AN ORDINANCE TO APPROVE VAC 16-5424 SUBMITTED BY ALLISON THURMOND-
QUINLAN FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF MILL AVENUE AND
SOUTH STREET TO VACATE STREET RIGHT-OF-WAY.
WHEREAS, the City Council has the authority under A.C.A. § 14-54-104 to vacate public grounds or
portions thereof which are not required for corporate purposes; and
WHEREAS, the City Council has determined that the following described street right of way is not
required for corporate purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby vacates portions of street
right-of-way as described in Exhibit B attached to the Planning Department's memo.
Section 2. A copy of this Ordinance duly certified by the City Clerk along with the map attached as
Exhibit A to the Planning Department's memo shall be filed in the office of the Washington County
Circuit Clerk.
Section 3. This vacation approval is subject to the following conditions:
1. Any costs associated with relocation of or damage to utilities and new easement dedication shall be at the
owner/developer's expense.
2. A utility easement shall remain where the existing gas line is the center line of the utility easement.

RECOMMENDATION:
Planning Department staff and the Planning Commission recommend approval of VAC 16-5424
with the following conditions:

1. Any relocation or damage to utilities and associated new easement dedication shall be at
the owner/developer's expense.
2. A utility easement to remain whereas the existing gas line is the center line of said utility
easement.
BACKGROUND:
The property is located on the northwest corner of Mill & South St. The property is currently zoned
as RMF-24, within City Right-of-way, and contains approximately 2,052.5 square feet. The
applicant states the property in the 1920s and 1930s had a grocery store, but was later
demolished and deeded to the City in 1946 for roadway widening.
The applicant proposes to vacate city right-of-way as depicted in Exhibit 'A' and described in
Exhibit 'B' to allow for future development.
DISCUSSION:
On May 23, 2016 the Planning Commission forwarded this item to the City Council with a
recommendation for approval with a vote of 6-0-1 (Commissioner Quinlan recused;
Commissioners Autry and Noble absent) as a consent agenda item.

PETITION TO VACATE STREET RIGHT OF WAY
TO: The Fayetteville City Planning Commission and
The Fayetteville City Council
Flintlock Development, LLC requests that the City of Fayetteville abandon and vacate the street right of way described
below and in the attached ALTA survey and exhibits. The Street Right of Way is a small triangular parcel numbered 765-
02976-000 fronting F. South Street that is currently used for parking by the residents of 228 S. Mill Ave.
LEGAL DESCRIPTION
The legal description of the parcel is as follows:
Beginning at the South East corner of said lot as shown by the recorded plat of said addition, and running
thence North to a point which is three (3) feet South of the North line of said Lot 10; thence East to the East line
of said lot, thence Southwesterly with the East line of said lot to the place of beginning.
STREET RIGHT OF WAY HISTORY
The parcel had a small grocery store on it during the 1920s and 1930s. The concrete floor of the grocery store is still
visible on site. The grocery store also appears on the 1930s Sanborn to have a small gas tank associated with it. We
have checked that this tank is unregistered and unregulated, and have done due diligence to confirm it did not have any
leakage or environmental issues associated with it.
The parcel was deeded to the city for the purpose of widening the road in 1949. The road has not been widened or
changed in the intervening years, and City's Master Street Plans do not include any proposed changes to the adjacent
streets. The public's interest and welfare would not be affected by the abandonment.
REASON FOR RIGHT OF WAY VACATION REQUEST
We request that parcel 765-02976-000 be vested in Flintlock Development; LLC (the abutting property owner) as
provided by law, subject to existing utility easements as required. We request that this Street Right of Way be
abandoned and vacated so that it may be developed along with the adjacent parcels into compact single family homes.
The site will be developed in accordance with the city's 2030 Master Planning Goals of making infill and revitalization
the highest priority, making traditional town form the standard, and creating opportunities for attainable housing.

We, the undersigned, being all the owners of the real estate abutting the right of way hereinafter sought to
be abandoned and vacated, lying in part of Lot 10, Block 2 in Boles Addition to the City of Fayetteville,
Arkansas, a municipal corporation, petition to vacate a right of way which is described as follows:
Beginning at the South East corner of said lot as shown by the recorded plat of said
addition, and running thence North to a point which is three (3) feet South of the North line
of said Lot 10; thence East to the East line of said lot; thence Southwesterly with the East
line of said lot to the place of beginning.
That the abutting real estate affected by said abandonment of the right of way are: E12 LOT 9, N 2 FT E12
LOT 10, BLOCK 2 (765-02974-000) and PT LOT 10 BLOCK 2 7312291381501351179 (765-02977-000) of
the City of Fayetteville used by the public for a period of many years, and that the public interest and
welfare would not be adversely affected by the abandonment of the portion of the above described right-
of-way.
The petitioners pray that the City of Fayetteville, Arkansas, abandon and vacate the above described real
estate, subject, however, to the existing utility easements and sewer easements as required, and that the
above described real estate be used for their respective benefit and purpose as now approved by law.
The petitioners further pray that the above described real estate be vested in the abutting property owners
as provided by law.
WHEREFORE, the undersigned petitioners respectfully pray that the governing body of the City of
Fayetteville, Arkansas, abandon and vacate the above described real estate, subject to said utility and
sewer easements, and that title to said real estate sought to be abandoned be vested in the abutting
property owners as provided by law, and as to that particular land the owners be free from the easements
of the public for the use of said alley.

AN ORDINANCE TO APPROVE VAC 16-
5424 SUBMITTED BY ALLISON
THURMOND-QUINLAN FOR
PROPERTY LOCATED AT THE
NORTHWEST CORNER OF MILL
AVENUE AND SOUTH STREET TO
VACATE STREET RIGHT-OF-WAY.
WHEREAS, the City Council has the
authority under A.C.A. § 14-54-104 to
vacate public grounds or portions thereof
which are not required for corporate
purposes; and
WHEREAS, the City Council has
determined that the following described
street right of way is not required for
corporate purposes.
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City
of Fayetteville, Arkansas hereby vacates
portions of street right-of-way as described
in Exhibit B attached to the Planning
Department's memo.
Section 2. A copy of this Ordinance duly
certified by the City Clerk along with the
map attached as Exhibit A to the Planning
Department's memo shall be filed in the
office of the Washington County Circuit
Section 3. This vacation approval is subject
to the following conditions:
1. Any costs associated with relocation of or
damage to utilities and new easement
dedication shall be at the owner/developer's
expense.
2. A utility easement shall remain where the
existing gas line is the center line of the
utility easement.
