HomeMy WebLinkAbout182-14 RESOLUTIONRESOLUTION NO. 182-14 A RESOLUTION TO APPROVE A REQUEST BY THE CITY OF FAYETTEVILLE TO MODIFY THE GEOGRAPHIC EXTENT AND LOCATION OF CERTAIN TREE PRESERVATION AREAS PURSUANT TO § 167.04(L)(2), TREE PRESERVATION AND PROTECTION, UNIFIED DEVELOPMENT CODE OF THE CODE OF FAYETTEVILLE, TO CONSTRUCT SECTIONS OF THE FRISCO AND TOWN BRANCH TRAILS BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves the request of the City of Fayetteville to modify the location of the Tree Preservation Areas at Allied Storage and at property north of 18th Street identified on the map attached hereto as Exhibit "A", pursuant to § 167.04(L)(2), Tree Preservation and Protection, Unified Development Code of the Code of Fayetteville, to construct sections of the Frisco and Town Branch Trails, subject to the following conditions: A. The City shall provide mitigation of a minimum of fifty (50) two-inch (2") caliper large tree species planted within multi -use trail easements or on City park property as directed by the Urban Forester within two years of approval of this modification and maintained to assure survival for three (3) years. Mitigation will be required at a minimum of 50 - 2" caliper large tree species with trees to be planted within multi -use trail easements or on City park property as directed by the Urban Forester. Three-year maintenance of the trees to ensure survival will also be required. BACKGROUND: A 0.8 -mile long extension of the Razorback Regional Greenway is planned to connect Walker Park to Town Branch Trail and southwest to the future Regional Park. In order to make this important connection, the trail must cross several properties including two properties with tree preservation areas. According to chapter 167.05 (B) "No filling, excavating or other land disturbance shall take place in tree preservation areas", therefore in order to construct the trail, portions of the tree preservation areas need to be modified to accommodate the trail construction. The Trails Coordinator will oversee the trail construction and coordinate with the Urban Forester to ensure sensitivity to existing canopy and will work to minimize tree removal while protecting the remaining trees within these areas. In 2007, a 3.53 -acre tree preservation area was established as part of the development approval of the Allied Storage Ltd. Co. In order to construct the extension of Frisco Trail, 2.154 acres of property will be purchased from Allied Storage including 0.55 acres of the existing tree preservation easement. This 0.55 -acre area is proposed to be excluded from the remaining tree preservation area to facilitate the trail construction (See attached Exhibit "A"). In 2001, a 3.56 -acre tree preservation area was established as part of the development approval along the north side of 18th Street and is currently owned by University of Arkansas. On September 11th, the Board of Trustees approved a 1.17 -acre multi -use trail easement including 0.26 acres of the tree preservation area. This 0.26 -acre area is proposed to be Mailing Address: 113 W. Mountain Street Fayetteville, AR 72701 www.fayetteville-ar.gov excluded from the remaining tree preservation area to facilitate the trail construction (See attached Exhibit "A"). DISCUSSION: The Fayetteville code of ordinances allows for modification of tree preservation areas in chapter 167.04 (L) (2) with the express approval of the City Council. The ordinance also says the modification should be in'the best interest of the City of Fayetteville. With the strong regional support for the Razorback Regional Greenway and emphasis on connecting trails to the new Regional Park, this section of Frisco Trail will provide a significant amenity for the citizens of Fayetteville as well as the region and would be considered in the best interest of the City. Approximately 11,002 square feet of canopy is estimated to be impacted by the trail construction in both of the tree preservation easements. Based on the formula established for mitigation trees, this results in a total of 50 mitigation trees. To provide shade along the growing trails system, these mitigation trees are proposed to be planted within multi -use trail easements or within City Parks in the southeast and southwest quadrants as directed by the Urban Forester. The trees will be planted within two years of approval of the tree preservation modification and will be maintained for three years to ensure survival. BUDGET/STAFF IMPACT: Funding for the mitigation tree planting and maintenance will be included in the project costs for the Frisco and Town Branch Trails. The extension of Frisco Trail and Town Branch Trail is fully funded through a 50:50 matching grant with The Walton Family Foundation Grant. The City portion of the matching funds are available through the Trail Development Capital Improvement Program for 2014 and 2015. Attachments: Exhibit "A" - Frisco and Town Branch Trails 2
