WHEREAS, in anticipation of possible future development, a survey was commissioned by the City of property at the intersection of West Avenue and Spring Street that was purchased from Fayetteville School District No. 1 in 1995 and which is currently used as a public parking lot; and WHEREAS, the survey identified a 15 x 152 foot strip of land on a portion of the property that was conveyed in 1907 by John and Alma Rehm to the St. Louis and San Francisco Railroad Company as a railroad easement, but which reverted to the Rehms after it was not used for railroad purposes; and WHEREAS, the City must acquire clear title to the 15 x 152 foot strip of land in order to proceed with future development of the property but the City has been unable to locate any heirs of John and Alma Rehm to attempt to negotiate a conveyance of the property to the City; and WHEREAS, the City of Fayetteville needs to gain possession of this property promptly to begin the development of necessary public improvements. BACKGROUND: Lot 56 is a public parking lot located at the southeast corner of West Avenue and Spring Street. The City purchased the property in 1995 from Fayetteville School District No. 1, and it has been utilized as a parking lot for over 15 years. Historically, the property was utilized for a barrel -making shop and a service station, among other uses. A spur of the Frisco line railroad used to traverse West Avenue to this property, within a 15' x 152' strip of land adjacent to the West Avenue right- of-way owned by the St. Louis and San Francisco Railroad Company. The overall property on which the parking lot is located is currently being considered for the new home of Theatre Squared, supported by the City Council in Resolution 186-15 adopted in October of 2015. As part of the survey of the property it was discovered that a 15 -foot strip along West Avenue is excepted from the description of the property on the Warranty Deed to the City of Fayetteville from Fayetteville School District No. 1. After researching the ownership prior to our purchase of said property, it was determined that a deed had been granted by John and Alma Rehm to St. Louis and San Francisco Railroad Company in 1907. This deed was granted to the Railroad but contained a clause that the property was to be used solely for the purpose of maintaining and operating a railroad and whenever abandoned for such purposes, the premises revert back to the grantors and their heirs and assigns. The railroad obviously is no longer utilizing these premises today. Through extensive research by the City's land agents, we have been able to establish the descendants of the Rehms, using ancestry research, gravesite locators, death certificates and census records. A title search was also conducted by Bronson Abstract; there are no further documents past the 1907 deed to the Railroad on the 15 -foot strip. It appears that there may be Mailing Address: 113 W. DISCUSSION: Regardless of any potential future use of the property by Theatre Squared, the City currently utilizes this property for a public parking lot, and the intent of purchasing it in 1995 was to do so. It appears that a 15 -foot strip of the larger property was separated when it was deeded to the railroad, and future acquisitions and subsequent deed transfers of the Rehm property did not include the 15 -foot strip of property along West Avenue. From our research, it appears this was not intentional, nor has it been noticed or resolved in over 100 years. The City has conducted an appraisal of the property, and requests that the City Council authorize the City Attorney to seek possession of the property by way of condemnation, due to the fact that no known heirs are alive. Funds deposited with the Court will likely eventually go to the State if they are not claimed, which is the expected outcome in this particular case. BUDGET/STAFF IMPACT: The agenda item staff review form indicates $37,001 as the cost of this request. It should be noted that this is an estimate, based on the appraised values of the properties, and that the final cost is subject to negotiation with the property owners (should they be located) or by court order. The appraised value will be deposited into the Registry of the Circuit Court as just compensation when the condemnation complaint is filed for the property.
