CITYCOUNCIL AGENDA MEMO
AS
MEETING OF JULY 21, 2015
TO: Mayor and City Council
FROM: Mike Reynolds, Deputy Chief of Police
DATE: June 22, 2015
SUBJECT: Law Enforcement Forfeitures for Fayetteville Police Department
RECOMMENDATION:
Staff recommends approval of a budget adjustment in the amount of $100,993 to
recognize revenue associated with law enforcement forfeitures, proceeds from sale on Gov
Deals.com, and increase corresponding expense budgets.
BACKGROUND:
The Fayetteville Police Department receives forfeitures as a result of civil proceedings
concerning cash or property seized during a criminal investigation. Most of the forfeitures we
have received in the past are a direct result from the efforts of the officers we assign to the 4th
Judicial District Drug Task Force (4th DTF), the local office of the Federal Drug Enforcement
Agency (DEA), and the Internal Revenue Service (IRS) Financial Crimes Task Force. By
statute, federal and state forfeitures are to be spent for law enforcement purposes only. All
purchases utilizing these funds must follow the City of Fayetteville Purchasing Policy.
DISCUSSION:
Funds within this budget adjustment consist of Department of Justice funds which are
drug related federal forfeitures, Department of Treasury funds which are Internal Revenue
Service related forfeitures, State Asset Forfeiture funds which are drug related state forfeitures,
and the reimbursement of expenses used to purchase unit # 1284 due to the salvage sale of
unit #1236 via GovDeals.com. The requested budget adjustment will recognize the following
forfeitures and proceeds through May 2015: $24,735 from the Department of Justice; $25,429
from Department of Treasury; $25,153 from State Asset Forfeitures; and $12,838 from proceeds
from the sale of unit # 1236.
BUDGET/STAFF IMPACT:
Our expense budget will increase equal to the revenue received through May 2015.
There is no staffing impact related to this budget adjustment.
