RECOMMENDATION: The Planning Commission and staff recommend approval of an ordinance to rezone the properties to CS, Community Services as shown in the attached Exhibits `A' and 'B'. BACKGROUND: The proposed rezoning request is for approximately 2.71 acres, the south portion of a larger 6.07 acre parcel located at the northwest corner of Mt. Comfort and Salem Roads. The property is currently within the R-A zoning district, and is developed with a single-family home and assorted agricultural buildings. The home was built in 1921. Request: The request is to rezone a portion of the parcel (approximately 2.71 acres) from R-A to CS, Commercial Services, in order prepare the parcel for development. Land Use Compatibility: The proposed zoning is compatible with surrounding land use patterns in this area, which contains a mixture of recent suburban residential development and the historic agricultural use. Large parcels to the west and south are currently pasture, while land to the east and north are in residential use. The proposed CS zoning does not abut immediately adjacent to any single family homes, although there is a single family resident across Salem Road from the site. Land Use Plan Analysis: The proposed zoning is fully consistent with the Future Land Use Map (FLUM) of the City Plan 2030. The goals of City Plan 2030 include making the traditional town form the standard. The CS zoning district encourages patterns of development that result in realizing this goal, including an expectation that non-residential buildings will be located at the corner, creating an environment appealing to pedestrians and reducing the visual impact of parking areas. DISCUSSION: This item was discussed at the June 13, 2016 Planning Commission meeting where it was forwarded to the City Council with a recommendation for approval with a vote of 5-1-0 (Commissioner Autry voted 'no'). At that meeting three members of the public spoke against the proposed rezoning discussing a variety of concerns including traffic, lack of sidewalk, dislike of Dollar General store, and other issues. BACKGROUND: The proposed rezoning request is for approximately 2.71 acres, the south portion of a larger 6.07 acre parcel located at the northwest corner of Mt. Comfort and Salem Roads. The subject property also has access to Salem Road, a two-lane collector that is improved near the intersection at Mount Comfort Road, but not improved along much of the property frontage. Any further street improvements would be determined at time of development. Water: Public water is available to the site. An 8" water main runs along the property frontage of Salem Road. This designation supports the widest spectrum of uses and encourages density in all housing types. A determination as to whether the proposed zoning would create or appreciably increase traffic danger and congestion. Finding: A CS zoning allows a wide range of commercial activity and unlimited residential density. The proposed rezone would create the potential for increased traffic in the area over the existing R-A zoning. The property is located on a corner of Salem Road, a partially improved `Collector' street and Mt. Comfort Road, a fully improved five -lane `Minor Arterial' street. Improvements in this area have been completed in anticipation of future development in this area of the City. Future improvements to Salem Road will be evaluated at the time of development. Traffic danger and congestion is not expected to increase appreciably. 4. A determination as to whether the proposed zoning would alter the population density and thereby undesirably increase the load on public services including schools, water, and sewer facilities. Finding: Rezoning the property from R-A to CS could significantly alter population density in the area. CS zoning allows a wide range of commercial activity and unlimited residential density. The rezone request is not likely to undesirably increase load on public services. 5. Comfort and Salem Road. We represent Dollar General in Arkansas and have been asked by them to locate a store in this immediate area. Upon research along Mt. Comfort Road, we have found this piece of ground that we believe will be a perfect spot, due to the location, traffic patterns, and the economics. During further research I noticed that the master plan on Fayetteville's GIS map showed that this area is labeled as City Neighborhood Area according to the future land use map. Currently the ground is still labeled as residential agricultural use. Our hope is that we can take the front 300' in depth and the entire width along Mt. Comfort Road and rezone this to Community Services zoning. This will allow the development of a Dollar General on the furthest southwest corner of the parcel leaving a corner available for future development. We believe that the zoning will provide us sufficient liberties to place businesses/retail that would be a great service to the immediate surrounding neighborhoods as to provide quick and convenient services to close residents.
