WHEREAS, C Holdings, LLC is the record owner of the real property located at 1503 North Garland Avenue, City of Fayetteville, Washington County, Arkansas, legally described as follows: A part of Lot Numbered Two (2) in Block Numbered One (1), Hendrix Addition, Fayetteville, Arkansas, as per plat of said addition on file in the office of the Circuit Clerk and Ex -Officio Recorder of Washington County, Arkansas, being more particularly described as follows: Beginning at the Southeast. corner of said Lot 2, and running North 52.50 feet; thence West 150.00 feet; thence South 52.50 feet; thence East 150.00 feet to the point of beginning, and containing 0.18 acres, more or less; and WHEREAS, the City Council has determined that the structure located on said property is dilapidated, unsightly, unsafe, and detrimental to the public welfare; and WHEREAS, C Holdings, LLC, having been properly served with Violation Notices via Certified Mail, Return Receipt Requested, and given thirty (30) days to correct said violations, has refused to repair, or raze and remove said dilapidated, unsightly, and unsafe structure. BACKGROUND: Service Request #161006 Case #22177: Code Compliance responded to a request concerning the structure located at 1503 N Garland Ave. The structure appeared to be in violation of Subsection 173.09(A), Unsafe Buildings, of the City Code of Ordinances. The Building Safety Director observed: Broken windows, back door ajar, tree growing into corner, rotted and missing siding, roof leaks, extensive interior water damage. On June 10th, 2016 a Notice of Violation was delivered to the owner of record. By Ordinance, the property owner was given until July 13th, 2016 to acquire a building permit or to Raze and Remove the structure. On August 10th, 2016 a Notice of Public Hearing was sent to the property owner informing them of the September 6th, 2016 Public Hearing DISCUSSION: This parcel contains a single story 1,000 square foot single family dwelling. Property owners have been unresponsive as to any intentions for abatement. No building permits have been issued or applied for. BUDGET/STAFF IMPACT: If the property owner does not comply with the Raze and Removal order, Raze and Removal costs will be expensed at the current budget. A lien will be placed on the property for the incurred costs. The current budget balance is $2,300.00, therefore, we are requesting a budget adjustment of $3,849.00.
