Section 1. That the City Council of the City of Fayetteville, Arkansas hereby awards Bid No. 15-63 and
authorizes the Mayor to sign a contract with Modern Control Access, Inc. for the construction of security
fencing, gates and gate controls at the Police Department parking lot at the southeast corner of South Block
Avenue and West Rock Street in the amount of $66,970.00 and further approves a 10% project contingency
in the amount of $6,697.00.

SUBJECT: FPD Parking Lot Security Fence
RECOMMENDATION:
Staff recommends approval and award of formal bid number 15-63 to Modern Control
Access, Inc. for the construction of a security fence, gates, and gate controls at the Police
Department parking lot located at the southeast corner of South Block Avenue and West Rock
Street in the amount of $66,970 plus 10% contingency. If you have any question, please

BACKGROUND:
The Police Department is in need of a secure lot adjacent to our building for the parking
and storage of department vehicles, trailers and other equipment. Our parking lot on the
southeast corner of Block Ave and Rock Street is currently unsecured and completely open to
vehicular and pedestrian traffic.
Most of the additional vehicles and trailers have been housed in a secure lot at the City
Shop. Access to our vehicles at the City Shop takes extra time and in some cases, additional
personnel to shuttle vehicles back and forth. In addition, this lot is also used for the storage of
seized and evidentiary vehicles. Due to our accreditation requirements, access to evidentiary
items must be limited to only those personnel assigned to Property/Evidence. To meet this
standard would require us to relocate non -evidentiary items to another location.
DISCUSSION:
We have consulted with the Planning, Engineering and Purchasing Divisions to insure
that all applicable policies and procedures were followed in the planning of this project. The
Planning Commission approved a variance (VAR 15-5091) for the fence height, and City
Engineering provided design and approval of fencing project. The Purchasing Division
advertised and obtained formal bids for the construction of this fencing project.
BUDGET/STAFF IMPACT:
Funding for this project is budgeted within IRS/Treasury Forfeitures project, and no
staffing impact is required.

and Modem Control Access, lnc. ln consideratíon of the mutual covenants contained herein, the partíes agree as follows:
L Modem Control Access. lnc. at its own cost and expense shall furnìsh all labor, materials, supplies, machinery,
equipment, tools, supervision, bonds, insurance, tax perm¡ts, and all other accessories and services necessary to
complete items bid per Bid 15-63 as stated in Modern Control Access, lnc. bid proposal, and in accordance with
specifications attached hereto and made a part hereof under Bid 15-63, all included herein as if spelled out word
for word.
The Cìty of Fayetteville shall pay Modern C¡ntrol Access. lnc. based on their bid proposal in an amount not to exceed
S66.97q. Payments will be made after approval and acceptance of work and submission of invoice. payments will
be made approximately 30 days after receipt of invoice.
The Contract documents which comprise the contract between the City of Fayettevílle and Modern Control Access,
lnc. consist of this Contract and the following documents attached hereto, and made a par-t hereof:
A. Bid form identified as lnvitation to Bid 15-63 with the specifications and conditions typed thereon.
B. Modern ControlAccess. 14ç. bid proposal.
C. The Notice to prospective Bidders and the Bid Tabulation.
These Contract documents constitute the entire agreement between the City of Fayetteville and Modern Control
Access, lnc. and may be modified only by a duly executed written instrument signed by the City of Fayetteville anJ
Modem Control Access. lnc.
Modern Contr.ol Access. lnc. shall not assign its duties under the terms of th¡s agreement.
Modern Control Access, lnc. agrees to hold the city of Fayetteville harmless and indemnify the city of Fayetteville,
against any and all claims for property damage, personal injury or death, arising from Modern Control Access, lnc.
performance of this contract. This clause shall not Ìn any form or manner be construed to waive that tort immunity
set forth under Arkansas Law.
7 . Modern Control Access, lnc. shall furnish a certificate of insura nce addressed to the City of Fayetteville, showing
that he carries the followlng insurance which shall be maintained throughout the term of the Contract. Any work
sublet, the contractor shall require the subcontractor similarly to provide worker's compensation insurance. ln
case âny employee engaged in work on the project under this contract is not protected under Worker's
Compensation lnsurance, Modern Control.Access. lnc. shall provide and shall cause each Subcontractor to provide
adequate employer's liability insurance for the protection of such of his employees as are not otherwise protected.
