BACKGROUND: Construction has started on the Cato Springs Trail which will extend approximately 2.7 miles south from the Town Branch Trail from Greathouse Park southwest along the Cato Springs Branch to the Fayetteville Regional Park and Kessler Mountain. A portion of the Cato Springs Trail must cross undeveloped streamside property owned by Home Team, LLC and the owner is interested donating the property in addition to dedicating a multi -use trail easement for the Cato Springs Trail. In April of 2016, the owner sold a multi -use trail easement on the southwest corner of this parcel to the City of Fayetteville for $2,500 allowing construction of the Cato Springs Trail to begin. DISCUSSION: The owner of Home Team, LLC would like to donate the 1.5 acre parcel number 765-28586-000 to the City of Fayetteville also known as lot 32 of The Bungalows at Cato Springs. This parcel is composed primarily of the Cato Springs Branch and adjacent streambank and is completely covered by a drainage easement. When the Bungalows at Cato Springs development was reviewed by planning staff, the intent was to dedicate this parcel as tree preservation, trails and park space. This dedication did not occur with the development, so the owner would now like to donate the parcel to the City. The City will be responsible for the creation of the warranty deed document and the recording fees. The owner will perform an appraisal of the parcel for the purpose of claiming the land as a noncash charitable contribution. The owner has requested that this land remain as open space for at least 50 years. This land is not suitable for development and is planned to remain an open riparian zone for the Cato Springs Branch in perpetuity. Mailing Address: 113 W. The entire 1.5 acre parcel is a drainage easement that will continue to be maintained by the Transportation Services Department. The property itself can be placed in the general fund so it will not be the responsibility of a specific department.
