BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves
Amendment No. 2 to the Memorandum of Understanding with the Watershed Conservation
Resource Center in an amount not to exceed $6,020.00, a copy of which is attached to this
Resolution, to for enhancement of the Niokaska Creek in Sweetbriar Park, monitoring of bank
erosion, and repairs to rock structures constructed as part of the original stream restoration
project.

RECOMMENDATION:
Parks and Recreation staff recommends approval of Amendment No. 2 to Ordinance No. 5268 with
the Watershed Conservation Resource Center resulting in an increase of $6,020.
BACKGROUND:
Sweetbriar Park contains 4.05 acres and is located at 2636 E. Sweetbriar Drive. The park is situated in
the northeast quadrant of town east of Old Missouri Road and south of Joyce Boulevard. Niokaska
Creek, a tributary to Mud Creek, flows through Sweetbriar Park. The creek is located within the Illinois
River Watershed.
On September 1, 2009, the City Council passed Ordinance Number 5268 approving a Memorandum of
Understanding (MOU) with the Watershed Conservation Resource Center to restore an approximately
1,600 -foot section of Niokaska Creek that was incised and had several banks eroding into the park land
and surrounding residential yards using natural channel design principles (see attached ordinance). A
portion of the project was funded by an EPA Region 6 Wetlands Program Development Grant in the
amount of $234,000. The grant is utilized for projects promoting research, training, demonstrations, and
surveys relating to the causes, effects, extent, prevention, reduction, and elimination of water pollution.
DISCUSSION:
Staff is requesting approval of Amendment No. 2 pursuant to the Memorandum of
Understanding (MOU) as described in Ordinance No. 5268 with the Watershed Conservation
Resource Center. This amendment includes establishing native vegetation, removal of invasive
species and planting additional native plants on an existing floodplain within Sweetbriar Park.
Also included are monitoring of bank erosion and hand repairs and enhancements to rock
structures constructed as part of the original project.

After the catostrophic flooding in 2011, WCRC and city staff determined there was a need to
enhance existing floodplain along the project to provide additional roughness to help dissipate
energy during larger flood events. An approximately 5,000 square foot area located within
Sweetbriar Park provided the perfect setting. One of the challenges in designing natural channel
stream restoration projects is the ability to tie into the existing landscape. The stream restoration
project is improved by enhancing the existing floodplain within the park. Additional benefits
include demonstrating the use of additional riparian area along streams on city property as
encouraged by the city's streamside protection ordinance, as well as, reducing the amount of
park land requiring mowing and maintenance.
Ongoing erosion monitoring is required to demonstrate the effectiveness of the project in
preventing streambank erosion. The need to make immediate hand repairs and enhancements
to rock structures was revealed during inspections of the project after recent storm events.
These repairs and enhancements help to facilitate the Tong -term effectiveness of the restoration
project.
An additional cost of $6,020 is incurred for the additional work.
BUDGET/STAFF IMPACT:
This project is funded with Sales Tax funds in project 02045.9025 - Niokaska Creek Stream
Restoration Demonstration. Adequate funds are available in the project for Amendment No. 2.

AN ORDINANCE WAIVING THE REQUIREMENTS OF FORMAL
COMPETITIVE BIDDING AND APPROVING A MEMORANDUM OF
UNDERSTANDING WITH THE WATERSHED CONSERVATION
RESOURCE CENTER (WCRC) IN THE AMOUNT OF $188,000.00 FOR A
STREAM RESTORATION DEMONSTRATION PROJECT ON NIOKASKA
CREEK THROUGH SWEETBRIAR PARK.
WHEREAS, the Watershed Conservation Resource Center possesses unique expertise
and resources ideally suited to meet the City of Fayetteville's need for stream restoration as part
of the Stormwater Phase II permit requirements; and
WHEREAS, the Watershed Conservation Resource Center can perform this work at a
significant savings to the citizens of Fayetteville.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby determines
an exceptional situation exists in which competitive bidding is deemed not feasible or practical
and therefore waives the requirements of formal competitive bidding and approves a
Memorandum of Understanding (marked as Exhibit "A" attached hereto and made a part hereof)
between the City of Fayetteville, Arkansas and the Watershed Conservation Resource Center
(WCRC) in the amount of $188,000.00 for a Stream Restoration Demonstration Project on
Niokaska Creek through Sweetbriar Park.

AMENDMENT NO. 2
ONGOING ESTABLISHMENT OF NIOKASKA STREAM RESTORATION
PROJECT IN SWEETBRIAR PARK
STATE OF ARKANSAS
COUNTY OF WASHINGTON
This Amendment is written pursuant to the Memorandum of Understanding (MOU) as
described in Ordinance No. 5268 executed on September 1, 2009. The referenced MOU
pertains to a stream restoration project and associated services with the Watershed
Conservation Resource Center (WCRC) for the Niokaska Stream Restoration in Sweetbriar
Park. This Amendment entered into and executed on the date indicated below the signature
block by and between the City of Fayetteville and the Watershed Conservation Resource
Center sets forth the project description, project schedule and associated fees for these
services related to the ongoing establishment of the Niokaska Stream Restoration Project
located in Sweetbriar Park.
Section I - Project Description
This project consists of continued ongoing efforts to establish the stream restoration project
along a section of Niokaska Creek in Sweetbriar Park and surrounding properties. WCRC
originally designed the project and performed the construction observation working closely
with the contractors. Since implementation, the WCRC has continued to work towards
establishing a restoration project that willbe better able to withstand future flood events.
The project currently is effective in protecting city park property, however, as with any
stream restoration project, establishment of a vigorous stand of native vegetation is
essential to creating a long-lasting and effective project. This amendment will help to
facilitate continuation of the establishment efforts that are needed for this project.
Section II - Project Timeframe
Establishing native vegetation, removal of invasive species and planting additional native plants
on an approxiamtely 5,000 square foot existing floodplain within Sweetbriar Park has been
completed. The ongoing erosion monitoring and hand repairs and enhancements to rock
structures will be completed within 60 days following City Council approval and receipt of the
Notice to Proceed.
Section III - Scope of Services
The work conducted under this amendment includes the following activities up to the NTE
amount shown in Section IV.

Section V - Memorandum of Understanding in Effect
Except as amended specifically herein, the original Memorandum of Understanding shall
remain in full force as originally approved.
