TREE PRESERVATION AREA MODIFICATION:
A RESOLUTION TO APPROVE A MODIFICATION TO AN EXISTING TREE PRESERVATION
AREA AT THE WALTON ARTS CENTER FOR THE PURPOSE OF INSTALLING PUBLIC ART.
WHEREAS, the City Council has the authority under § 167.04 (L)(2) of the Unified Development Code to
modify the extent and location of tree preservation areas if it is in the best interests of the City of
Fayetteville; and
WHEREAS, the City Council has determined that it is in the best interests of the City of Fayetteville to
grant the Walton Arts Center's request to modify the existing tree preservation area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves the request to modify
the tree preservation area at the Walton Arts Center identified on the map attached to this Resolution,
pursuant to § 167.04(L)(2), Tree Preservation and Protection, Unified Development Code of the Code of
Fayetteville, and authorizes the removal of two trees to allow for the installation of public art, subject to the
following conditions:
A. The Walton Arts Center shall plant six trees, the species of which shall be approved by the Urban
Forester, in the existing tree preservation area.
B. The Walton Arts Center shall adhere to standard City of Fayetteville planting detail.
C. The Walton Arts Center shall coordinate with the Urban Forester to ensure continued protection of the
existing site during construction.
D. The Walton Arts Center shall use low impact construction methods to avoid damage to the existing
trees on site.

SUBJECT: Tree Preservation Area Modification- Modification of a tree preservation
area on the Walton Art Center grounds facing N. West Avenue in order to
install public art.
RECOMMENDATION:
Staff recommends approval to modify an existing Tree Preservation Area and to approve
proposed improvements associated with the Walton Art Center Facility in the Tree Preservation
Area for the purpose of installing public art, with conditions of approval.
BACKGROUND:
A Tree Preservation Area was dedicated to meet the minimum tree preservation requirements
for the Walton Arts Center Expansion. The tree preservation area is located on the western side
of the Walton Art Center facility facing N. West Avenue (see attached easement plat). The area
is adjacent to the Grubs Patio and is a highly manicured lawn including brick walls, rose bushes,
ornamental perennials and a grove of trees. The area has served as a semi-public space since
its creation. Any modification of the established Tree Preservation Area requires City Council
approval.
DISCUSSION:
The applicant is proposing to remove one Honey Locust and one Smoke Tree in order to
construct public art including a fountain and sculpture, to relocate two existing sculptures and to
construct associated permeable brick pavers in the Tree Preservation Area. Additionally, the
applicant is proposing to plant additional perennials and install two benches.
To offset the impact of the tree removal, the applicant is proposing to mitigate with six honey
locusts, five in the proposed area and one additional tree towards Grubs. Pervious pavement
will be used to minimize the impact to the roots of the existing trees. The applicant is currently
under construction with an approved landscape plan that does not include these improvements
(see attached approved landscape plan).

Staff's opinion is that this particular tree preservation area is a well -manicured public green
space located in an urban area that serves as more of a garden park than a natural area. Tree
preservation areas are typically more natural, minimally maintained areas serving as woodlands
and are purposely not maintained to allow the forest to regenerate and evolve without
disturbance. This particular area is a highly designed and utilized greenspace that serves the
citizens as a stylized garden rather than a natural area The area has already been somewhat
impacted by the intense use by the public. Soil around tree roots has experienced compaction
from traffic and maintenance activities. Staff agrees with the applicant and allowing the
proposed trees to be removed and other improvements to be made along with the proposed
mitigation will continue with the spirit and tradition of the designed garden next to the Walton Art
Center in this urban area.
Conditions of Approval:
Staff recommends in favor of the variance based on the findings discussed earlier in the
staff report, subject to the following conditions:
a., Six trees to be planted in the existing tree preservation area; species subject to
staff approval.
b. The applicant adhere to standard City of Fayetteville planting detail.
c. The applicant will coordinate with Urban Forestry to ensure continued protection
of the existing site during construction.
d. The applicant will use low impact construction methods to avoid damage to the
existing trees on site.

None.
