A RESOLUTION TO APPROVE THE EXTENSION OF THE CITY'S
SEWERAGE SYSTEM BEYOND THE CITY LIMITS TO A SINGLE
RESIDENCE LOCATED AT 55 S. HARVEY DOWELL ROAD
WHEREAS, §51.113(C) Sewer Service and Extension Policy states that "the city's
sewerage system shall not be extended outside the city's corporate limits except on the express
approval of the City Council," and;
WHEREAS, the homeowners are currently experiencing a septic system failure and
would be able to easily tap into the sewer main the City re-routed across their property in 2008.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves
and authorizes an extension of the City's sewerage system beyond the city limits to a single
residence located at 55 S. Harvey Dowell Road upon payment of all applicable tapping fees by
the property owner.

SUBJECT: A Resolution To Allow Extension Of Sewer Service Outside The City's
Corporate Limits To A Single Property on Harvey Dowell Road.
RECOMMENDATION:
Staff recommends approval of the request to allow extension of the sewer service outside the
City's corporate limits to a single residence located at 55 South Harvey Dowell Road.
BACKGROUND:
On June 12, 2014 the City received notification from the owner of 55 S. Harvey Dowell Road
that they had been experiencing problems with their septic system since the City installed a
sewer main in their driveway, front yard and field. This installation was in 2008. The owner is
requesting a connection to the sewer system in lieu of repairing the septic system.
DISCUSSION:
In 2008, a contractor working for the City rerouted a 42 -inch sewer pipe approximately 20 feet
deep around the house located at this address. Upon visual inspection of the property it is
evident that there is a failure of the septic system. The sewage is "ponding" on the surface of
the ground.
BUDGET/STAFF IMPACT:
The owner will have to agree to pay all applicable tapping fees.

§51.113(C) of the Code of Ordinances sets forth the City's policy for
extension of sewer services. That policy states:
Sewer extensions outside the city. Except for facilities needed to
serve property within the city's limits, such as major
transmission lines and pump stations to deliver sewage to
disposal sites, and except through contractual arrangements
with other municipal corporations, the city's sewerage system
shall not be extended outside the city's corporate limits except
on the express approval of the City Council.
The City has already located a 42 inch sewer main on this property and
allowing the property owner to hook into the City's line would not be
difficult and the costs involved (tapping fees) would be paid by the
property owner. However, since the property is located outside the
corporate limits of Fayetteville and is not a facility needed to serve
property within the city limits, the City Council must expressly approve
this arrangement.
