2016 EMPLOYEE COMPENSATION:
A RESOLUTION TO APPROVE A BUDGET ADJUSTMENT IN THE AMOUNT OF
$1,220,000.00 TO FUND THE CITY-WIDE 2016 EMPLOYEE COMPENSATION ADJUSTMENT,
AND TO APPROVE A CERTIFICATION PAY PLAN FOR SWORN POLICE PERSONNEL
WHEREAS, the most recent forecast shows that City will have a net operating surplus for the
General Fund of about $1,600.00 for 2015; and
WHEREAS, Mayor Jordan's proposed Employment Compensation Adjustment will cost the General Fund
about $819,000.00 for 2016 for General Fund employees; and
WHEREAS, including all employees (Water and Sewer, Recycling and Trash Collection, etc. as well as
General Fund employees), the cost will be about $1,220,000.00 for 2016; and
WHEREAS, Mayor Jordan and Chief Tabor also recommends the approval of a certification pay plan for
sworn police officers which will pay the amount of $25.00 per month for each certificate achieved by an
officer beyond the basic certificate at a cost of approximately $77,000.00 for the remainder of 2016.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a budget adjustment,
a copy of which is attached to this Resolution and made a part hereof, in the amount of $1,220,000.00 to
fund the city-wide 2016 Employee Compensation Adjustment.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves the

SUBJECT: Appropriation Authority for Employee Compensation Adjustments
RECOMMENDATION:
The Mayor's recommendation is for the City Council to appropriate funds to
provide for the compensation package outlined above.
DISCUSSION:
As discussed during the 2016 Budget process, the Mayor is recommending a
compensation package to the City Council based on the fiscal results of 2015
operations. The operating results from the fourth quarter of 2015 have been
forecasted to be a net operating surplus of approximately $1.6 million in the
General Fund.
This surplus was achieved through both expense control and revenue increases
as the Administration was able, through good management, to hold
expenditures under budget.
Other operating funds such as the Street, Parks Development, Water & Sewer
and Recycling & Trash Collection funds have the capacity to afford these salary
increases.

The Mayor's Guiding Philosophy
• Recommendation supports on-going funding without risking future layoffs.
• Non -uniformed employees with at least six (6) months of service to the City
qualify for an appropriate increase in compensation.
Based on these results, the Mayor is recommending the following compensation
package to the Council:
• The plan would provide for a one step increase for eligible Police and Fire
uniformed personnel beginning 3/14/2016 keeping everyone in a step.
• The plan would provide for merit increases for other employees
comparable to the amount provided for a step to uniformed personnel, to
be distributed based on merit (3.7% merit pools will be created for that
purpose).
• Amounts to merit employees will be based on performance as
determined by the appropriate department/division head. These
increases will go into effect beginning 3/14/2016.
• Employees at the top of their ranges will be eligible for a single year
service award which will not be factored into the employee's base pay.
• To be eligible merit employees must have completed at least six (6)
months of service as of 3/31/2016.
• Uniformed personnel must have completed at least one year of service as
of 3/31/2016 to receive a step increase.
• The 2016 cost of this plan is projected to be $819,000 in the General Fund.
The 2016 cost for all funds would be $1,220,000.
• The on-going cost of the plan in future years will be $1,065,000 for the
General Fund and $1,585,000 for all funds.

The impact of this proposal would be to increase the budgets for various funds
as follows:

SUBJECT: Certificate Pay for Police Officers
RECOMMENDATION:
Staff recommends the approval of a certificate pay plan for sworn police personnel.
BACKGROUND:
The State of Arkansas Commission on Law Enforcement Standards and Training (CLEST)
offers five (5) law enforcement certificates (Basic, General, Intermediate, Advanced, and Senior)
based upon a combination of experience, training, and education. All but one other similarly
sized municipal law enforcement agency in Arkansas have a certificate pay plan in place (see
attached).
DISCUSSION:
Our Certificate Pay Plan will not include the basic certificate. Our plan will offer $25 per month
for each certificate achieved beyond the basic certificate. We believe implementation of this
certificate pay plan will assist in our recruitment and retention efforts, and make us more
comparable to other law enforcement agencies. Implementation of our certificate pay plan is
projected to be approximately $77,000 for the remainder of 2016.
BUDGET/STAFF IMPACT:
Funds are currently budgeted within the Police Department's 2016 Annual Budget and Capital
Improvements Program.

TITLE: CERTIFICATION OF LAW ENFORCEMENT OFFICERS
This specification supplements Section 1010, 1011, and 1012 of the
Regulations which provides for the issue of Basic, General, Intermediate,
Advanced, Senior, Part-time I, Part-time II and Auxiliary Certificates to law
enforcement officers meeting prescribed standards of training, education
and experience.
REQUIREMENTS
1. GENERAL PROVISIONS
(a) To be eligible for the award of a certificate, each applicant
must be a law enforcement officer appointed by a law
enforcement unit located within the State of Arkansas.
(Refer to Regulation 1001 (9))
(b) Each applicant shall meet the Commission's prescribed
minimum standards for employment established pursuant to
Regulation 1002 except those Full-time law enforcement
officers who were employed before January 1, 1978. Those
persons are "grandfathered" and exempt from meeting any
selection or training requirements, provided they have been
continually employed by the same agency since December
31, 1977. Amended by Act 1472 of 1999.
(c) Each applicant should attest that he subscribes to the Law
Enforcement Code of Ethics.
(d) All applications for an award of the Basic, General,
Intermediate, Advanced or Senior Certificates shall be
completed on the Form F-7, Application for Award of Law
Enforcement Officer Certificate.
(e) In addition to the requirements set forth above for the award
of a General, Intermediate, Advanced or Senior Certificate,
each applicant shall have completed the designated
education and training combined with the prescribed law
enforcement experience.
(e) College credits earned in law enforcement related subjects
may be counted for either training points or education points,
whichever is to the advantage of the applicant.
4. LAW ENFORCEMENT EXPERIENCE
Experience acquired as a sworn law enforcement officer employed
full-time and having statutory authority to enforce state or federal
criminal, traffic, or highway laws may be approved. Experience
acquired with a police agency whose standards are lower than
minimum standards established by the Commission will be
rejected.
Law Enforcement experience claimed is subject to staff evaluation
and final approval of the Commission.
5. ELIGIBILITY QUESTIONS
When determination of "eligibility of certification" of persons defined
in Act 452 of 1975, becomes necessary for establishing
qualifications to apply for, file for, or hold certain positions or
elective office, as required by laws, the following procedures shall
apply:
(a) The applicant shall submit a letter to the commission
requesting voluntary participation in the certification
program. The commission also reserves the right to initiate
the exploration of eligibility.
(b) Any person approved for certification will be required to meet
the minimum standards for employment or appointment as
defined in Regulation 1002 and the training requirements
established or approved by the Commission.
(c) The acceptance of previous military police experience will be
determined on an individual basis. That experience which is
limited to the enforcement of the Uniform Code of Military
Justice is not acceptable as being the equivalent experience
of a federal, state, county, or municipal law enforcement
officer who enforces the criminal, traffic, or highway laws of
the Federal Government or a state.
(a) Shall possess or be eligible to possess a General Certificate.
(b) Shall have satisfactorily completed six (6) semester hours of
college English or its equivalent from a college or university,
approved in accordance with Specification S-8, paragraph
(a) with at least a _2.0 grade average on a 4.0 point scale.
(Note: Equivalency will be determined in writing from the
English Department Head of the college or university
granting credit for the course)
(c) Shall have acquired the following combinations of education
and training points combined with the prescribed years of
law enforcement experience:

Significant Considerations
General Fund Operating surplus for 2015 is estimated to be
$1,600,000 after adjusting for one time transfers.
Impact of the plan on the General Fund for 2016 would be
