A RESOLUTION TO APPROVE A BUDGET ADJUSTMENT IN THE TOTAL
AMOUNT OF $54,451.00 RECOGNIZING FEDERAL AND STATE LAW
ENFORCEMENT FORFEITURE REVENUE RECEIVED THROUGH AUGUST
2014 AND PROCEEDS FROM THE SALE OF USED TASERS
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves a
budget adjustment, a copy of which is attached as Exhibit "A", in the total amount of $54,451.00
recognizing federal and state law enforcement forfeiture revenue received through August 2014
and proceeds from the sale of used Tasers through GovDeals.com.

SUBJECT: Federal and State Law Enforcement Forfeitures for Fayetteville Police
Department
RECOMMENDATION:
Staff recommends approval of a budget adjustment in the amount of $54,451 to
recognize federal/state law enforcement forfeiture revenue and replenish federal forfeiture funds
used to purchase new Tasers with proceeds from the sale of used Tasers received through
August 2014 and increase corresponding expense budgets.
BACKGROUND:
The Fayetteville Police Department receives forfeitures as a result of civil proceedings
concerning cash or property seized during a criminal investigation. Most of the forfeitures we
have received in the past are a direct result from the efforts of the officers we assign to the 4th
Judicial District Drug Task Force (4th DTF), the local office of the Federal Drug Enforcement
Agency (DEA), and the Internal Revenue Service (IRS) Financial Crimes Task Force. By
statute, federal and state forfeitures are to be spent for law enforcement purposes only. All
purchases utilizing these funds must follow the City of Fayetteville Purchasing Policy.
DISCUSSION:
Funds within this budget adjustment consist of Department of Justice funds which are
drug related federal forfeitures, State Asset Forfeiture funds which are drug related state
forfeitures, and the replenishment of federal forfeiture funds used to purchase new Tasers with
proceeds from the sale of our used Tasers via GovDeals.com. The requested budget
adjustment will recognize the following forfeitures and proceeds through August 2014: $3,794
from the Department of Justice; $37,642 from State Asset Forfeitures; and $13,015 from
proceeds from the sale of used Tasers via GovDeals.com.
BUDGET/STAFF IMPACT:
Our expense budget will increase equal to the revenue received through August 2014.
There is no staffing impact related to this budget adjustment.
