HomeMy WebLinkAbout71-16 RESOLUTION113 West Mountain Street Fayetteville, AR 72701 (479) 575-8323 Resolution: 71-16 File Number: 2016-0148 UNIVERSITY OF ARKANSAS COST SHARE AGREEMENT: A RESOLUTION TO APPROVE A COST SHARE AGREEMENT WITH THE UNIVERSITY OF ARKANSAS FOR A WATER MAIN UPGRADE ALONG PORTIONS OF MAPLE STREET AND OLIVER AVENUE WHEREAS, the University has requested that the City construct and share in the cost of constructing a 12 -inch water main along a portion of Maple Street west of Razorback Road to Oliver Avenue, a distance of approximately 150 feet, and then north along Oliver Avenue a distance of approximately 300 feet, so that the University may further develop the property near the Chancellor's residence; and WHEREAS, increasing the size of this segment to a 12 -inch main will alleviate the current capacity deficiency and the lack of a loop, allow the University to develop the property, and also allow for ample future capacity which the City recognizes will be necessary for the area that is served by this water main; and WHEREAS, § 51.112 of the Fayetteville City Code provides that "the City shall pay the excess material cost of facilities of a size larger than required to service subdivisions when such excess size is specified and required by the water and wastewater director for the general benefit of the water system." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a cost share agreement with the University of Arkansas for a water main upgrade along portions of Maple Street and Oliver Avenue, with construction material costs in the amount of $22,999.44 to be paid by the University, and labor and equipment costs in the amount of $7,254.40 along with any construction material costs exceeding the amount of $22,999.44 to be paid by the City. The cost share is $22,999.44 for construction materials provided by the University, and $7,254.40 in labor and equipment provided by the City. BACKGROUND: The University has requested that the City construct and share in the cost of constructing a 12 - inch water main on a portion of Maple Street between Razorback Road and Oliver Avenue, a distance of approximately 150 feet, and a portion of Oliver Avenue between Maple Street and West Cardwell Lane, a distance of approximately 300 feet, so that the University may further develop the property near the Chancellor's residence. The City of Fayetteville also benefits from the installation of this water line segment. In addition to alleviating the current capacity deficiency in that area, providing the capacity needed for future growth and increasing the fire flow protection, this project will establish a looped line between Oliver Avenue and Maple Street. This decreases the age of the water in the pipe, and therefore reducing the possibility of forming of Disinfection Byproducts in the public water system. DISCUSSION: Section 51.112 of the Fayetteville City Code provides that "the City shall pay the excess material cost of facilities of a size that is larger than required to serve subdivisions when such excess size is specified and required by the water and wastewater director for the general benefit of the water system." Since the 12 -inch line will provide a loop to convey much more water to the area, the Utility Staff feels it is fair and equitable to provide labor and equipment toward the upgrade. Furnish the labor, materials, and equipment to upgrade approximately 450 linear feet of 2 and `/4 -inch water main on Maple Street and Oliver Avenue to 12 -inch main. B. Bear any costs associated with the water main installation that exceed the amount the University agrees to pay below. 2. The University of Arkansas agrees to: A. Reimburse the City for the cost of the water main installation up to a maximum - not -to -exceed amount of $22,999.44, which represents the cost estimated by Fayetteville. B. Make payment to Fayetteville within thirty (30) days after receipt of valid invoices.
