A RESOLUTION APPROVING AMENDMENT NO. 1 TO THE CONTRACT

$2,000.00 AND APPROVING A BUDGET ADJUSTMENT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves
Amendment No. 1 to the contract with Grubbs, Hoskyn, Barton & Wyatt, Inc. for the additional
amount of $8,000.00 for additional geotechnical evaluations of Tract 14 of the Fayetteville
Industrial Park, and further approves a project contingency of $2,000.00.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby approves a
budget adjustment, a copy of which is attached to this Resolution as Exhibit "A".

RECOMMENDATION
City Administration recommends approving Amendment No. 1 to the engineering contract with Grubbs,
Hoskyn, Barton & Wyatt, Inc., Consulting Engineers, for an additional $8,000, making the entire contract not to
exceed $27,600, for additional Geotechnical evaluations of tract 14 in the Industrial Park, approve a budget
adjustment, and approve a $2,000 contingency. Consultant selection was completed from Request for
Qualifications 13-01.
BACKGROUND
The City of Fayetteville owns several lots in the Industrial Park, and is marketing them for economic
development opportunities. A recent geotechnical evaluation of lot 10 on Morningside Drive identified
challenging soil conditions that would significantly increase the cost of the proposed Pacific Vet Group
development on that lot. As a result, we executed a $19,600 contract with Grubbs, Hoskyn, Barton & Wyatt,
Inc. to evaluate the other City owned lots that seem viable for PVG or other similar development. In that
contract, they only performed borings at areas that were easy to access; more expensive or invasive borings
would not be completed unless the initial evaluation proved a lot to be suitable for development. The contract
also allows for Grubbs Hoskyn, if directed in writing by the City, to conduct a phase I environmental site
assessment for one of the four lots. The attached aerial shows the specific lots involved, which are owned by
either the Water/Sewer or general funds.
The results of the initial phase of geotechnical evaluation indicated that tract 14, east of and adjacent to the
Water/ Sewer Operations Center, has potential for the PVG development. Using the results, PVG's engineers
developed a potential preliminary master plan for the tract (attached). Their plan shows development through
much of the tract, including a more wooded area in the northeast corner of the tract where the first phase of
borings did not investigate.
DISCUSSION
Under this amendment, Grubbs, Hoskyn will develop more detailed geotechnical information for tract 14,
including an estimated 15 additional borings. These borings will provide general geotechnical information of
consequence to foundation, floor slab and pavement design, and to site grading, basic infrastructure, and
construction considerations for storage and manufacturing facilities with light to moderate foundation loads.
Additionally, they will identify subsurface conditions that warrant further investigation. All of these additional
borings are in land owned by the general fund.
BUDGET IMPACT
The additional $8,000, and the $2,000 contingency, will come from the general fund. $9,600 of the original
investigation was Water/Sewer responsibility; $10,000 was general fund responsibility. The environmental
assessment, if required, has been split between the two funds for estimating purposes.

AMENDMENT I TO AGREEMENT

THIS Contract Amendment No. 1, dated tVZJA)2� �t7 , 2013, shall amend the original
contract between the City of Fayetteville, Arkansas and GRUBBS, HOSKYN, BARTON & WYATT,
INC. (hereinafter called GRUBBS, HOSKYN), dated 13 September, 2013.
This Contract Amendment No. 1 adds approximately fifteen (15) borings in the northeast corner of Lot 14
in the Industrial Park. All borings will be drilled to 10-ft depth or auger refusal except two borings which
will be drilled to 15-ft depth or auger refusal. Adequate laboratory testing will be performed on the soil
samples and a supplemental geotechnical feasibility report will be submitted for this lot.
The original contract is hereby modified as follows:
SECTION 5 - PAYMENTS TO ENGINEER
5.1 Replace the maximum not -to -exceed amount authorized for this Agreement of $19,600.00
with $27,600.00.
APPENDIX A — SCOPE OF SERVICES
3. b. Replace the total number of borings proposed of 37 with a total number of boring proposed of
52.
4. Payment to Engineer: Replace the not to exceed cost of these services of $19,600.00 with
$27,600.00.
