000. We ask
that a.response be provided in a timely manner so that'the design for the project can continue.
