COVERT CELLULAR WIRE AND TWO (2) UNDERCOVER DRUG
ENFORCEMENT VEHICLES, AND APPROVING A BUDGET
ADJUSTMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes
acceptance of a non-matching Arkansas State Police Special State Asset Forfeiture Grant in the
amount of $36,069.00 for the purchase of a covert cellular wire and two (2) undercover drug
enforcement vehicles.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a
budget adjustment, a copy of which is attached to this resolution, recognizing the revenue.

Section 1: That the City Council of the City of Fayetteville, Arkansas hereby authorizes acceptance of a

for the purchase of a covert cellular wire and two (2) undercover drug enforcement vehicles.

SUBJECT: 2014 Arkansas State Police Special State Asset Forfeiture Grant Award
RECOMMENDATION:
Staff recommends approval of a grant award from the Arkansas State Police (ASP)
Special Assets Forfeiture Fund and budget adjustment in the amount of $36,069 for the
purchase of a covert cellular wire and two (2) undercover drug enforcement vehicles.
BACKGROUND:
Every two years, as funds accumulate in the Special Assets Forfeiture Fund, the
Arkansas State Police open grant opportunities for the purpose of drug enforcement to eligible
applicants. Pursuant to Arkansas Code 5-64-505(i), any money deposited into the Special
Assets Forfeiture Fund is considered federal forfeiture funds. Federal forfeiture funds have
limited uses specific to law and drug enforcement operations, and applicants must be in
compliance with the Department of Justice Equitable Sharing Program.
DISCUSSION:
These grant funds will be used to purchase a covert cellular wire and two (2) undercover
vehicles dedicated to drug enforcement activities. The purchase of a covert cellular wire will
allow investigators to conduct safer and more productive undercover narcotics purchases. This
cellular technology provides numerous technological advances over a traditional body wire that
operates utilizing radio frequencies. A traditional body wire limits the range at which officers can
listen to an ongoing covert operation. This purchase would allow numerous officers to listen to
an operation from varying distances. This creates a safer environment for undercover officers
and/or confidential informants.
Undercover vehicles are used vehicles essential to drug enforcement operations through
surveillance, purchase of evidence/information, and meeting with confidential informants. We
have found it necessary to trade our undercover vehicles every three years in order to maintain
covertness and dependability. These two vehicles will enable two member agencies of the Task
Force to trade older vehicles for newer used vehicles. The proposed $15,000 per vehicle plus
the trade-in value of existing vehicles will meet the undercover needs of our Task Force.

MEMORANDUM OF UNDERSTANDING
In accordance with Act 830 of the 2007 session of the Arkansas 86th General Assembly
the Arkansas State Police was charged with the responsibility of disbursing moneys from
the Special State Assets Forfeiture Fund and federal forfeitures.
Pursuant to the foregoing authority, the Arkansas State Police has established the Special
State Assets Forfeiture Fund Committee to award funds, which in the Committee's
opinion, will best facilitate drug enforcement operations.
In accordance with the foregoing a joint agreement between the Arkansas State Police
and the 4th Judicial District Drug Task Force is entered for a period of July 1, 2014
through May 31, 2015.
The recipient of the awarded funds agrees to maintain records and receipts for items
purchased with the grant funds and will furnish copies of all receipts to the Arkansas
State Police by the 10th day of the month following the expenditure.
Any modification or changes above 10% to the grantee's approved budget must be
authorized by the Arkansas State Police before expenditures for the changes can be made.
Any awarded funds not expended during the period set out in the preceding paragraph
and in accordance with grantee's budget or approved changes shallbe refunded to the
Arkansas State Police by 4:30 p.m. May 31' 2015.
The awarded funds are subject to audit by the Arkansas State Police and/or the
Department of Legislative Audit. All documents must be retained for a period of three (3)
years. Misuse of these funds will result in the 4th Judicial District Drug Task Force
reimbursing the Arkansas State Police for the funds awarded.
The following items will NOT be considered for funding and any funds awarded should
not be used for these items:
• Salaries, over time, fringe benefits related to salaries
• Contractual services, and travel related expenditures
• Electronic Immobilization Devices
• Drug Court Programs
• Real Estate
■ Vessel or Aircraft
• Construction Projects
■ Buy Money
This MOU shall remain in full force and effect beginning on the date of signature and
continuing for the duration of the current agreement period.
