CITY OF 6WIleCITY COUNCIL AGENDA MEMO ay ARKANSAS MEETING OF MAY 17, 2016 TO: Mayor Jordan and Fayetteville City Council THRU: Don Marr, Chief of Staff Connie Edmonston, Parks and Recreation Director Alison Jumper, Park Planning Superintendent FROM: Ken Eastin, Park Planner DATE: April 20, 2016 SUBJECT: Recognition of Park Land Dedication Funds for Braden Park Improvements RECOMMENDATION: Staff recommends approval and recognition of Park Land Dedication Funds for Fayetteville's northeast park quadrant to be used for proposed improvements at Braden Park as a partnership match with funds donated by the Covington Park Property Owner's Association, and approval of a Budget Adjustment. BACKGROUND: The current Covington Park Property Owner's Association revised a previous 2004 agreement with Parks and Recreation in March of 2015. This revised agreement stated that the POA is interested in providing annual funding toward improvements to Braden Neighborhood Park and in working with Parks and Recreation staff to assist in cost estimating, prioritizing, and implementing projects. This agreement resulted in the construction of an entry garden in 2014 and the provision of the site with water service for irrigation. The agreement also makes provisions for continued donations from the POA, particularly regarding improvements to the existing playground. DISCUSSION: Most recently, Parks has been contacted by the POA with an offer to improve and expand the existing playground. The POA has offered to pay for the purchase and installation of a new modular play structure and a new two -bay swing set, valued at approximately $20,000. The new modular play structure is proposed to be erected at the POA's expense within an existing concrete -curbed area containing an existing climbing structure and engineered wood fiber safety play surfacing. The POA requested that Parks staff remove the existing climber (planned for reuse in another park) so that the modular structure can be installed in its place. This play area is immediately adjacent to another existing small sand covered play area with a smaller climbing structure for toddlers. This smaller structure is popular with resident children and they have requested it remain in place. Mailing Address: 113 W. This purchase will include two belt swings and two toddler swings, plus impact mats beneath the belt swings and all necessary hardware for use. In conjunction with this offer, the POA has requested that Parks remove two or three small trees, excavate the soil within the proposed swing play area, purchase and install a gravel base for drainage, add additional engineered wood fiber for safety surfacing, and install approximately 100 feet of concrete curb to contain the wood fiber. This request was made by Dani Dingman, POA representative, to the Parks and Recreation Advisory Board at the scheduled meeting of April 4, 2016. The Board voted unanimously to accept this offer and commit to the City's involvement, as shown on the attachment, "Commitments of City and POA". BUDGET/STAFF IMPACT: The estimated budget for the City's commitment is $6,990 in which the tree removal and excavation of the swing area is planned to be accomplished by park maintenance crews at an estimated cost of $1,965. The cash outlay would total $5,025 to cover installation of the concrete curb (estimated at $30/foot for a total of $3,000), the purchase and installation of the gravel subbase and Geo Fabric (estimated at $775), and the purchase and installation of the engineered wood fiber surfacing (estimated at $1,250). The request for the budget adjustment will recognize funds received from parkland dedication (PLD) (Chapter 166.04 (B)) for the NE quadrant in the amount of $3,723. The difference in this PLD balance of $3,723 and the expected budget need of $5,025 is $1,302. This difference will come from the savings of previous PLD funds remaining from another project. These extra funds will be transferred through an administrative budget adjustment to make up the additional $1,302. The City of Fayetteville Parks and Recreation Department shall assist Covington Park POA in creating cost estimates for improvements including but not limited to: installation of a planting bed at the park entry including irrigation; improvements or additions to the play equipment; and construction of a common meeting space which may include a fire pit and/or a pavilion. 3. The Covington Park POA shall provide a prioritized list of improvements to the City of Fayetteville Parks and Recreation Department based on the POA's available funding. 4. All maintenance plans and proposed improvements shall be reviewed and approved by the City of Fayetteville's Parks and Recreation staff. All improvements provided in the park shall become property of the City of Fayetteville. 5. The Covington Park POA shall provide funding for the installation of an irrigation system at the park entry including City of Fayetteville impact fees and required back flow prevention. The irrigation system shall be the responsibility of and shall be maintained by the Covington Park POA. The Covington Park POA shall open a City water account in its name, and shall be solely responsible for the payment of all water bills. 6. The Covington Park POA shall supply all plants, materials, and labor for the park entry planting bed, subject to the approval of the City of Fayetteville. 7. The Covington Park POA shall maintain the park entry to present a neat and orderly appearance at all times. The Covington Park POA shall provide a maintenance schedule, to include weed control methods, timing and schedules to Park staff. The Covington Park POA shall strictly comply with the City of Fayetteville's vegetation management policy, and report any weed control difficulties to the City of Fayetteville's Park staff for review and advisement. The Covington Park -POA shall document all volunteer work and submit such documentation to the City of Fayetteville's Parks and Recreation Volunteer Coordinator no later than the last business day of each month. 9. If at any time the City of Fayetteville determines the Covington Park POA has failed to satisfy the terms of this agreement, it may be necessary for the City of Fayetteville to return the entry planting bed area to a grass area so as not to increase the level of maintenance required for a typical neighborhood park. 10, The Covington Park POA may not remove, prune or otherwise alter any tree on the park property without approval by Park staff. 11. Braden Park is a public park and as such, shall remain open to the public as regulated by ordinance. 12. It is agreed that the failure of the City to invoke any of the available remedies under this agreement or under law in the event of one or more breaches or defaults by the Covington Park POA under the agreement shall not be construed as a waiver of such provisions and conditions and shall not prevent the City from invoking such remedies in the event of any future breach or default. 13. Each paragraph of this agreement is severable from all other paragraphs. In the event any court of competent jurisdiction determines that any paragraph or subparagraph is invalid or unenforceable for any reason, all remaining paragraphs and subparagraphs will remain in full force and effect. 14. This agreement shall be interpreted according to and enforced under the laws of the State of Arkansas. 15. This agreement contains the entire agreement of both parties hereto, and no other oral or written agreement shall be binding on the parties hereto. This agreement supersedes all prior agreements, contracts and understandings of any kind between the parties relating to the subject matter hereof. This agreement may be executed in all or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Dingman proposed adding a small modular unit with double slides and additional play features attached. This unit would go into an existing play area. They are also requesting a new swing set. Dingman added the current climbing structure is not being utilized nor considered safe by park users. They are proposing to remove this component and replace it with something more age appropriate and safer. Eastin added the city would be responsible for adding the 100 feet of concrete curb and removing existing play equipment. There is also a small boulder that may need to be relocated within the park. The cost to the city would be around $5,000. Edmonston added there are available funds within the park quadrant budget that could cover the department's financial portion of this project. Staff is recommending to utilize these funds. PRAB Motion: Maxwell motioned to approve the proposal, McKnight seconded the motion. Motion passed 8-0-0. Mailing Address: 113 W.
