RECOMMENDATION:
Staff recommends approval of a contract amendment with Garver, LLC, in the not to exceed
amount of $168,600 for construction administration services on the Spring Street Parking Deck.
BACKGROUND:
A design team led by Garver, LLC was selected by a City selection committee in November,
2011 for engineering and architectural services on the Spring Street Parking Deck. Services
under this selection cover all three phases for the overall outcome of a designed parking deck in
downtown Fayetteville: Phase 1, Site Selection & Preliminary Design; Phase 2, Schematic
Design & Project Development; and Phase 3, Construction Administration Services. The
contract for Phase 1, Site Selection & Preliminary Design, was awarded on February 12, 2012.
The contract amendment for Phase 2, Schematic Design & Project Development, with the
objective of designing the structure, and performing all associated work required to develop the
design and construct the project, was approved in December 2012.
DISCUSSION:
This contract amendment with Garver will provide for construction administration services by
Garver and their subconsultants, Carl Walker Parking Consultants and and AFHJ Architects.
Services provided under this amendment will include review of construction material submittals
and other contractor/supplier submittals, design support for changes to the plans as required or
requested during construction, and periodic construction observation during the construction
period.
BUDGET/STAFF IMPACT:
Funding for this portion of the contract is coming from parking revenue bond proceeds.

This Contract Amendment No. 3, dated 0,,\-[)a9.ir '� , 2014 shall amend the original contract
between the CITY OF FAYETTEVILLE (Owner) and GARVER, LLC (Engineer), dated February 21,
2012 referred to in the following paragraphs as the original contract.
This Contract Amendment No. 3 adds additional professional services during the construction phase
of the project for the:
Construction of a Parking Deck to be located in the Downtown/Dickson Street area including the
associated liner buildings and infrastructure improvements.
The original contract is hereby modified as follows:
SECTION 5 - PAYMENTS TO GARVER
5.1 Compensation
Increase the not to exceed amount by $168,600.
EXHIBIT A - SCOPE OF SERVICES
Add Section 1.3.to the Exhibit A - Scope of Services for additional services as attached to and
made a part of this amendment.
EXHIBIT B - SUMMARY OF COSTS
Add the Exhibit B sheets attached hereto to Exhibit B contained in the original contract and

AMENDMENT NO. 3 - EXHIBIT A
DOWNTOWN PARKING DECK
SCOPE OF SERVICES
1.3 PHASE 3 — CONSTRUCTION ADMINISTRATION SERVICES
Garver will subcontract with Carl Walker, Inc. and AFHJ Architects to perform portions of the
Phase 3 services. The scope for the services for the Project Team will include:
1.3.1 Pre -Construction Services
A. Garver will Issue a Notice to Proceed letter to the Contractor.
B. Garver will provide coordination with the franchise utilities.
C. The Project Team will evaluate and respond to construction material submittals and shop
drawings. Corrections or comments made by the Project Team on the shop drawings
during this review will not relieve Contractor from compliance with requirements of the
drawings and specifications. The check will only be for review of general conformance
with the design concept of the project and general compliance with the information given
in the contract documents. The Contractor will be responsible for confirming and
correlating all quantities and dimensions, selecting fabrication processes and techniques
of construction, coordinating his work with that of all other trades, and performing his
work in a safe and satisfactory manner. The Project Team's review shall not constitute
approval of safety precautions or constitute approval of construction means, methods,
techniques, sequences, procedures, or assembly of various components. When
certification of performance characteristics of materials, systems or equipment is required
by the Contract Documents, either directly or implied for a complete and workable
system, Garver shall be entitled to rely upon such submittal or implied certification to
establish that the materials, systems or equipment will meet the performance criteria
required by the Contract Documents. One set of approved shop drawings and
construction material submittals will be prepared and delivered to the City.
1.3.2 Construction Services
A. Garver will attend progress/coordination meetings on a bi-monthly basis with the
City/Contractor.
B. The Project Team will issue instructions to the Contractor on behalf of the City and issue
necessary clarifications (respond to RFIs) regarding the construction contract documents.
C. Review of the Contractor's progress payment requests is excluded from the scope of
services.
D. Resident construction observation services for the construction are excluded from the
scope of services. Garver will provide up to 110 hours of onsite consultation on an as -
needed basis.
In performing limited construction observation services, Garver will endeavor to protect
the City against defects and deficiencies in the work of the Contractor(s); but Garver
cannot guarantee the performance of the Contractor(s), nor be responsible for the actual
supervision of construction operations or for the safety measures that the Contractor(s)

takes or should take. However, if at any time during construction Garver observes that
the Contractor's work does not comply with the construction contract documents, Garver
will notify the Contractor of such non-compliance and instruct him to correct the
deficiency and/or stop work, as appropriate for the situation. Garver will also record the
observance, the discussion, and the actions taken. If the Contractor continues without
satisfactory corrective action, Garver will notify the City immediately, so that appropriate
action under the City's contract with the Contractor can be taken.
E. As a Subconsultant to Garver, Carl Walker, Inc. will provide Specialty Services during the
construction phase for the parking garage structure as specified in the attached proposal
and as follows:
1. Material submittal reviews and response to RFIs for responsible items.
2. One concrete pre -placement meeting with the Construction Manager, concrete
sub -contractor, ready -mix supplier prior to the parking garage concrete pour.
3. Provide one on-site observation of the work to help ensure the work is being
performed in conformance with the intent of the design documents.
4. Assist in the preparation and closeout of the project punch list. This includes one
site visit to create a punch list of items related to the parking deck superstructure.
F. As a Subconsultant to Garver, AFHJ Architects, with assistance from KB Architects, will
provide Architectural services during the construction phase for the parking garage
structure and Northern Liner Building as specified in the attached proposal and as
follows:
1. Material submittal reviews and response to RFI's for responsible items.
2. Provide periodic site visits for observation of the Architectural components which
include steel screening, windows, storefronts, curtain walls, guardrails, handrails,
lighting fixtures, cement board, metal siding & flashing, concrete for screening
coordination, elevator, glazing, green screen, expansion joints, skylight, roof
hatch, metal soffit, metal roof, insulation, sheathing, paint, stair nosing, TPO
roofing, steel studs, channels, fire proofing, gypsum board, joint sealers, doors
and hardware. In addition to the site visits by AFHJ Architects, fees include three
(3) site visits from KB Architects during the construction phase.
3. Provide LEED documentation.
4. Attend coordination meetings as necessary.
5. Attend final project walkthrough and assist in the preparation of the closeout
documents and project punch list.
G. Survey crew time for field checking quantities, contractor's layout, etc. have been
excluded from the scope of services
H. When authorized by the City, the Project Team will prepare change orders for changes in
the work from that originally provided for in the construction contract documents. If
redesign or substantial engineering or surveying is required in the preparation of these
change order documents, the City will pay the Project Team an additional fee to be
agreed upon by the City and Garver.
1.3.3 Project Close -Out
A. Garver will attend and participate in the Pre -Final Inspection and the entire Project Team
will participate in the final project inspection, prepare punch list, review final project
closing documents, and review the final pay request.
B. Garver will review whether the Punch list Items have been addressed in a satisfactory
manner.

C. The Project Team will review the Contractor's As -Built drawings and transfer items to the
originals with applicable notes. One set of drawings will be provided to the City along
with the digital copy.

Carl Walker, Inc. is pleased to submit this proposal to you to provide professional Parking Facility
Design Consulting services for the above mentioned project in Fayetteville, Arkansas. Our scope
of services is described in detail below, but in general we will provide consulting services
incorporating the disciplines of Structural Engineering and Parking Consulting for this third phase
of this parking facility project, the construction phase.
As specialists in the design and construction of multi-level parking structures, we believe that our
expertise will be an asset for you and the owner in developing a user-friendly and cost-effective
parking facility. As we work through our firm's 3151 year in business, our experienced staff of
designers can proudly reflect on thousands of projects, hundreds of parking structures and
millions of parking spaces for clients nationwide.
PROJECT UNDERSTANDING
Based upon our involvement in the site selection and design phases of this project, we
understand that construction will proceed on the 236 space, 3 -level parking structure. The
construction will be of long -span post -tensioned concrete, and include cast -in-place concrete
stair and elevator towers. Additionally, the design includes an enclosed south liner building
partially within the footprint of the garage, and a partially -enclosed east liner building adjacent
to the southeast corner of the garage.
This third phase of the project will cover construction administration services for the parking
structure. We understand the City of Fayetteville has a timeline of approximately 12 months for
the construction of the parking structure immediately following design, and upon notice to
proceed given to the contractor. Length of schedule increases brought forth by parties outside
of Carl Walker, Inc.'s control, which increase the need for labor and expenses on our part
beyond the basic services included with this proposal will be subject to additional services
increases in the fee set forth in this proposal for our work.

As noted above, Carl Walker, Inc. will function as the Parking facility Design Consultant for this
new facility. In this capacity, we will provide functional and structural design consulting and
construction administration with our in-house staff. See below and attached for a detailed
Scope of Services for our work.
Not included in our scope is construction administration for other building designs (e.g. the WAC
Administration Building), architecture, geotechnical engineering, foundations (piers, piles, caps,
retaining walls, grade walls, pits) structural engineering, MEP engineering, civil engineering,
landscape architecture, surveying, street traffic engineering (roadway/intersection
improvements), traffic impact analysis, environmental, security systems, architectural graphics or
construction costing and scheduling. If necessary, we can assist in obtaining these services.

B. Respond to RFIs on work specified and/or detailed by Carl Walker, Inc.
C. Coordinate with project consultants, where necessary.
D. Attend scope related meetings during construction in conjunction with site
observation visits, if possible. Our fee covers a maximum of three (3) site visits
during construction.
E. Provide final punch list (punch list site visit is included in the above) and record
drawings for parking and structural items.
PROFESSIONAL FEES
Based upon our project understanding and the Scope of Services discussed above, we are
proposing a professional fee, on an hourly not -to -exceed basis, of $36,300. Project related
expenses such as travel, communications, delivery, reproductions, printing, etc. are not included
in this fee. We estimate project related expenses in the amount of $2,300. Expenses will be
billed in addition to our hourly not -to -exceed fee.
FEE EXCLUSIONS
Carl Walker, Inc.'s project related coordination efforts with the following tasks and consultants
are included within the proposed design fees. Costs for these Owner and Contractor provided
surveys, testing, inspections and consultants are not part of the above referenced design fees.

We anticipate that this proposal will be an addendum to the formal contract agreement
between Garver, LLC and Carl Walker, Inc. for the above mentioned project.

1. Attend pre -construction meetings as follows:
a. One (1) concrete pre -placement meeting with the General Contractor and their
concrete sub -contractor, ready -mix supplier, etc. prior to placing and finishing

2. Review appropriate shop drawings and submittals related to our scope of work.
