RECOMMENDATION: Parks and Recreation Staff recommends approval of a resolution awarding the Lake Fayetteville Boat Dock Operator contract to Alvaro Perea in the amount of $40,188. BACKGROUND: The City contracts the operation of the Lake Fayetteville boat dock and marina. The contractor is responsible for the day to day operation of the marina which includes opening and closing at sunrise and sunset, renting boat stalls, and selling permits for fishing and boating. Additional responsibilities include maintaining the grounds and selling concessions and related fishing supplies. The existing contract with Dollie Black was approved in 2010 and allowed five (5) automatic renewals for one year each. The existing contract expires December 31, 2015. On October 21, 2015, a Request for Proposal was issued for the Lake Fayetteville Boat Dock Operator. Two proposals were received and reviewed by a Selection Committee according to the Professional Selection Policy. Proposals were received from Dollie Black and Alvaro Perea. The candidates were interviewed by the selection committee and evaluated on five categories that include: 1) Qualifications in relation to specific project to be performed, 2) Experience, competence, and capacity for performance, 3) Proposed method of doing work, 4) Past performance, and 5) Price. The criteria was weighted with proposed method of doing work weighted the highest and past performance and price weighted the lowest. Al Perea was unanimously voted as the top candidate by the committee. DISCUSSION: Dollie and/or Jim Black operated the Boat Dock at Lake Fayetteville for the last 26 years. During this time, Lake Fayetteville has drastically changed. With the addition of the paved trail system including the Razorback Greenway and the upgrades to the nature trail, usage of the park has exponentially increased with an average of 850 trail users per day during the summer. Also, usage of the lake by the Rowing Club of Northwest Arkansas as well as Parks' Outdoor Adventure Camps has brought a new clientele to the lake in addition to fisherman. The selection committee wanted the Lake Fayetteville Marina to reflect these changes and provide more services and options than currently provided. It was agreed upon that Alvaro Perea's Mailing Address: 113 W. Mountain Street www.fayetteville-ar.gov Fayetteville, AR 72701 proposal contained elements that capitalized on the increased and varied usage that now exists at the Lake. Examples of proposed services offered are bike rentals, canoe and paddle boat rentals, concessions for lake and trail users, and sale of bait and tackle for fisherman. ln addition, Mr. Perea's proposal included maintaining the grounds within the Marina and working with Parks Staff to make cosmetic upgrades to the Marina Office. Mr. Perea's background and experience qualifies him well for these proposed changes. BUDGET/STAFF IMPACT: The 2016 Budget approved by Council has $40,188 budgeted for the Lake Fayetteville Boat Dock Operator. Mr. Perea's bid was for $43,907 but after negotiating, Mr. Perea agreed to the budgeted amount of $40,188 with an annual increase of 3o/o pending Council approval of the annual budget. Eíther party may cancelthis contract bygiving the other party sixty (60) calendar day's written notice of cancellation. The Contractor further certifies possession of the initial capital monies to commence boat dock operations. Contractor shall operate and manage the Lake Fayetteville Boat Dock. Contractor shall be an independent contractor not an employee of the City. The Lake Fayetteville Boat Dock is closed each year on Thanksgiving Day and from December 24, through January 14. The operator is responsible for supervisíng the boat dock durlng this time. For the total amount of S 40,188 to be paid in monthly installments, Contractor agrees to provide the list of servjces and requirements to the City of Fayetteville beginning January 1, 2076 and ending December 31, 2016, Contractor shalf open and close the lake gates seven days a week at Sunrise and Sunset. Contractor shall prepare reports and keep records as requíred by the Parks and Recreatlon Director" L Contractor shall enforce lake rules and regulatlons as adopted by the Fayetteville Code of Ordinance Chapter 97, Section 97.07O and 97.999, Contractor ls to act in the best interest of city property or public safety in response to ordinance violations. 9. Contractor shall províde proof of liability insurance as dlrected and listed in the RFP. Premlums for these policlesshallbepaidbyContractor. Foranyworksubcontracted,Contractorshallrequirethesubcontractor slmilarly to provide worker's compensat¡on insurance. ln case any employee engaged in work on the project under this contract ¡s not protected under Worker's Compensation lnsurance, Contractor shall provlde and shall cause each Subcontractor to provlde adeguate employer's liabflity Ínsurance for the protect¡on of such of his employees as are not othen¡ylse protected. The premíurns for all insurance and the bond required herein shall be paid bythe Contractor. 10. Contractor shall provide a S5,@0 bond for performance and payment of ltems in relation to this contract. 11. Contractor shall receive prior approval from the Parks and ßecreation Director for any special event conducted at Lake Fayetteville. 12. Contractor shall mow and manicure wlthin the secured confines of the lake Fayetteville Boat dock area. Grounds must be maintained according to park standards. Contractor shall provide all equipment necessary for the maintenance ofthese grounds. 13. Contractor shall plck up trash and clean the offlce, patlo area and office restroom on a daily basis, Contractor is to supply cleanlng and restroom supplles for the office. The outdoor publíc restroorn which is a free standing buílding will be cleaned by park staff. Contractor shall keep the boat docks swept and tidy, free of cob webs, wasp nests, and similar pests. 14. Contractor shall attend a citi¿en service workshop administered by the Parks and Recreation Department and adhere to the public relation pollcies and procedures. 15. Contractor shall conduct the following at the Lake Fayetteville Boat Dock: a. Sell concessions in compliance with all applicable State and Federal Laws, Municipal Ordinances, Health Department Regulat¡ons and the rules and regulations of all authorities having jurisdlction over the performance of this project. b. Sell related fishing equipment and supplíes. c, Provide other services which the Park and Recreation Director determlnes will enhance the operation of Lake Fayetteville Park. All appliances and amenitles related to the sale of equipment and supplies shall be provided by the contractor. 16. Contractor is not required to live on the premises, but if desired will be granted a temporary license to placl and maintain a mobile home ín the deslgnated Lake Fayettevílle Boat Dock area. Mobile homes style, condition, and loc¡tion site shall be appràved in advance of such by the Park and Recreation Dírector' Mobile home shall be structurally sound and skirting shall be installed ar:ound the perimeter' a. Contractor agrees to accept financial responsibility for the electric and natural gas at the mobile home site. ln exchange therefore, the Clty of Fayettevílle ágrees to be responsible for the municipal water account at the site. City will be responsibf'e for the tetephone utillties at the boat dock office and the Contractor will be responsíble for the telephone utilities at the mobile home. b. Contractor agrees to maintain the mobile home and the grounds adjacent to the residence in good and orderly ãpp..rrn.", to include grass, shrubs, and trees; place all rash or refuse in appropriate containers; and assíst in monitoring the property and improvements owned by the Clty of Fayetteville. c. Contractor understands and agrees that he/she must recelve Parks and Recreation Departrnent staff approval prior to making any improvements to the site, including but not limited to the constructíon, installation, or pfacement of fencíng, storage buíldlngs, or other facilities' Outdoor storage of any personal property must be pre-approved by the Park and Recreatíon Director. d. Contractor understands and agrees that he/she shall be solely responsible for insuring all personal property against any damage or loss whatsoever, and that nothing hereín shall be construed to alter, limit or otherwise compromise that f mmunity afforded the City of Fayetteville under the Constitution and Statutes of the State of Arkansas. e. Contractor understands and agrees that the property shall be used for residential purposes only' f, Contractor hereby agrees that upon termination of the Operating Contract for Lake Fayetteville Boat Dock by expiration or by earlier termination for any reason whatsoever, contractor will peacefully deliver possession of the premises to the Cíty of Fayetteville, and remove his/her mobile home forthwíth, ln the event it should become necessary for the City of Fayetteville to institute any actíon of law to recover possession at the time of termination, whenever and however termination may occur, Contractor agrees that he/she will pay all costs and expenses of such action, including reasonable attorneYs' fees. g. Contractor agrees not to violate any law, ordínance, rule or regulation of any government authority having jurisdiction over the premises. L7. tt is agreed that the failure of the City of Fayetteville to ¡nvoke any of the available remedies under this agreêment or under lay in the event of one or more breaches or defaults by contractor under the alreement shall not be construed as a waiver of such provisions and conditions and shall not prevent the CitV of Fayettevílle from invoking such remedies in the event of any future breach or default. 1g. Each paragraph in this agreement ís severable from all other paragraphs. ln the event any court of competent jurlsdiction determinesthat any paragraph or subparagraph is invalid or unenforceable forany reason, all remalníng paragraphs and subparagraphs will remain in full force and effect. lg, Contractor shall not act as a broker or facilitate sales of boats. 20. The initial term of the contract shall be for one (1)year. We live very close to the Marina and can hear the bell ring everyday. We believe that Lake Fayetteville is an important part of the comrnunity in attracting citizens and tourists. Growing up and living on the water most of my life, I understand the importance of safety and diligence conceming boating and water activities. My Grandfathet owned several shrimp and oyster boats in South Louisiana where I would spend my surnmers worHng as a kid. In the past, I have worked as a beach and pool lifeguard, and as an Emergency Medical Technician. I've also worked as a boat dock assistant and parasail boat deckhand in Destin, Florida, at Boogies Watersport Rent¿ls. I love the water and have owned (and been around) boats all of my life. Currently, my wife and I are both employed at HealthSouth as Physical Therapists. She works part-time and I work PRN (as needed). I also buy, fltx, and sell houses. I began flipping houses in ÞT school when I bought and sold the house I was living in. I have family in construction and worked for a homebuilder in the past, so doing the work myself came natural. I have turned over scveral properties in Northwest Arkansas since moving here in 2010. Also, we realize the importance of being organized to run a successful organization. My parents will be a part of the team helping to maintain and operate the boat dock. They both recently retired and moved here from Houma, Louisiana. My mom was an educator/counselor for over 30 years. She is also a Christian Counselor. My dad was a grocery store manager for most of hís life. They are both gregarious and love to listen and talk. They also live near the marina. 3. Please explain your plans and methods for managing the boat docks. We plan on managing the boat docks with safety and customer service as the main priority. 'We will welcome and get to know cvery customer while maintaining a professional demeanor. We will set up systems to ensure smooth operation. We will clean daily and maintain a very neat facility. Keeping a clean and organized surrounding is essential to having a healthy mind, body, and spirit. We will use checklist to ensure daily maintenânces are performed. We will use a cash register and receipt book and keep records according to the city's requirements. We will break up the daily work shifts depending on the hours we prefer. We will have the required insurance for every employee. Every employee will wear a collared shirt with the Lake Fayetteville Marina logo. Each employee will have a friendly professional personality. Since we live so close, there will always be somebody on call nearby who can quickly come assist the dock operator. 4. Providing the highest level of services to our citizens is very important. How would you respond to customer concerns regarding operations of the lake? IVe will communicate very well with the city and manage the dock with the highest of standards. Keeping our customers happy is the reason we are here and will be top priority. When a customer has a concern, \rye will do our best to make it better. If the concern is beyond our control and authority, we will present it to the proper level of authority. We will be sure to communicate with the customer that we care, and are working quick to find a solution. 5. You are required to keep fìinancial rccords and reports. What experiences have you had in keeping accurate records and reports? My undergraduate degree is in business administration. I've taken several courses in finances, accounting, and computing. I have put them to use when owning and rururing my businesses. I used QuickBooks as my rnain accounting software. Also, working as a Physical Therapist requires me to keep accurate reports and documentation. 6. This contract requires liability insurance coverage and a $1,000 bond for performance. Could you have these in order within ten (10) business days from notice of award? Yes, not a problem. 7. It is not a requirement that you live Ín a trailer at Lake Fayetteville; however, what are your intensions in relation to this option? We do have a travel trailer that we can park at the dock if encouraged by the city to do so for security purposes but we do not intend to stay there. I would like to install video surveillance cameras, with DVR recording and live web viewing, near the docks and around the dock house. I install security cameras and motion sensing lights on all my real estate investments, and would like to do so at the marina, 8. What other services, if any, would you be interested in providing to park patrons at Lake Fayetteville? Northwest Arkansas is becoming known as having some of the best outdoor activities in the country. We think Lake Fayetteville can offer a little more to its, park patrons by offering pedal boat and kayak rentals. We'd also like to rent row bikes, elliptical bikes, recumbent bikes, and surrey bikes. We would like to improve the concessions by offering a better and healthier selection of snacks. We are flexible and willing to offer more if anyone has good ideas and suggestions that the city would like to implement. 9. Are there any questions you might have on the list of contracted services and requirements? If awarded the contract, we want to refresh the interior of the "boat house" by painting the walls, replacing countertops, and kitchen /bath fixtures. BACKGROUND: The City contracts the operation of the Lake Fayetteville and Lake Sequoyah boat dock and marina. The contractor is responsible for the day to day operation of the marina which includes opening and closing at sunrise and sunset, renting boat stalls, and selling permits for fishing and boating. Additional responsibilities include maintaining the grounds and selling concessions and related fishing supplies. As noted at Agenda Session, the contractor submits the revenue collected from boat stall rentals, daily and season permits to the City. Operations at the two lakes are similar with the exception that Lake Sequoyah does not have boat stalls available for rent. Fees charged for boat stall rentals, fishing, and boating help offset the cost of opefating the lakes. These expenses are reflected in the Park Staff Salary. Lake Fayetteville receipts are $32,492 with expenses of $52,350 for a net cost of $19,858. Lake Sequoyah receipts are $1 8,246 with expenses of $32,1 50 for a net cost of $13,904. Any revenue collected by the contractor through selling bait and tackle, concessions, canoe rentals, etc. is kept by the contractor. The current contractor at Lake Fayetteville, has not offered bait or tackle for the last several years so no information is available. The contractor at Lake Sequoyah stated he makes approximately $3,000 per year on selling bait and tackle and renting canoes. Opportunity exists at Lake Fayetteville to not only sell bait and tackle to fisherman, but also rent canoes, kayaks, paddle boats, etc. Also, with the proximity to the trail, opportunity exists to rent bikes. This is a major reason that Alvaro Perea's bid for the contractor job was chosen since he proposes to offer these options to park users and thereby increase the range of services offered to park patrons. At this time there is no data to indicate what that earning potential might be.
