NORTHWEST ARKANSAS MULTI -JURISDICTIONAL WATER QUALITY COMPLIANCE
ASSOCIATION:
A RESOLUTION TO EXPRESS THE CITY COUNCIL'S INTENT TO PARTICIPATE IN
COOPERATIVE REGIONAL EFFORTS TO EVALUATE THE POTENTIAL COST SAVINGS AND
ENVIRONMENTAL BENEFITS THAT MAY BE AVAILABLE TO THE CITY OF FAYETTEVILLE
THROUGH THE FORMATION OF A NORTHWEST ARKANSAS MULTI -JURISDICTIONAL WATER
QUALITY COMPLIANCE ASSOCIATION
WHEREAS, Act 335 of 2015 authorizes the Arkansas Pollution Control & Ecology Commission to
promulgate regulations establishing nutrient water quality trading programs, including the formation of water
quality compliance associations; and
WHEREAS, the timely development and implementation of nutrient water quality trading programs may
provide significant long term savings and environmental benefits for the communities in Northwest Arkansas
including, but not limited to, the cities of Fayetteville, Springdale, Rogers, and Bentonville.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby expresses its intent to explore the
potential cost savings and environmental benefits that may be available to the City of Fayetteville through the
formation of a Northwest Arkansas multi- jurisdictional water quality compliance association and authorizes the
Mayor to negotiate and present a proposed agreement for the City Council's consideration that defines the
mission of such an association, the responsibilities of the parties to the agreement, and the anticipated costs.

SUBJECT: Resolution authorizing the Mayor to express the City's intent for participation in
cooperative regional efforts to evaluate, and to report, the potential cost savings
and environmental benefits that may be available to Northwest Arkansas through
the formation of a multi -jurisdictional water quality compliance association and
other nutrient water quality trading programs.
RECOMMENDATION:
Fayetteville City Administration recommends approval of a resolution that authorizes the Mayor,
or a designee appointed by the Mayor, to represent the City on all matters associated with the
possible formation and operation of a multi -jurisdictional association to participate in nutrient
trading programs.
BACKGROUND:
Act 335 of 2015 authorizes the Arkansas Pollution Control and Ecology Commission to
promulgate regulations establishing nutrient water quality trading programs, including the
formation of water quality compliance associations. The timely development of these water
quality trading programs may provide significant long-term savings and environmental benefits
for the communities in Northwest Arkansas. There currently are not any entity or group formed
to undertake the effort to assist in developing draft regulations establishing nutrient water quality
trading programs that would be necessary to benefit Northwest Arkansas communities. In the
interest of economy and efficiency, a cooperative regional approach to understanding the
issues, the potential impact and effects, and collectively responding to proposed changes is
desirable.
DISCUSSION:
This resolution would give the Mayor the authorization to express the City's intent to consider
entering into a cooperative agreement that may include, but not be limited to, the cities of
Fayetteville, Springdale, Rogers, and Bentonville -all of whom would be affected by the
establishment of certain TMDL's for nutrient loads in receiving streams, and the likely imposition
of substantially more stringent wastewater discharge limitations. The participation in cooperative
regional efforts regarding these matters would be through the Northwest Arkansas Regional
Planning Commission which was established by Fayetteville, Springdale, Rogers, and
Bentonville, along with Benton and Washington County, to provide a forum for regional
dialogue, intergovernmental cooperation, and to address regional issues.

been, there will be a contract submitted for review by City Council.
